I am rejecting this response because:Thank you for your reply Please note that although Dean Johnson Homes states that there may have been a misunderstanding regarding the $payment toward the lot, it is important to recognize the following:No documentation had ever been approved, signed, nor shared.When discussing the preferred lot, located at [redacted] in Chaska, I had made it clear that I could purchase the lot, myself I was encouraged by Dean, to allow him to purchase the lot himself, as he has a relationship with, not only the listing Agent, but also the seller I agreed I appreciate that Dean took purchasing the lot into his own hands, however, upon his negotiation of the lot, Dean told me that there was no way that I would be awarded the lot, unless I offered more than asking price of $40, After seeking Dean's advice as to what to bid on the lot, as he has built numerous homes & townhomes within the Cloverfield development, I accepted his expertise & bid the $higher lot price He asked that I write a $check to Dean Johnson Homes to "hold" the lot I agreed.Upon notifying Dean in writing, via the email that was attached to his reply to Revdex.com, Dean chose to move forward & secure the lot regardless, in order to build another home in the development In other words, he used my personal money, to move forward with another build He was not bound to make this choice I believe that he knows that this particular lot, & the success of the model that he has already built, will sell & profit nicely I appreciate Dean's intelligence & abilities.Let's look at this from a legal sense, should a court proceeding be pursued:One, legally there is no binding documentation whatsoever, which would allow for a company to keep the lot hold of $ There is no signed paperwork period Two, there was never ever ever, a single discussion of a $fee for reworking a plan, which Dean has already built & had in place This was quite a shock to read Three, the $lot hold check, will produce income for Dean Johnson, at minimum, times the $amount (see below, the to be built home on [redacted] **) Four, a company in this type of business, encounters situations such as what happened, every day Upon emailing Dean the fact that I chose not to move forward any further (which again, I apologize for, but had the right to make this decision, without penalty), I offered to contribute somehow (a small donation), for his time reworking the already existing plan I offered this out of good faith, despite the fact that no fees were ever mentioned, nor documentation ever signed, as I am an ethical individual As mentioned in the initial complaint, Dean never responded to my emails This is very unprofessional, despite believing that Dean Johnson Homes business is a decent organization Because no mention of fees were pointed out for reworking the plan, which Dean has sold successfully, there is no legal or fair comparison to state that if I would pay Dean Johnson Homes $for plans costs, that the lot hold amount of $would be returned How sad to read this unwarranted comment This is not good business ethic & practice, & it reflects poorly upon the company.Finally, out of good faith, as mentioned, I would be willing to donate $out of the $lot hold, for modifying the Dean Johnson Homes plan, as per the below.I look forward to my lot hold refund of $500, less the donation of $for reworking the plan for the below build, totaling $450, at your earliest convenience And I wish continued success of your operations.Regards, [redacted] $298,700Chaskabeds / baths1,sqft / acreBuilt in 2017MLS# 4808366Active New Const [redacted] **iveSingle FamilyStoryEastCarver Cnty Schools Schools Lakes Area Realty G.V.My rating: Request ShowingFavorite Inquire ShareMy personal notes
