De La Villa Landscaping/Construction Company of Bay Shore, New York is owned by Edgar R*** MrR*** and myself entered into an April *, 2016, contract in which MrR***' company was engaged to install a patio around a swimming pool, install a fence around the backyard's property,landscape the backyard as indicated within the contract, install sod, and replace an existing sprinkler system
On July **, 2016, the contract was amended whereby MrR*** agreed to seal the pool patio, as well as other stone work completed by R***' company in The cost of the materials plus labor came to $ Since MrR*** said he would be back in two days, that is, on July **, 2016, to do the job, I gave him the entire $in cash as full payment R***, however, did not return to do the work and subsequently ignored at least fifteen phone calls to him from me After approximately two months, R*** then called, apologizing and telling me he had been out of the country He agreed to
