This letter will serve as a response to the above referenced complaint in regards to our customer, [redacted]. [redacted], who purchased a 2004 [redacted], [redacted] from Dealer Direct on August 18, 2015. My name is Ian S[redacted], and I am the manager of Dealer Direct. First, let me say that...

we always take any complaints from a customer very seriously. In regards to the specifics of Ms. [redacted]' complaint, we carefully reviewed the description of the• complaint, and I also interviewed the salesperson of the vehicle, Josh S[redacted]. He Informed me on August 26, 2015, that Ms. [redacted] had contacted him by telephone on or around that date and told him that the transmission had completely failed an the vehicle. Josh informed me that he asked the customer to obtain a second opinion on the diagnosis, since it seemed odd that the vehicle experienced such a catastrophic failure after operating normally beforehanci Josh told me that the customer refused to take the vehicle to any other repair shop and would not obtain a second opinion. Our only option in assessing the malfunction on the vehicle was the customer's statement that the transmission needed replaced at a cost of around $2,000. With my instruction, Josh contacted a repair shop in the customer's vicinity named [redacted] Automotive in [redacted], Ohio to receive a quote for the customer on the complete replacement of the transmission. Josh said [redacted] Automotive quoted a price of $1,200 to replace the transmission, which was more in line with the repair cost of a domestic vehicle of that age. Josh then toict me that he asked the customer to consider using [redacted] since it was less expensive, if in fact the transmission needed completely replaced. She again refused. Neither Josh, nor Dealer Direct had any knowledge of an ongoing or impending issue with the transmission on the. [redacted]. We deny that Dealer Direct and/or Josh acted in a clandestine, unfair, or deceptive manner in representing the vehicle to Ms. [redacted] for the following reasons: 1.. By the customer's own admission in her complaint to the Revdex.com, she stated that:the vehicle operated normally when she purchased it, as well as for six days after. 2   Josh informed me that the vehicle operated normally from the time the dealership purchased it for resale, to the time it was sold and delivered to Ms. [redacted], If we had discovered a transmission issue, it would have either been repaired, or the vehicle would have been returned to the auction for a refund. The dealership made no attempts to repair the transmission since it was operating normally.            3. The [redacted] was sold in. an AS-IS condition with no warranties express or implied. Ms. [redacted] agreed to these terms by purchasing the vehicle and signing the Retail Buyers Order, The pertinent excerpt of these terms clearly state, in bold, red ink, "UNLESS DEALER FURNISHES PURCHASER WITH A SEPARATE WRITTEN WARRANTY OR SERVICE CONTRACT MADE BY DEALER ON ITS OWN BEHALF,DEALER HEFIEBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IN CONNECTION WITH THE VEHICLE AND ANY RELATED PRODUCTS AND SERVICES SOLD BY DEALER. DEALER NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY LIABILITY IN CONNECTION WITH THE SALE OF THE. VEHICLE AND THE RELATED. PRODUCTS AND SERVICES" (see attachment), We are sorry that we were not able to reach a resolution with Ms. [redacted]. We feel that we made an effort to assist her and effectively resolve the complaint when it was brought to our attention. We deeply regret that she was not satisfied with our response.
