De La Rosa Plastering

De La Rosa Plastering is failed to fulfill the construction contract and performing a deceptive business practices.
I signed a contract with *** Plastering to install stucco for my new construction home in on May 23, 2018. The contract had a 2 years warranty that the contractor will repair if stucco cracks, chips, or stucco peeling. They completed the installation on November 11, 2018 and it was paid in full. Junior ***, the president of *** Plastering said at the time they will come back to perform a final walk-thru and repair a couple damaged area resulted for the removal of the scaffolds. July 2019 when our house was completed and ready to move-in, I contacted Mr. Junior *** to come back for the final walk-thru but he never responded or return my call. Around October 2019, I've noticed a crack on the back side of my garage, I notified Junior *** and again he did not respond to my call. On November 13, 2019 I saw Junior *** passed *** my house and I followed him to his construction site at Laguna Bay area and confront him about the issues and his failure to take action to fulfill the contract. Junior *** told me that he will send someone out to my house to check on the cracks in a couple weeks. I waited and no one has come. On January 30, 2020, I made a formal request and threating to file a law suit. Mr. Junior *** contacted me and scheduled a meeting at my house to check on the cracks. At this time, multiple cracks showed up all around the house. February 06, 2020, Junior showed up at my house as scheduled and he did about 15-20 minutes walked around the house. He said he was concerned with the foundation and possibly caused the stucco to crack. He told me to contact my foundation contractor to come check the foundation before they make a repair. I contacted my foundation contractor and schedule an appointment with both Junior *** and my foundation contractor so he can address Junior ***'s concerns. I confirmed with both for the appointment on February 12, 2020 at 10 a.m. On February 12, my foundation contractor (Steve *** came but Junior *** did not showed up. I texted him and he said he had an emergency and can't come. Steve *** spent over an hour to inspect the foundation and found no issue with the foundation. He pointed out that all the cracks on the wall was horizontally and almost at the same level on the wall. There is no cracks or damages on the inside walls. In addition, there is no cracks on the stone wall below the stucco which indicate no sign of foundation issue. I contacted Junior *** the next day to share with him the inspection results and he said he want to meet up with the foundation contractor. I told Junior *** that Steve *** came the day before and I can't ask him to come out again. I provided the Steve *** contact number so he can discuss his concern with Steve. Junior never contacted Steve *** to discuss his concern. I also offered for him to bring his certify inspector to come perform the inspection and that never happened. On February 28, 2020 I hired an independent house inspector to perform the full inspection. As a result, the inspector found workmanship issue with the stucco installation and no issue with the foundation.
I had complied with all Junior's demands and with two inspection on the foundation yielded no problem except for the stucco. As a consumer, I spent a lot of time and money. I am being treated unfairly by De La Rosa Plastering deceptive business practices. I had exhausted my options and I am reaching out to you for your help. I am hoping that you can encourage De La Rosa to fulfill their contract. In addition, I am hoping you take on this case to prevent other falling into the victim of his practices.
