I am rejecting this response because:  The man is lying and copiously.  There was never any arrangement in regards to number of trailer loads.  Ir was clearly agreed that the job was to remove ALL of the limbs and debris.  To arrange otherwise would be ridiculous. He had never been told that the limbs had been cut up and ready for pickup.  This is stupid.  He was standing right there surveying the limbs before he gave the estimate for the job.  I did tell him that a few limbs against the fence had been cut up to remove them to my side of the fence.  He knew exactly what the job was when he gave the estimate.  I had even discussed with him how hard and heavy the wood was.  He agreed with me that the work would probably be 3 loads... possibly even 4.  I asked him if he wanted my help with the job and he said 'no'..

The facts are these... He did not have the physical strength or the correct tools to do this job.  He was using a polesaw to cut up downed limbs.  I had tried that and found a regular chainsaw much faster and easier.  He simply isn't strong enough to perform jobs that require numerous squats.  So he panicked after the second load and came to me and said " For the first time I'm going to do something.. I'm going to have to ask you for more money."  I said no, that he was getting better than triple minimun wage at the fee I had paid him.  He took off.  He then called later and asked if I could help him the next day.  I said yes, and he agreed he'd be there around noon.  He never showed up.  When I called him the next morning he became agitated when I asked about finishing the job (I asked him 'so when are you going to come over").. His voice became high pitched and he squeeched out "What if I come over there and kick your as and put a bullet in your brain?

I ended the call and called the Yuba County Sheriff.  They came by and took a report.

Other misstatements.  I only called this man four times that week.  the last time was to let him know that I was not just going to let this go.  That he had stolen money from a 79 year old Vietnam Veteran, and I thought elderly persons needed protection  from people like him.. I never threatened him or his wife.. certainly not in the way he threatened me.  I put a counter ad up to his on Craigs List... which is my right as a consumer to do.  If he has evidence of me threatening him, let him produce it.

I need a complete refind... What work he did is useless to me.. what I needed was ALL the debris removed.. and that was what I hired him for.  You don't build half a bridge and then think you are going to get paid. for it.  Half a bridge is useless.  He obviously can't come over here after making threats against my life... and indirectly my fathers. I checked with the Dept of Consumer Affair and he does indeed have a gun carrry permit.... connected to an unrelated and I belive defunct PI Service.

Those are the facts.
Sincerely,

only take one trailer load to remove. I advised the customer over the phone the estimate would be a minimum of $100.00 and that I would need to see the pile before providing a complete estimate. On Sunday, March 9, 2014, I traveled to the customer's residence and viewed the pile of tree limbs. The pile was approximately 70' in length, 30' in width and at points 10' in height. The customer advised the limbs were from a 40 year old Mulberry tree. The customer told me that he had cut the limbs into smaller sections and would be easy to load. From what I could visually see at the top front of the pile I estimated the job to take two trailer loads. I advised the customer the fee would be $250.00 for the removal of two trailer loads. The customer paid me $260.00 as he did not have change to break a $20.00 bill. I began work, using a tree trimming saw to cut branches occasionally. After filling and emptying one trailer load I began to fill the second load. As I continued working at about halfway through the pile towards the rear of the pile I found the majority of the limbs had not been cut as the customer stated. I spent the majority of my time cutting the limbs while my helper loaded the trailer. After filling the second trailer there was approximately 1/4 of the pile left. I advised the customer I had filled two trailers and the limbs towards the rear of the pile were not cut as he stated. I advised the customer if he wanted me to complete the job, it would require an additional $100.00. The customer became irate and ordered me off of his property. After leaving and unloading the trailer, I contacted the customer by phone and advised him I would return the following day to complete the job, if he was willing to help as he had stated during our initial contact. The customer advised he would help. The following day I was unable to keep my appointment with the customer due to mechanical issues with my vehicle. The following day, March 11, 2014, at 7:01 a.m., the customer called my home phone and began cursing me and demanding a full refund, although I had completed 3/4 of the job. I advised the customer in order to keep him satisfied I would return and finish the job myself. The customer threatened me and Hung up. The customer threatened and cursed at my wife who answered the customers phone call at 7:06 a.m. The only truth to the customer's complaint is that he did in fact contact the Yuba County Sheriff's Department to file a report.; however, the Yuba County Sheriff's Department determined there was no criminal violations and deemed the customer's complaint to be a civil issue. I personally spoke to [redacted] of the Yuba County Sheriff's Department who confirmed the aforementioned information. Since March 11, 2014, the claimant has contacted my personal home phone and cellular phone four times and has left harassing and threatening phone messages (of which I have audio recordings of). I have learned the customer has additionally posted a derogatory post on craigslist.com regarding my services. If the customer continues with the harassing and annoying phone calls (653(m) P.C.) I will pursue a criminal complaint against the customer. At this point I will not return to the customer's residence to complete the job as I had graciously offered, even though the remaining work was outside of my estimate and the agreed upon services, due to the customers threats. I will not issued a refund to the customer as the work performed was completed with the second load and the customer lied or misrepresented the work he had preformed with regards to the tree limbs being cut and ready to load. There was no written estimate provided to the customer. I do have photographs of the tree pile if needed for further information. Thank you.

Review: This business is owned by [redacted]. He was paid $260 in advance for yard work on my 79 year old father's property. This price was agreed to and paid before he began work. After completing only a fraction of the job, the person demanded more money... saying his estimate had been too low. He refused to work unless he was paid more, leaving my father in a quandary. When I called him to ask about the delay in completing the work, he threatened me with lethal force, necessitating a call to the local Sheriff.I have not been able to find any licensure for this person in the local business databases, despite the fact he claims to be qualified to do plumbing work in his advertisements on Craigs List.Desired Settlement: Refund in full... also do not believe this individual should be free to prey on other elderly people.
