I have reviewed the offer and/or response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.MrMosby did remit payment for the repairs to the brick work but only after being contacted by a reporter at Channel that gave him a deadline of 8/to remit payment or they would investigate my story. With respect to the garage doors, I agree they were not new or perfect. However, they only needed minor repairs and paint. There are matching garage doors and the one his employee did not damage is evidence that MrMosby is not being truthful. His statement that they were “puckered” is misleading. The vast majority of the door (99%) was in good shape. They did not have water damage as he stated and I can prove it because he damaged all of the other panels and not the one that needed the minor repairs. Again, the other door that he didn’t touch is evidence that cannot be disputed and proves he is not being truthful. After MrMosby’s employee power washed the door, it is now irreparably damaged. I have attached photos of the damage. I had Apple Door and Amelia Overheard Door Company come provide an estimate for repairing the doors and they stated they cannot be repaired. They gave me an estimate of $1,to replace the doors. Unfortunately, there are two identical garage doors and I can’t replace one without replacing the other. The original doors had windows but to save money I requested an estimate for the cheapest doors available that are uninsulated and do not have windows because I am not trying to be unreasonable and just want to be able to sell the house at the value it would have been marketed for prior to the damage caused by MrMosby. He should be responsible for replacing both doors because, had he not damaged the one door beyond repair, I would not be in the position of having to replace both doors to be able to sell the house. I should be made whole and put back into my original position before he damaged anything.I am having to sell my mother’s house to be able to provide for her care. I have recently had to move her to a memory care/assisted living facility because she suffers with dementia and I can’t afford to pay the monthly fee for her care much longer without having the funds from the sale of her house. She does not have the funds available to pay for the repairs associated with the damage caused by MrMosby and I will receive less money for the house “as is” than before he did any work on the house. He should be responsible for paying for the damage and not my mom having to be out of pocket or have to sell the house for substantially less due to his negligence. With respect to his statement that he never misrepresented himself about being licensed is untrue. MrMosby contacted me and stated he was done with the work on 7/and asked that we meet him to make payment that afternoon. He did not show up but I went to the house and this is when I noticed the damaged caused to the house. We called MrMosby that evening to express our concerns and we asked him to confirm he was licensed and insured which he replied “Yes”. We called MrMosby on 7/and asked him to bring his license and insurance information to our meeting scheduled for that afternoon so that we would have the information available should it become necessary to file a claim Again, during the call we asked him point blank if he was lying and was he truly licensed and insured and again he replied “Yes, he was licensed and insured” I sent MrMosby an email on 7/requesting him to provide his contractor's license and insurance information but he did not comply. On July 25th, he finally did meet us in person (after several cancellations) and he confessed in the presence of myself, husband and brother that he had lied and he was not licensed and insured but had been providing another contractor's license number which Mike Hogan, the realtor who recommended him, could attest to this fact because he had been given a contractor's number (per his email to me) which I’m assuming he hadn't verified that it was in MrMosby's name or he would have discovered he was not licensed When searching the DPOR website, MrMosby has never been licensed I used MrMosby under the recommendation of the realtor because my intention was to use him to list the house. Therefore, I did not confirm he was actually licensed and insured because I truly believed no realtor would recommend someone that wasn’t qualified, licensed and insured when they wanted to list a house for me. MrMosby made the comment that he thought he would never be in these circumstances that not being licensed and insured would ever be an issue. If he wasn’t misrepresenting himself as a licensed contractor, is he publically admitting to Chesterfield County, the DPOR, the Attorney General and every other agency that oversees contractors that he was willfully committing an illegal act? Please note my comment in the last paragraph because MrMosby has been quoted several times in the Richmond Free Press and each time he is listed as a home improvement contractor in Richmond.With respect to his statement that I wouldn't allow him to correct the issues, this statement is correct only because I cannot have an uninsured, unlicensed contractor on my property because, if he or his employees were injured on the property, then I would be personally responsible and he agreed that he would do the same if he was in my position I explained once he was insured and licensed I would let him make repairs and to please forward me his information as soon as it was received He explained he anticipated having all the necessary documents by 7/ I emailed him on 7/and he did not respond until 8/when he texted me that he had the paperwork and would provide it to my on 8/ On 8/7, I texted and emailed MrMosby my concerns that I hadn't received his license and insurance information as originally promised but I did not receive any response Only after I reported him to the Revdex.com, the DPOR, Chesterfield County for working in the county as an unlicensed contractor, the Attorney General's Office, and Channel did I receive any response A reporter from Channel called him and gave him until 8/to pay for the repairs to the brick work It was only then I received any response and that was only to pay me for the repair to the brick work. I believe, had it not been for the efforts of the reporter, I would have never heard from MrMosby or recovered any money. However, the money received is only a small portion of the total damaged caused by MrMosby.At this juncture, after having the work delayed on the house for over a month and him being unresponsive to any of my requests, I do not trust him and will not let him make any repairs. He has been unprofessional and his actions have been disreputable. I am in the process of getting an estimate for repairing the hardwood floors because he splattered paint and wall mud on all of the hardwood floors. He splattered paint and wall mud on all of the stained kitchen and bathroom cabinets, the tile floors, and the furniture that was in the center of the rooms that was covered to protect it. He got paint on the screen on the screened porch that he painted as well. His workmanship is inferior. I could only include four attachments but the one of the wall is representative of the entire house. He left wallpaper on the walls (which per the contract he was to remove all wallpaper) and covered it with drywall mud and then painted over the mud without priming it. The wallpaper subsequently has been pulling away from the wall because of the moisture in the mud. I’m certain he will deny this but where there was wallpaper below the toilets and in corners he didn’t remove it and I have pictures as evidence. He left paste and pieces of wallpaper on the wall which he painted over. When we tried to repair the walls ourselves, if you sanded anywhere, the paint peels off the wall in sheets because he didn’t prime the walls after applying skim coat or drywall mud. He painted latex paint over oil base paint on the doors and left huge drips on the doors. Again, when we tried to repair the doors, the paint peels off in sheets because he did not prime the doors before applying the latex. I work full time and commute hours a day to and from work and my husband works full time as well. We are at my mom’s house every Saturday and Sunday repairing and cleaning up behind MrMosby because I do not have the funds to pay someone. I have spent at least hours using a razor blade to scrap the paint and mud from each individual tile on the floor and in the showers/tubs because, he didn’t just get a little paint and mud on the floor, essentially the entire floor was covered along with the sinks and counter tops. The drywall mud was at least one inch thick in the bottom of the bath tub. I have been in the process of trying to gently remove the paint from the bathroom and kitchen cabinets. However, the stain is coming off of the cabinets, baseboards and chair rail because it requires so much scrubbing to remove the paint and drywall mud. It is hard to convey how much damage he has done. It is almost as if he purposefully splashed paint and mud on everything. It is truly incomprehensible and can only be believed when seen for yourself.MrMosby would be getting off easy if he paid for just the damage to the garage doors, brick work and damage to the walls that I had to pay another contractor to repair because I do not have the skills to do it myself. I am replacing the screen that has paint splashed on it, I have scraped the floors, walls, baseboards, cabinets, and furniture he splashed with paint and mud. I have cleaned up the thick layer of drywall dust he left behind that covered everything. I have fixed the gutter he stepped on and bent. I have sanded and filled the grooves he cut into the pedestrian door with the power washer. He damaged all sides of the house (the entire house is brick) but I only repaired the front because of the cost to repair the entire house was prohibitive and essentially we have only masked the damage and not truly fixed it because that would be even more expensive and time consuming.MrMosby still owes me for the damage caused inside that I had to pay another contractor to repair ($1,800), replacement of the garage doors ($1,084), and the repair of the hardwood floors at a minimum(to be determined). I should mention that MrMosby said he had completed all of the work to the house on 7/20. Per the contract (I can provide a copy signed by MrMosby), he was to remove all wallpaper; mud, sand, and skim coat all walls where wall paper was removed; paint the interior walls, one ceiling, and interior doors as needed; paint the exterior after sanding, scraping, and priming the handrails, front porch, bay windows, basement doors, garage doors, side porch, and columns on the back porch, and any other windows. He was to caulk, prime, and apply two coats of paint. In addition, he was to power wash the house. When I arrived at the house, none of the exterior of the house had been painted and the inside was not finished. He had circled large portions of every wall in the house with pencil which I was assuming those were areas he was indicating to his employees that still needed repair. I have at least pictures of the damage and condition of the walls when he was supposedly done with the job. I will not be satisfied until he has been held accountable for all of the damage caused by his employees and I have received restitution. Any unwary person that calls him should be on notice that he is not licensed. As of today, August 26th, he is still not listed on the DPORs website as being a licensed contractor and the total of the work he was to do for me was over $6,000. Being an unlicensed contractor is against the law.
