I disagree with the value the New York appraiser but on the ring as that is his opinion
EGL does the grading not meThey are a major worldwide lab who grades stones
All sales are finalCustomer has a copy if the signed terms and conditions
I did not charge for settingNot sure where the customer is coming up with this number
None of their appraisals are done by GIAThat is a labNot an appraisal company
I can charge what I want for a product and I sold this at a fair priceWe will continue to take the stance on not issuing a refund

Almost years ago *** *** came to my jewelry store and wanted to purchase a diamond engagement ringHe told me he wanted a carat cushion cut and then showed me a ring he wanted me to create for himWe showed him several
stones and he told me what his budget wasBased on his budget we showed him a stone that was D color and Siclarity with an EGL certificateHe did not want to spend more than that budget.nhe told us he wanted to do a layaway and we agreed thatWe went ahead and purchased a diamond specifically for him and told him we would buildnhim a ring specifically for himWe gave him the receipt and signed it describing the diamond and that it was certified by EGLWe showed him the certificate and diamond and he loved itHe loved the way ring lookedIt was exactly what he wanted and we gave him a very good priceAfter asking for payment after months he extended it to almost months and then year and then to almost years on layaway!!! I don't usually extend the terms like this but he told me he was out of work and he needed a little bit longer to pay it off and I agreed.ni never thought it would be almost years from the initial purchaseThe ring is gorgeous
His mom actually came to pay off the ring earlier this year and we shipped it to *** for themThe mom loved the ring and thought it was gorgeous*** loved the ring and thought it was gorgeousI got a phone call a couple weeks ago from ***'s mom saying they want a refund because his sons fiancé took the ring to another jeweler in new york and he said it was not good and worth a lot less and thatcher husband was an attorney and I needed to give them their money backI was so surprised as I gave *** a very fair prices for this custom made ring.mi told her that appraisals can vary and it is subjective and a matter of opinionThe diamond was certified nd we did not misrepresent anything*** has almost years with the invoice and we had this ring on hold for himNot question til now
I then get a phone call from the fiancé who went to get the ring appraised and said she wanted a refund because the diamond ring is not worth what they paidI also get calls from Hs dad saying he is an attorney and he wanted a refundI explained to everyone in the family that appraisals can vary and he bought a diamond that was certified by EGL and the sales are finalI told all of them to check market prices in stores for what carat custom made cushion cut diamond rings go for and I can also get them another appraisal stating otherwise.nthey all wanted a refund and then ***'s dad came to my storeHe came to my store basically telling me he wanted a refund and that I am ripping people offThis is not the caseI did not misrepresent and we gave him a very fair dealThe customer knew what they were buying for almost years
EGL is a very famous lab that is used widely by jewelers all around the worldThey have a set standard and we sold a diamond that they certifiedThey are less expensive than some diamonds that are certified with the same specification by GIA but the customer had a certain budget and this was the best diamond we could sell them for the budget which was $plus taxThee invoice was explained to the customer and he read it before signing it and knowing what he was buyingHe saw the diamond certificate before purchasing.
At no point throughout this entire matter did the customer *** ever call me *** *** to discuss the matterHis mom, fiancé and father have all asked for refund but we did give him a fair deal for the product he gotI sold him a diamond that came with a certificate from that labThey have a set standard of grading and the pricing is also reflected by that.
Every lab has their own way of grading and *** was educated very well about the differences between the labsI educated him on color, clarity and showed him a gorgeous diamondI do want to mention his fiancé said that the wholesale price should be significantly lower than the price of His father told us we are a rip off and jewelers take advantage and anyone can buy settings like this online and I told him I am not an online storeI amBrick and mortar store with overhead and I an entitled to a profitI gave his sons a great deal at a fair price and another appraiser is "knocking our product"
I told him he can get another appraisal from one of the most respected appraisers in town but he said he did not want to do thatWe have witnesses in our store listening to his tirade about how we rip people offI told him to do some more market research on custom made rings with a carat d color sicushion cut diamond with matching round brilliant diamond set in white gold before he judges a reputable 3rd generation jeweler after getting an appraisal from a competitor
We sold a product at a fair price and we did not misrepresentWe do not think it is appropriate to give a refundThey can exchange out the diamond for a better stone if they would like and pay the difference

*** *** is not explaining why the ring I purchased is worth significantly less than what I spent and also why the grading is inaccurate Many times throughout his response he comments on how everyone thought the ring was "gorgeous" This has absolutely no relevance in being taken advantage of His entire first paragraph is about how long I had the ring on lay-a-way I first put the ring on lay-a-way 6/15/and it was picked up in early December That is a year and a half, not two years Six months into the lay-a-way I explained I would not be able to make payments as I had relocated to be with my now fiancé in New York and my financial situation had changed *** did not want to give me a partial refund of my down payment I had to purchase the ring or lose the $I had put towards the purchase I even asked if I could use the money that I had already given him towards a different piece of jewelry and he said no Again, none of this is relevant to the complaint or issue at hand
Moving on, he stated how my fiancé brought the ring to a jeweler and the jeweler brought attention to the bad quality of the ring This is incorrect My fiancé brought her engagement ring to a GIA certified appraiser, as stated in the complaint, for insurance purposes *** also stated that no one has questioned the quality of the ring until nowthat is because my fiancé got her ring in December and then had an appraisal done in March He also stated that, "the fiancé said that the wholesale price should be significantly lower than the price of $3700." He may have misunderstood as she was stating that if something is advertised as a wholesale diamond the consumer should be paying less than the value of the diamond not more than the appraised value That does not make any sense
Lastly, *** did offer to have a GIA certified appraiser complete an appraisal on the ring but with our lack of trust in *** *** my father refused his offerMy father did take the ring, which is now in San Diego, to *** *** *** in San Diego on March 29, 2014, where all diamonds were graded using the Gemological Institute of America (G.I.A.) diamond grading nomenclature The findings of this appraisal were as such: "The diamond is accompanied by an EGL International Diamond Certificate but the grading of this diamond was not derived from this certificate as it is extremely inaccurate." "The color grade is H to I" , ***'s EGL International Certificate reports a color grade of D "The Clarity grade is SI2", ***'s EGL International Certificate reports a Clarity grade of SI"The Polish is Good", ***'s EGL International Certificate reports a polish of Excellent "The Symmetry is Good", ***'s EGL International Certificate reports Symmetry is Excellent Lastly, the replacement cost of the appraisal was $4, I paid $5,for the ring Lastly the appraiser said that I was overcharged for the fee to set the ring *** charged me $ I did ask a local jeweler about this and was told that it can cost as little as $to set a ring Also the appraiser from San Diego said that "There are no quality stamps or trademarks." This means that if *** claims it was a custom made ring, there is no stamp proving so
Purchasing an engagement ring goes beyond the financial value but more importantly has a sentimental value This is obviously not how I wanted the purchase of my fiance's engagement ring to turn out I do not have any trust in *** *** and I am still requesting a full refund so I may purchase my fiancé a new engagement ring at a more reputable jeweler I have had two appraisals done by G.I.A., the most accurate in the country, and so because of this I am confident in my complaint I would like a full refund of $5,

I have had multiple transactions with David (custom commissions) He has always taken the time and effort to make sure that whatever piece I have made is 100% I send friends, family, and whoever asks where I get such beautiful pieces from to David and his team The ONLY jeweler in San Diego to do business with
