I purchased a house 9 years ago, the roof has now began to leak, damaging my ceiling. By be having home owners insurance I called them out to inspect the damage. The adjusted told me my roof is not covered because the builder did not put Felt Paper under the shingles or Valley Roofing in the creases of the roof top to safe guard any leakage. Therefore he told me to see if the builder would come back out to replace the roof, cause it's in the building code or that I may have to contact the Revdex.com or Attorney General. What can I do, contact me at [redacted], please sir or ma'am let me know is there anything I can do to get my roof fixed. It's sad when you have paid insurance for such reason as these, even when the adjusted see the problem but cant help because the house wasn't completed properly. I'm not sure bur I thought when you get insurance they come out an appraise the house before they insure it. Shouldn't they have noticed this issue before it got to this point. This house shouldn't have passed inspected, by this material being as a code.Business Response Into response to the above complaint, the property was originally built for rental. The complainent lived in the property for one prior to purchasing it. I discounted it for less than the appraised value and gave a one year warranty at the time of sale. When informed about the leak by the insurance company they stated that her deductible was $2000.00 which was more than the cost of repair. I offered to send an estimator out but she said forget it..The roof is now about Thirteen yrs old so I feel that the issue is with the Insurance company and not me.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)First of all, I did not rent my home a year prior to purchasing it, that's incorrect. My husband and I did a lease to purchase from [redacted] & [redacted] and yes, he was using it as rental property but there was also a for sale sign posted in the front yard. As to what he sold the house for is not my concern, we didn't ask for a discount, we ask how much was he selling it for and he gave us the price of $150,000. He asks that we pay $5,000 down and to take up the house note which was $1183, to build up our credit. I don't know anything about a one year warranty because it was never discussed with me. I do know, [redacted] told us a lot of things that wasn't done, but I looked pass it. I accepted many lies from [redacted], putting them behind me. [redacted], told my husband and myself he was going to come in an touch up the walls and that he was also going to finish the attic which was not completed, the flooring wasn't down, ceiling nor the walls was put up. There was open installation just tacked to the wall no plywood or any form of covering. [redacted] had a key to my home in order to get these things done but never came over to do any of them. I spoke with him about it later on and he told me y'all done bought it now it not my responsibility, so at that time I changed my locks. Again I accepted it because somehow we are supposed to be related. I call [redacted] about my roof, I told him what the insurance adjusted said about the roof, that it's not covered because the roofers didn't put felt paper or valley roofing under the shingles to protect the roof from leaking. He stated, "That house is 11 years old that warranty is out", now as to his statement he's saying the house is actually 13yrs old. Neither here nor there, I than told him I understand the warranty part but you should be responsible for your work not me. I'm not asking you to correct the whole roof just the valley roofing so the leak will stop. He then told me he will have someone to look at it and give me an estimation of what it will cost to fix it, I then told him I shouldn't be responsible for something your contractors didn't do. You hired them and if it was done right I wouldn't have to call you, my insurance would have fixed it. I also told him, it's like I'm paying for insurance and it won't protect my roofing cause of something you done and now you won't stand up for work you did. The adjusted explained to me that the housing code is there for a reason, as for as your roofing, it's important because it stands as a second protector in protecting the roof on the house. I never told him "forget it" that is also untrue. [redacted] called [redacted], which is our insurance agent with [redacted] after I spoke with him and they discuss the situation at hand. [redacted] is the agent for majority all the homes in my area per [redacted] recommendation when purchasing home. But mine you, I spoke with [redacted] before I call [redacted] about what the adjusted said about the roofing and he instructed me to call [redacted] told me [redacted] is a good man and I know he will stand up to his work and correct that problem for you. [redacted] discussed my insurance policy with [redacted] given him my deductible, which was not his business, that's my personal information, which is a breach of confidentiality on his part and I [redacted] be contacting [redacted] on that behalf as well. After he called [redacted] the insurance agent, [redacted] called me back, saying well your deductible is $2000, I can go on and fix it $400 or $500 dollars. I told him, it don't matter what my deductible is, you sold me a home and the roof is incomplete. No matter what goes wrong with my roof no insurance company will touch it because he didn't follow the building regulation code for roofing. Whoever inspected this house did a shady job and they are trying to make me pay twice for something that wasn't done as for as the building regulation code. I also spoke with the [redacted] about the stature of limitation and explained to them the situation at hand. They informed me that the warranty was invalid at the time the roof was installed, seeing that the roof was improperly installed. Final Business Response This correspondence is on behalf of [redacted]. We have received the response from [redacted] tried in good faith to work with [redacted] even though he was not at fault. He regrets that the offer to resolve the matter was not accepted.
