The two decks for the customer Mr [redacted] , at [redacted] *** Street, [redacted] , were completed on 8/8/2013, and at the completion of the project, the customer was satisfied with the final work and paid us in fullPrior to accepting the job outlined above, we advised the customer that both decks had been painted by another painter, who used an inferior product and an improper application method The customer contacted us in May, approximately months laterHe stated that the decks finish was lifting We agreed to attempt to again refinish the decks, as my schedule allowedWe are sorry we have not been able to reach an agreed to date to return to the projectWe would like to suggest we attempt to refinish the decks again, which is the customer’s desire also Unfortunately, due to the lateness of the season and the fact that the weather is too cold to permit us to work on the decks with any success, we would like to work on the decks in the spring I will attempt to make an appointment with the customer now to schedule the work Once again, we agree to work on the decks but we have to remind and advise the customer that both decks have been painted by another painter, who used an inferior product and an improper application method We will again remind the customer that we will again attempt to repair the damage as best we can due to the circumstances Thank you

I am rejecting this response because:  Prior
to contracting  the job to Davis
Pro Painting, I
was assured by [redacted] that both decks (which had been painted by another
painter who used a [redacted] deck stain ) would be able to be strip and redone to my satisfaction. I agree with his statement that I paid in full however
within a week I contacted [redacted] and advised him that there were areas that were
missed and needed touching up,  the touch up areas do not match in color. I just
feel that he should have made time in busy schedule to redo my decks as I
had been in contact with him starting May thru September trying to get him to come
back and fix his work.... I should be the first job he does in 2015 as this has
gone on long enough !!!

Review: On 5/28/2013 I entered in to contract with Davis Pro Painting of [redacted]. The contract was to strip and re-stain 2 wood decks and a small ramp at my property at [redacted] this is a duplex and each side has a deck located in the rear of the house. [redacted] the owner agreed to perform the work for $ 1,000.00 on 5/28/13 I issued Check # [redacted] from my [redacted] checking account for $ 600.00 for startup and on 8/9/13 I issued check # [redacted] for the remaining balance.

Here is a timeline of what has transpired to date:

6/4/2013: Davis Pro Painting started the job and was having an issue with stripping the decks he advised me that he would have to put a solid decking stain on the decks not a ploy stain as we originally agreed upon I advised [redacted] that this was acceptable to me.

8/1/2013: Davis Pro Painting advised me, via a text message that the job was finished and the decks look great.

8/4/13: Via a text message I sent a photo and advised [redacted] that there were several areas that I would tape up that need to be fixed before I would make the final payment.

8/8/13: [redacted] texted me a said that all touchup was completed and would stop by on 8/9/13 Pick up a check which he did.

5/10/14: I sent [redacted] a texted requesting that he call me, as there were issues with the deck.

5/11/14: [redacted] called me and I advised him that the stain was lifting up all over the deck. [redacted] stopped by on a Sunday in late May or early June and was shown the issues he told me that he wanted to bring a employee of [redacted] by to look at the issue he assured me that he would completely redo the decks.

6/20/14: I texted [redacted] asking him what was going on, I included a photo showing him that the decks where getting worse. NO REPLY

6/29/14: I texted [redacted] again asking him when he was going to redo my decks. Again NO REPLY

8/20/14: I called [redacted] and finally got to talk to him, he stated that he still has full intention on redoing my decks and make right on our original contract and he told me that he was on a job and when he got home he would check his schedule and get back to me that night with a date that he would redo my decks. I never heard back form him that night.

6/20/14: I texted [redacted] asking him what was going on, I included a photo showing him that the decks where getting worse. NO REPLY

8/23/14: I texted [redacted] asking him what was going on. NO REPLY

9/27/14: I texted [redacted] asking him what was going on. NO REPLY

10/19/14: I called [redacted] asking him what was going on. NO REPLY

I feel that I have been more than fair and reasonable with Davis Pro-Painting it seems to me that he has absolutely no intentions on redoing my decks. I have photos. text messages, emails and phone records to confirm most everything that I have stated in my complaint.Desired Settlement: I would like to have my decks stripped and redone as [redacted] stated he would do.
