We are in receipt of the complaint from our
former client [redacted] and would like to respond.
It is true that we pulled off of their project at the
punch list phase, but we did not do so lightly.   We made a generous
offer to settle our differences with these...

clients. That offer is copied below.
On June 22, 2015, we sent:

At this point, we do not feel that we can adequately satisfy you
and do not feel that, when all work is complete, that we will be paid the final
payment. Therefore, we recommend that you keep the final payment and arrange
for completion of the remaining work and repairs directly.   For HVAC
work, you can contact [redacted] at [XXXX]. He
will run the condensate line to an area outside the house to meet code and
there will be no charge to do so.  After that work is complete, you may
contact call for your final inspection with [redacted] at [redacted] at [xxxx].  You will be responsible for any remaining issues, both
present and future.  Landis will not be responsible for any warranty work
moving forward.  Please acknowledge receipt of this
proposal.    If acceptable, please indicate your acceptance.

They never responded to this email nor have they to
date.  When they decided next to contact us, it was not to reply to the offer
of settlement; it was to make accusations as if we had not sent the above email.
Because we did not hear back from them, we assumed they accepted our offer. 
Plus, we knew that they had contacted at least one of our subs to complete
minor repairs that we had already paid the sub to do.
In their complaint to the Revdex.com, they note $15,000 as a
disputed amount.  Let’s be clear that the unpaid balance of our design and
construction agreement is $14,000.  The accusation that WE owe them money
is blatantly false. They should have easily been able to complete the work on
the punch list and failed final inspection work for at most two or three
thousand dollars.  All of our subs were paid in full and only needed to be
contacted to correct any issues they might have had. 
In summary: We did not, nor will we bill these clients
for the contract balance of $14,000.  We know based upon their recent
third party inspection report that they only have one minor code correction to
complete. Our contract with them states that in the event of a dispute, we will
go to binding arbitration to resolve any differences.  If [redacted] and [redacted] are not willing
to accept our offer stated above, we remain willing to go to binding
arbitration.
