He also did do a notice to vacate to leave as of August 31, As of today I still don’t have possession of the unit he asked to vacate. Here is our policy per our lease agreement in regards to breaking a lease. LEASE TERM This Lease is for the term of _12_ months Tenant shall give not less than sixty (60) days written notice, prior to the expiration date of the Lease term, of their intention to vacate the Premises at the end of this term, which notice must be in writing and transmitted in person or by mail (notice must be received on or before the 1st of the month in which Tenant intends to vacate the Premises) Any holding over by the Tenant after the term of this Lease has expired shall not constitute a renewal of this Lease and such continued occupancy shall not defeat Landlord's right to possession of the Premises Should the Tenant occupy the suite under a month-to-month tenancy, Tenant agrees to pay an additional monthly charge of Seventy Five and NO/Dollars ($75.00) for the month-to-month residency Landlord may give written notice to Tenant, not less than sixty (60) days prior to expiration date of the aforementioned Lease term, of its intention to renew this Lease If Landlord fails to give said written notice, the Lease term will expire as per the terms of this Apartment Lease If Tenant occupies the suite for any day in a month, Tenant shall be liable for the full month's rent Tenant also understands that if, for any reason, Tenant vacates the Premises during the term of this Lease Agreement and returns possession of the Premises to Agent, Tenant agrees to pay to Agent a Lease Breakage Fee of $ Payment of said sum shall, in no way, relieve Tenant from its obligations under this Lease Agreement, but shall be paid in addition to other amounts due under this Lease Agreement as outlined above. Our lease also requires that the resident pay back any promotions that he has received *** *** was receiving a monthly promotional discount of $per month.As of September 11, as far as I know he has not vacated the unit He is now late on his rent and I have to file an eviction in order to regain possession of my unit We have made daily calls to *** for rent payment and or to get his keys to the unit.The unit has not been re-rented and he and his co-signer are responsible for the lease until the time the unit has been rented again.*** *** also received a letter form us on August 4th stating that we had received his letter of notice to vacate and that we had received his $termination fee It also states that he is responsible for his lease until the unit is re-rented So his accusations that he has had no contact with us are false We have had multiple conversation with him in regards to this situation..His statement about us not talking to the “Islander are also false Both myself and my assistant spoke to them over half a dozen times if not more. We don’t cancel leases because of a doctor’s note Our leases are a legal binding contract between both parties.I should also mentioned that *** *** came to us in July and asked us to rent a two bedroom on the 1st floor We took a unit of the market for him He was to sign the new lease on Monday, July 20th and begin his transfer but on that date we received a “Residency Verification” form to be completed I can’t send you a copy of the completed verification due to privacy protection laws The form he claimed we never filled out is not true. As of today, September 11, I still don’t have possession of the unit I still don’t have rent for this month I am now put in to position that I will have to file an eviction on him to gain possession of my unit We have tried every day since the 1st to reach him Sometimes his phone just rings and other times either myself or my assistant have left him messages We have had absolutely no communication with him.We now in the last two months have lost revenue on two units due to his actions.*** *** has continue to be ongoing problem with us at *** *** From visits from the police department to issue with his girlfriend We have worked with *** *** since day one to give him a great living environment. At the end of the day *** *** has not held up to his end of the agreement of his lease term with us He is upset because his sister is a co-signer on his new lease that was executed on May 14, We will have to file on both parties He is upset because we won’t let him out of his lease The place that the resident verification came from was the same apartment and lay out that we had held from him It also was a 1st floor unit and it was even cheaper than the unit that he was moving to In my opinion this is all because we wouldn’t release him from his lease with no penalty.Please feel free to contact me with any additional questions.Thank you.Donna T*** Donna T***Property Manager*** *** Apartments*** (office)***(fax)***www.fawnlakeapartments.com
