Service contract to remove trees and grind stumps. Trees remove and some stumps ground down except for one.
On 10/3/17 trees removed as contracted. Was told stumps to be removed within few days. All but one large tree stump was not ground down as contracted to do. Called company at least three times since then. At first was told last stump would be removed that week. Next told machine unable to gain access to area but would find smaller stump grinder. Next, unable to find grinder and asked if he could come to cut stump to ground level. I agreed to try it to see if result would acceptable. Alex said he would be there by end of the week (10 days ago). Never showed up so last call I made was suggestion to remove adjacent bush to gain access to tree stump with grinder. No response received so after 4 calls and poor response I decided to file this complaint in the hope the work will be completed. I paid in full on the day the trees were removed on the good faith that stumps would be removed as promised. Thank you
Remove the adjacent bush which has some damage from the tree removal and grind the bush and tree stump. Or, pay three hundred dollars back to me to hire someone to finish the job
In conversation with the customer we have explained that we would be happy to return the actual cost of the stump removal in the amount of $45 so he can make other arrangements regarding it's removal. In our expert opinion the removal of the large bush, which we were not contracted to do, will cause damage to his water well and A/C.
Reasonably, if the customer wishes to have the bush removed, we would require payment of our labor for the removal and that he sign a waiver absolving us of any liability in regards to his water well and A/C.

No one from Daytona Tree ever offered money to me in any amount for removal of the stump. There is no one in volusia county who would provide stump removal especially a stump of this size for $45 So since Alex wants to provide such poor customer service the I suggest bypassing his company obtaining two quotes from reputable companies to remove the stump. This service to be paid by Daytona tree service. Remember Alex took my payment in full and has failed to finish the job. Alex surveyed the site before service was provided and an issue about removing this stump never surfaced. When I made payment in full to Alex' son after the tree removal he accepted payment saying that the stumps would be removed within a few days. In fact a representative from the stump removal group surveyed the site a few days before stumps were removed and he did not mention a problem with access to the stump that still hasn't been removed.
Alex failed to mention his failure to show up on two occasions as promised to take care of the issue. So I guess I am viewed as a nuisance because a bulk of the work was completed but an agreement is agreement but so far Alex actions have proven less than honorable
In summary I believe there is a breach of contract. An offer of $45 is ridiculous as Alex well knows. It is the responsibility of Daytona tree inc to fulfill the service agreement. they should find the correct stump grinder that will fit the location of the stump. If they are unwilling then they should be found in default of contract and meet my request made in original complaint.

The stump was cut down to ground level and can now be covered with mulch so it won't be visible and not be a safety issue. I am satisfied with the remedy. Thank you
We are resolved to try to take care of this matter for the customer. We will attempt removing the stump as the experienced member of our team is back in operation. Everyone has a time-line and we try to handle our work as quickly as possible but unforeseen circumstances do arise. We apologize for any misunderstandings.
