I am writing in response to *** ***'s complaint placed on 11/13/at 10:AMA member of our office staff did in fact speak with him on two separate occasions about this matter via phoneBoth times he was very irate, shouting at us about his security depositWe informed him that we did
not have a forwarding address for him, something that is the tenant's responsibility to provide, and thus we could not at that time send him his refund checkHe provided us with his forwarding address in one of these conversationsWe also informed him that his behavior was unwarranted and that any further contact with him would be via emailHe continued to call and harass us, his phone call total was nowhere near times, as stated in his complaint, but was mildly incessantHe refused to contact us via email, but once he realized that this was another avenue to harass us, he took advantage of thisHe took to name calling, threats to our other businesses and threats also to our ownerWe have both saved emails and voicemails in which he, amongst other things, calls us "sg liars" repeatedly and threatens to picket our coffee shop, a business that has nothing to do with our realty companyHe also took to social media to slander our name and to in his words "protest." His security deposit was refunded in full for $was placed in the mail the date that we notified him that it wasThe postal service is not something that we have control overFrom his move out date to the date when he received the check it was about forty daysNYS Renters Law states that a tenant's security deposit must be returned "in a reasonable amount of time." Which even with a delay in receiving his forwarding address, we believe was doneOnce he received the check we thought the matter was settled but he counteredHe, as stated in his complaint, claimed that he was to receive the interest earned on his security deposit for the time he lived in the apartmentAs per NYS Renters Law, this is only to occur in buildings with six or more unitsHe lived in a three unit building and thus did not receive the interest that was in fact not due to himWe informed him of this in response to one of his many threatening emailsWe also took this opportunity, due to him threatening to take legal action, to inform him that we have seen him slandering our company on ***His posts disappeared the next dayIn conclusion and response to his Desired Settlement, he did receive his full security deposit totaling to $400.00, as we saw because he posted about it on ***No interest is due to him because of the size of his unit per the NYS Renters Law; and at this time we do not feel comfortable speaking to him on the phone due to his behaviorSince he has received what was due to him in full we consider this matter to be settled and have received no further contact from himThank you for your time, Boulder Realty
