We are frustrated. She knew in June there was a problem.  She delayed coming back to make it right, and her subsequent miscommunication mistates the circumstances.  The deck looks horrible and we want our money back.

As you know, we represent Deck Escapes Staining and Beyond, LLC regarding theabove-referenced matter. Thank you for your extension to respond to the Complaint. Thefollowing is our response.By way of history, on March 5, 2016, my client (Brenda F[redacted]) met Mrs. [redacted] at herhome to measure the deck. On...

March 12, 2016, my client again met Mrs. [redacted] to sign thecontract and decide on deck colors, etc. At that time, my client received the first payment for thedeck project.From April 14, 2016 through June 18, 2016, the work was performed pursuant to thecontract. My client has text messages and Facebook messages demonstrating substantialcommunication between the parties between April 14, 2016 and June 18, 2016.On June 18, 2015, Mrs. [redacted] asked if my client could contact her regarding the deck.Ms. F[redacted] immediately contacted her. Mrs. [redacted] sent a picture of white marks on the deck.Ms. F[redacted] was not able to go to Mrs. [redacted]'s home until July 26, 2016. Again, there issubstantial communication between the parties from June 18, 2016 to July 26, 2016 indicatingwhy Ms. F[redacted] was not able to come to the property due to the parties' respective schedules aswell as the weather.On July 26, 2016, Ms. F[redacted] went to Mrs. [redacted]'s home and did observe a whitecrystallized substance at the knot holes and throughout the boards on the deck. Ms. F[redacted]attempted to clean the spots with mineral spirits (the recommended clean-up product for the stainwhich was applied to the deck). The mineral spirits did not resolve the issue.Ms. F[redacted] indicated she would need to speak with the manufacturer of the stain. Ms.F[redacted] immediately called the manufacturer and had to leave a voice message. Eventually, Ms.F[redacted] contacted a wood restoration company spokesman who indicated it appeared the issueswere caused by sap in the wood. Ms. F[redacted] agreed to re-stain the effected deck boards. Mrs.[redacted] agreed and indicated she wanted to wait until the Fall to have the deck re-stained.Subsequently, my client spent a substantial amount of time contacting various industryrepresentatives to try to determine the cause of the white spots on the deck. My client wasunable to determine a cause. The consistent answer she received was pitch sap in the wood.Ms. F[redacted] had substantial communication with Mrs. [redacted] regarding her efforts to determine acause of the white spots. Ms. F[redacted] indicated to Mrs. [redacted] the cause likely was pitch sap in thewood.Shortly thereafter, Mrs. [redacted] indicated she had a baby shower on October 8th and thestain would have to be applied after that time.On September 23, 2016, Mrs. [redacted] texted and requested the deck be done before Octoberbecause family was coming on October 4th for a baby shower.On September 27, 2016, Ms. F[redacted] went to Mrs. [redacted] home and met Mrs. [redacted] with herhusband on the speaker phone, Ms. F[redacted] indicated the deck would have to be re-stained whenit was not raining and on a night the temperature would not drop below 50 degrees. Mr. [redacted]indicated he wasn't sure he wanted the deck stained this year. Ms. F[redacted] agreed to do it if thecustomer wanted. Ms. F[redacted] also indicated if the customer was not happy with the outcome shewould strip and re-stain the top boards next Spring at no charge. The parties agreed Ms. F[redacted]would clean the deck the next day and to prep for the possible deck staining.On September 28, 2016, as Ms. F[redacted] was driving to the [redacted]'s home, Mrs. [redacted] textedand indicated it was going to rain and they should come the following Monday or Tuesday. Ms.F[redacted] did go to the customer's home and the customer allowed her to clean. After cleaning thedeck, Ms. F[redacted] told Mrs. [redacted] to let her know whether they wanted the deck stained this yearor in the Spring.Ms. F[redacted] heard nothing from Mrs. [redacted] until October 18, 2016 when Mrs. [redacted] textedasking the status of the deck. Ms. F[redacted] indicated she was waiting to hear from them regardingwhether they wanted it stained. On October 19, 2016, Mr. [redacted] called Mrs. F[redacted] to discuss theissues. Ms. F[redacted] asked what would make them happy.Mr. [redacted] indicated a coat of stain on his deck this year would resolve the issue. Ms.F[redacted] again explained the curing issues with the weather. Regardless, Ms. F[redacted] indicated shewould stain the deck this year and, if they were not happy with the results, she again indicatedshe would strip and stain their deck's top boards in the Spring and give them $1,000.00. Mr.[redacted] indicated he wanted a full refund. Ms. F[redacted] indicated she would not provide a fullrefund.Subsequently, Mrs. [redacted] posted a very derogatory review on Deck Escapes' Facebookpage. My client has all communication between the parties, including emails and text messages.If this matter is litigated, we are confident an expert will opine the white stains were caused bypitch sap in the wood. My client did not install the deck. The wood used to construct the decklikely was not properly treated. My client remains willing to refund $1,000.00 in order toresolve this matter.Please let us know if you have any questions or need additional information.
