I would like to address a few of the items brought about in the response from Dazzle dated First and foremost, we do not believe that Dazzle has adequately addressed our inital complaintThey did provide a great detail of information in their response, however, we did not ask for additional information in our complaintWe asked for them to address our complaint which is that we are unhappy with the quality of our lawnThat is the bottom line hereWe do not believe that Dazzle has provided us with a quality lawn and we do not feel we should have to pay the remaining amount on the contract before they come out to do any 'warranty' type work (i.ereseeding areas over square foot)Let me address their response in order as they listed it:Payment: To imply that we did not make timely monthly payments is completely inaccurate as the customer inquiry report that Dazzle attached to their response indicatesIf you look closely at the report, you can easily see that we made $payments each month starting in February, and continuing until August, when this dispute reached a breaking point and we went to the Revdex.com with our complaintIn December, we made a $1,payment that covered November, December and January paymentsThe assertion that "each payment spreads over different services and none of them are paid up at this point" appears to us to be a convenient way for Dazzle to obscure the facts and make it look better for them and worse for us as if we have been shirking our duties of making timely paymentsThe reality of the situation is that we were requested to make a $4,downpayment prior to them starting the installation of the sprinkler system, landscaping beds and lawn and we made the downpaymentThat downpayment was primarily for the sprinkler system as that is more labor and material intensive than the planting of the lawnAs we stated in our initial complaint, we believe that remaining $4,we have paid to Dazzle more than covers the sprinkler system, landscaping beds and a portion of the fertilizer treatments and lawnGrading: Dazzle continues to misunderstand our issues with the grading and they continue to hold onto the excuse that "it is a violation of city ordinance to alter final grade." Dazzle added yards of topsoil to our yard during the planting of the lawnWhile we understand they did not appreciably change the grade in our yard, this yards of topsoil was placed there to aid in lawn growth AND to level out areas adjacent to the sidewalk and driveway per our discussion with DazzleOur major issue with the grading is that we have numerous low spots in our yard adjacent to the sprinkler control box behind our house, adjacent to multiple sprinkler heads and along the sidewalk and drivewayThese low spots have caused ponding in the middle of our yardWe are not talking about the drainage swale, or lack thereof, along the back side of our propertyIn fact, we have paid another landscaper to help us fix that due to the fact that Dazzle has been fighting us on it and that we didn't trust that they would do an adequate jobWe have requested that they come and adjust the elevation of the sprinkler heads where needed and also the control box behind our houseWe also wanted them to fix the gaps adjacent to the sidewalk and drivewayBoth of those are safety concerns of ours since we have small children who play in our yard and they can easily be injured by tripping over the exposed control box/sprinkler heads as well as by stepping into the gaps along the edge of sidewalk and drivewayAdditionallly, there are numerous areas of "up & down grading" throughout the yard which make it look terrible and are a safety hazard to our childrenWe are talking about a potential safety hazard for young children, ourselves and our guests and Dazzle does not seem to care about that one way or the otherWe would be happy to pass along to Dazzle any future medical costs caused by somebody getting injured by tripping on the exposed sprinkler control box, sprinkler heads or in the gaps adjacent to the sidewalk The existing low spots around the sprinkler heads are constantly flooded whenever it rains or when we run the sprinkler systemIn fact, they are wet for days after it rains even when we don't run the sprinkler system and the sun would typically have dried out the area in questionOur other issue is potential injuries to any guests we entertain in our yard given the low spots, raised sprinkler heads and control boxWhen Dazzle states "I am somewhat confused as to why they are trying to blame Dazzle Lawn Care for grading, water ponding" it is simply because these issues within the middle of our yard were caused by Dazzle and not by other landscapers adjacent to our yard.Lawn Quality: We appreciate the lesson in how to grow a quality lawn, however, that is not what we asked for in our complaintWe asked for the poor quality lawn to be addressedIn reference to the assertion that new construction is back filled with stones, chunks of concrete, etcwe feel that that is not our problemIn the contract we signed, Dazzle indicated that "they would work the soil approximately 2" deep with the eliminator, use of the rock hound, disposal of rocks, hand raking as necessary." Please refer to the attached photo of the 3' diameter, pound chunk of concrete that I dug up by hand that I found in our yard and had to have the builder come and remove since it was so largeThis concrete chunk was exposed above the level of topsoil but Dazzle somehow missed itWe also found a 3' long tree root, the top of which was exposed and that Dazzle somehow missed during their "hand raking if necessary" workI personally removed hundreds of small to midsize rocks from the lawn by just walking around with a bucket and picking them up by handWe even had Dazzle out to look at the lawn in the Spring and at the time he indicated "maybe we could have done a better job with the rockhounding..." but that was the best answer we gotWe have numerous bare areas that are greater than square foot but Dazzle refused to take any blame for those areas.Dazzle likes to point out that they replaced the Japanese Maple tree that died over the winter but that it wasn't their fault because we had such a severe winterThey like to make excuses to blame their poor quality work on everything from Mother Nature, to the builder using our lot as a dumping ground, to also blaming us for removing rocks and/or raking away the molding, disgusting straw mulch that was leftover during the SpringIn our mind, these types of excuses indicate poor customer service and are not what we were looking for when we entered into a contract with themWe do not believe that they have been more than fair in addressing our primary concerns of the aforementioned safety and grading issuesNevermind the fact that we still feel there is an issue with the sprinkler system leaking that needs to be addressed and that they have utterly refused to look atPlease advise as the next step in this process.Thanks*** & [redacted]

Our response to complaint:
Please remember that our mail comes to P.OBox and we do not pick it up every day
There are different issues we are trying to resolve payment, grading and lawn quality 1) Payment-The attached copy of contract that we entered with Mr& Mrs***
offers a discount package pricing for lawn, sprinkler system and landscaping installation, or pricing for each separate service that are listed next to themMr& Mrs*** purchased services as a package dealTherefore each payment spreads over different services and none of them are paid up at this pointThere is a clause in the contract which states that invoice need to be paid in full for any warranty to be in effectThere is also a clause about service charge on a past due
balanceDazzle Lawn Care Incand Mr& Mrs*** also entered into a maintenance contract in the beginning of May for fertilizer program which also has a service charge Attached customer inquiry report shows that Mr& Mrs*** are not following with the contract obligation in regards to timely monthly payments furthermore they did not make any payments on the fertilizer contract
2) Grading-There is no where in our contract or we do not verbally offer to provide, repair or change final grading, it is a violation of city ordinance to alter final grade which is designed by the engineer, completed by the builder and approved by the cityWe have discussed that issue with Mr& Mrs*** as we do with all of our customers prior to signing the contract during and after the lawn installationAttached email conversation between Mr& Mrs*** and *** *** *** which was forwarded to us by ***s it shows that they have a good understanding who is to be responsible of the final grading of their propertyI am somewhat
confused why at this time they are trying to blame Dazzle Lawn Care for grading, water pending
3) Lawn quality-Dazzle Lawn Care has been in business and planting grass for over years, we have knowledge and understanding what it takes to develop and grow lush healthy lawnWe take great effort to do the best job possible seeding the lawn, explaining and helping the homeowner to develop itThere are numerous factors which effect germination, growing, and establishing a new seeded lawn
Sub soil-a lot of new construction is back filled with dirt which in some instances comes with stones, chunks of concrete, tree roots, and construction debris creating a poor environment for grass seeds Time of the year and weather conditioour climate lawns could be seeded starting from spring into middle of October, in my opinion best results are achieved with lawns seeded between August and September
Weather conditions-soil/air temperature rainfall and heavy downpours, wind and storms and others are weather conditions beyond our control which will have a great impact on new seeded lawns Top soil-because of the poor sub soil conditions and some grading imperfections we offer to spread the top soil before seeding the lawnIt is up to the homeowner discretion on how much they want to spend on top soil to improve bedding for planted grass seedsEven though a thin layer of top soil might not have long lasting effect on a new lawn, greatly improves bedding, germination, and speeds up establishment of a new lawn
Maintenance-proper maintenance of a newly seeded lawn is where the homeowner can greatly influence lawn establishmentStarting with correct watering, proper mowing height and frequency and most importantly proper fertilizer program, taking advantage early spring and late summer/fall weather conditions to feed the lawnBlue grass and rye grass are cool season type of grasses which grow the best in the spring and late summer/fall when there is plenty of rainfall and cool temperatureIn the middle of summer when the temperature goes over degrees even with regular irrigation those grasses will struggle as they fight the heat insect and fungus
Looking at the new lawn installation portion of our contract you will find that we offer soil preparation, rock hounding, seeding, straw and starter fertilizerWe commit to one visit and reseeding areas that are bigger then square footBecause of the reasons listed above we do not offer any warranties or satisfaction guarantees on a new lawnWith the contract we provide general watering tips, seeds specifications, general guidance how to care and what to expect from a new lawn, we also offer unlimited support and guidance and try to help customers understand, explain what it takes to develop and grow a health lawn
Attached email conversations shows that Dazzle Lawn Care has been very responsive to our contract obligationsCustomers satisfaction is very important for us, it is our main goal and is keeping us in business for over years.
We feel we have been more then fair in our contract obligation to Mr& Mrs***Their statement that because they do not like their lawn at this point they should not be paying the remainder of their contract is unacceptable to us

I would like to address a few of the items brought about in the response from Dazzle dated 10.17.14. First and foremost, we do not believe that Dazzle has adequately addressed our inital complaint. They did provide a great detail of information in their response, however, we did not ask for additional information in our complaint. We asked for them to address our complaint which is that we are unhappy with the quality of our lawn. That is the bottom line here. We do not believe that Dazzle has provided us with a quality lawn and we do not feel we should have to pay the remaining amount on the contract before they come out to do any 'warranty' type work (i.e. reseeding areas over 1 square foot). Let me address their response in order as they listed it:Payment: To imply that we did not make timely monthly payments is completely inaccurate as the customer inquiry report that Dazzle attached to their response indicates. If you look closely at the report, you can easily see that we made $500 payments each month starting in February, 2014 and continuing until August, 2014 when this dispute reached a breaking point and we went to the Revdex.com with our complaint. In December, 2013 we made a $1,500 payment that covered November, December and January payments. The assertion that "each payment spreads over different services and none of them are paid up at this point" appears to us to be a convenient way for Dazzle to obscure the facts and make it look better for them and worse for us as if we have been shirking our duties of making timely payments. The reality of the situation is that we were requested to make a $4,000 downpayment prior to them starting the installation of the sprinkler system, landscaping beds and lawn and we made the downpayment. As we stated in our initial complaint, we believe that remaining $4,500 we have paid to Dazzle more than covers the sprinkler system, landscaping beds and a portion of the fertilizer treatments and lawn. Grading: Dazzle continues to misunderstand our issues with the grading and they continue to hold onto the excuse that "it is a violation of city ordinance to alter final grade." Dazzle added 20 yards of topsoil to our yard during the planting of the lawn. While we understand they did not appreciably change the grade in our yard, this 20 yards of topsoil was placed there to aid in lawn growth AND to level out areas adjacent to the sidewalk and driveway per our discussion with Dazzle. Our major issue with the grading is that we have numerous low spots in our yard adjacent to the sprinkler control box behind our house, adjacent to multiple sprinkler heads and along the sidewalk and driveway. These low spots have caused ponding in the middle of our yard. We are not talking about the drainage swale, or lack thereof, along the back side of our property.
