I empathize with [redacted] and I am happy to meet with her to discuss her optionsHowever, I dispute that the situation is my fault Specifically, the bankruptcy trustee filed a Motion to Dismiss her case on 12/8/ My office sent her a letter on 12/10/to explain that there was a deadline to Object to this Motion We sent her an Email on 12/23/and called her and left a message on 12/26/My assistant spoke to her on 12/29/and she indicated that she wanted the case to be dismissedConsequently, we did not Object and the court dismissed the case[redacted] then called my office on 2/and left a message I called her back and advised her to schedule an appointment to discussI met with her on 2/27/and we reviewed the bankruptcy trustee's website to identify the payments she had made I explained that the bankruptcy trustee paid Capitol One over 12,However, there remained a balance on the account The balance was likely due to the fact that the interest rate on the contract was much higher that the interest rate provided for under the chapter plan I explained this fact to her However, I understand these issues can be confusing At [redacted] 's request, I called Capitol One on 3/10/Auto to confirm they had received these paymentsCapitol One would not speak to me so I called [redacted] to advise her that she should call Capitol One Auto to request a payment historyShe then called and left a message for me on 3/14/She called back on 3/16/and spoke to my partner and he sent her a copy of the trustee payment history which detailed all payments made to Capitol One.Again, I am happy to discuss her options However, my office was diligent in our representation of [redacted] She advised my office that she wanted the bankruptcy dismissed That is the reason her car was repo'd and tax refund intercepted[redacted] ***

I empathize with [redacted] and I am happy to meet with her to discuss her options. However, I dispute that the situation is my fault.  Specifically, the bankruptcy trustee filed a Motion to Dismiss her case on 12/8/14.  My office sent her a letter on 12/10/14 to explain that there was a...

deadline to Object to this Motion.  We sent her an Email on 12/23/14 and called her and left a message on 12/26/14. My assistant spoke to her on 12/29/14 and she indicated that she wanted the case to be dismissed. Consequently, we did not Object and the court dismissed the case.[redacted] then called my office on 2/26 and left a message.  I called her back and advised her to schedule an appointment to discuss. I met with her on 2/27/15 and we reviewed the bankruptcy trustee's website to identify the payments she had made.  I explained that the bankruptcy trustee paid Capitol One over 12,000.00. However, there remained a balance on the account.  The balance was likely due to the fact that the interest rate on the contract was much higher that the interest rate provided for under the chapter 13 plan.  I explained this fact to her.  However, I understand these issues can be confusing.   At [redacted]'s request, I called Capitol One on 3/10/15 Auto to confirm they had received these payments. Capitol One would not speak to me so I called [redacted] to advise her that she should call Capitol One Auto to request a payment history. She then called and left a message for me on 3/14/15. She called back on 3/16/15 and spoke to my partner and he sent her a copy of the trustee payment history which detailed all payments made to Capitol One.Again, I am happy to discuss her options.  However, my office was diligent in our representation of [redacted].  She advised my office that she wanted the bankruptcy dismissed.  That is the reason her car was repo'd and tax refund intercepted.[redacted]

I am happy to meet with [redacted] to resolve her concerns.  Clearly there appears to be miscommunication relative to these issues.  I am available tomorrow afternoon, 4/22 between 4:00 and 5:30. She can call me to confirm the appointment, or schedule the appointment by responding to this email. I will not be in the office this Saturday, but I can see her the following Saturday 5/2 between 2:00 and 4:00. [redacted]
