The consumer states that she hired Washburn Construction in August of 2016, and that the company did not start the job until the end of September As outlined in the proposal, Washburn Construction was to start the job on August 15, 2016, provided that the company be paid a total down payment of $30,The consumer did not pay the down payment of $30,needed for the materials until September 20, (days after the job was scheduled to start)Which put a halt on the job because without the money needed, the materials for the job could not be orderedThe consumer complains that the porch was not in compliance with the building code for the town, however, after completion of the job on November 10, 2016, the local code enforcement officer issued a Certificate of Compliance that meets all safety standardsSo there are no safety issues with the job done on the consumers houseI have attached the Compliance Certificate, the Permits, a copy of the proposal, and a copy of the first check given to me by the consumer dated 9-20-2016.The consumer complains that damages were caused inside the house by Washburn Construction, however, this was never brought to my attentionI do not know if this was damage that was already there prior to my company doing any work on the consumers houseThroughout the job, the consumer and her husband continually harassed me, my Secretary, and my employees that were on the job siteBecause we know the consumer on a personal level, as she is my Secretary's mother, they must have felt that it was OK to continue to send me, and my employees harassing text messages after the job was finished as wellI do not feel that my company needs to demolish the porch or the eaves and rebuild and replace them as the consumer wishes, as everything passed the safety code of the townI have offered to fix the one piece of siding that has popped out of place, however, in my attempts to go to the consumers home to fix the siding, I have gotten bombarded by her and her husband as soon as I get thereThis has created a hostile environment for me to try to work in and I no longer feel comfortable even setting foot on the propertyI have every intention of fixing the work that needs to be fixed if she were to stop harassing me and my employees so I could feel comfortable going to her home.Prior to my construction on the house, I noticed that the consumer had all of the old eaves troughs running into her drivewayThis caused the water pool and flood the driveway and it would freeze in the winter and create a sheet of ice making it dangerous for anyone parking or walking in the drivewayWhen my company replaced old eaves with the new, I had ran the new eaves to new spots that would prevent the driveway from flooding and freezingOnly after putting up the new eaves, the consumer complained and wanted them placed how they were prior to my workSo as per the consumers wishes, I halted construction again, tore down the new eaves that created damage to the new siding, reordered new siding and eaves, replaced the newly damaged pieces, and re-ran the eaves to her demandsSo now her driveway floods again and freezes in the winter. Also prior to construction, the consumer and I talked about insulating the attic crawl spaceAfter communicating with the consumer, she opted not to have the attic insulted because she would lose the little bit of storage space that was up thereThis was a verbal agreement between me and the consumer, therefore it was not added to the proposal of work that I was going to be doing.I took on this job for the consumer because I knew her on a personal levelI charged her $60,for a new roof, new siding, and a new wrap around porchI charged half of what the job initially cost because I know the consumer on a personal levelThe work that was done to the consumers home would easily cost $120,had she gone to someone that she did not personally knowI feel that the consumer used me to get a cheaper job done, and took advantage of the fact that we knew each other personallyBecause I knew her personally, there was never a contract establishedThe only paperwork established was the proposal of the work that I was going to be doing, and I never received a signed copy of the proposal from herMany of the complaints in her statement are simply not true and has fabricated a majority of it to try to make her case against my business strongerI have been a contractor and have owned my own business for years and I have never had an issue with a consumer until this one.I have also attached pictures of the new siding, roof and porch that my company constructed

The consumer states that she hired Washburn Construction in August of 2016, and that the company did not start the job until the end of September 2016. As outlined in the proposal, Washburn Construction was to start the job on August 15, 2016, provided that the company be paid a total down payment of $30,000. The consumer did not pay the down payment of $30,000 needed for the materials until September 20, 2016 (36 days after the job was scheduled to start). Which put a halt on the job because without the money needed, the materials for the job could not be ordered. The consumer complains that the porch was not in compliance with the building code for the town, however, after completion of the job on November 10, 2016, the local code enforcement officer issued a Certificate of Compliance that meets all safety standards. So there are no safety issues with the job done on the consumers house. I have attached the Compliance Certificate, the Permits, a copy of the proposal, and a copy of the first check given to me by the consumer dated 9-20-2016.The consumer complains that damages were caused inside the house by Washburn Construction, however, this was never brought to my attention. I do not know if this was damage that was already there prior to my company doing any work on the consumers house. Throughout the job, the consumer and her husband continually harassed me, my Secretary, and my employees that were on the job site. Because we know the consumer on a personal level, as she is my Secretary's mother, they must have felt that it was OK to continue to send me, and my employees harassing text messages after the job was finished as well. I do not feel that my company needs to demolish the porch or the eaves and rebuild and replace them as the consumer wishes, as everything passed the safety code of the town. I have offered to fix the one piece of siding that has popped out of place, however, in my attempts to go to the consumers home to fix the siding, I have gotten bombarded by her and her husband as soon as I get there. This has created a hostile environment for me to try to work in and I no longer feel comfortable even setting foot on the property. I have every intention of fixing the work that needs to be fixed if she were to stop harassing me and my employees so I could feel comfortable going to her home.Prior to my construction on the house, I noticed that the consumer had all of the old eaves troughs running into her driveway. This caused the water pool and flood the driveway and it would freeze in the winter and create a sheet of ice making it dangerous for anyone parking or walking in the driveway. When my company replaced old eaves with the new, I had ran the new eaves to new spots that would prevent the driveway from flooding and freezing. Only after putting up the new eaves, the consumer complained and wanted them placed how they were prior to my work. So as per the consumers wishes, I halted construction again, tore down the new eaves that created damage to the new siding, reordered new siding and eaves, replaced the newly damaged pieces, and re-ran the eaves to her demands. So now her driveway floods again and freezes in the winter. Also prior to construction, the consumer and I talked about insulating the attic crawl space. After communicating with the consumer, she opted not to have the attic insulted because she would lose the little bit of storage space that was up there. This was a verbal agreement between me and the consumer, therefore it was not added to the proposal of work that I was going to be doing.I took on this job for the consumer because I knew her on a personal level. I charged her $60,000 for a new roof, new siding, and a new wrap around porch. I charged half of what the job initially cost because I know the consumer on a personal level. The work that was done to the consumers home would easily cost $120,000 had she gone to someone that she did not personally know. I feel that the consumer used me to get a cheaper job done, and took advantage of the fact that we knew each other personally. Because I knew her personally, there was never a contract established. The only paperwork established was the proposal of the work that I was going to be doing, and I never received a signed copy of the proposal from her. Many of the complaints in her statement are simply not true and has fabricated a majority of it to try to make her case against my business stronger. I have been a contractor and have owned my own business for 12 years and I have never had an issue with a consumer until this one.I have also attached 18 pictures of the new siding, roof and porch that my company constructed.

I'm not asking for a new porch or roof I'm just asking for my siding to be fixed appropriately according to safety and code standards. I have several pictures that I will send to you of how the aiding looks to this day.
