First off, I am attaching two different documents in support of my decision to neither transfer nor refund the customer. The first is the original Keeper's Membership Information & the Mandatory Questionnaire that was required at the time of purchase. Not only was the complainant
given all of the purchasing details in the area noted as "Stipulations" but he was also required to answer "Yes" to the Questionnaire which clearly reiterates the terms of the saleThe second set of documents is all of the email exchanges I have had with this customer. I have tried to make the stipulations of the membership very clear in this dialogue. As a consolation to the customer's lack of reading comprehension I have also offered to hold the bottles he paid for until the end of this year. I would also like to clarify some errors that the customer made in his "statement of the problem."Customer's Error: Each month they release quite a few beers to those who are members.Fact: Each membership is a purchase of 8 total beers, different varieties released quarterlyWe just released our third quarter offering to members on August 29th, 2015... and the last allotment will be available on November 21st, 2015.Customer's Error: Alot of breweries have memberships and allow trustees to pick up someones bottles who cant make it.Fact: Some do, some don'tThere is no set standard which is precisely why we emphasized and then re-emphasized the terms & conditions of the purchase.Customer's Error: When I signed up I put my name thinking I can list a trustee on my account.Fact: The information, stipulations and questionnaire clearly indicated a "trustee" had to be assigned at the time of purchase.Customer's Error: I tried emailing them numerous times and no luck.Fact: I responded to each and every email and reiterated the membership agreement (all attached).Customer's Error:They kept my money and bottles.Fact: As a courtesy to all of my members, the bottles are at my brewery to be pick up ANY TIME until December 31st, 2015.Customer's Error: I felt like I got robbedFact: Again, the bottles he paid for are here. No one has robbed any oneCustomer's Error: I am across the country.Fact: Geographically speaking California to Oregon is not across countryI am sincerely upset that this customer has gone to this level of filing a complaintbut for all of the above reasons and supporting documents, I do not feel my business is required to issue a refund or transfer.
