For your reference, details of the offer I reviewed appear below.First of all, I would like to clear up any confusion over who Mr*** customer is I am the customer who paid Mr*** in full I am the homeowner (not a renter) My wife selected the color of the new deck from Mr*** palette of options offered in his brochure of advertising materials, and, while equally dissatisfied with his work (if not more so), does not wish to be addressed by Mr***Now that we have that cleared up, I would like to rebut some of the statements Mr*** made which are patently as well as submitting photos of his work.With regards to color selection We received a color palette of options offered by Mr*** He stated that any color we picked would not be an issue We selected Cordovan Brown I jokingly quizzed him on the new color before he started spraying He "passed" At no time did he ever state or imply that the old color would show through His statement to the contrary is false Common sense suggests that our expectations were for full coverage of a new color To suggest otherwise is an insult to any sensible, intelligent person.Regarding coverage underneath the deck Yes, we expected the underside of the deck and stairs would not be sprayed We feel, however, that missing the underside of the TOP RAIL in some places but not others, is simply sloppy form and a further example of his imcompetence Please reference our submitted photos.With regards to his contract We verbally accepted his written estimate He states we signed for the conditions listed on the back This is false, we did not.For the reasons listed above, and because we have not received a 50% refund or an apology for his personal insults and lack of professionalism, we reject his response.Thank you for the opportunity to submit photos of his work I'm confident they'll speak for themselves Sincerely,*** ** ***

Mrsand Mr*** accepted our written proposal to have the work done In that proposal, it states clearly that we do not do the underside of the deck The homeowners/renters stated that they wanted to have a different color applied over their previous mistakes I informed them
that we would attempt to make such a drastic change, but that some of the old color may show through The homeowner was upset at the outcome, because some of the old color showed through and we did not do the underside of the deck Below are two excerpts from our proposal:NATURAL MATERIALS ACKNOWLEDGMENT:1. There are unavoidable imperfections that occur in the use of natural materials such as wood. These imperfections include, but are not limited to, variations in color, grain, texture, veins and finish. In addition color, texture, and other qualities of natural materials can change over time.2. Due to imperfections in natural materials, there will likely be non-uniform characteristics found in decks and any other natural materials that may be installed or refinished at your home. Any of these products or materials installed or refinished at your home may vary from samples shown.3. DECKWORKS makes no representation or warranty as to color, grain, texture, finish or other imperfections that may occur in the use of natural materials and by signing the contract the customer accepts these inherent risks associated with the use of products made with natural materials. Changes in characteristics in these materials, which occur naturally over time, are not covered by DECKWORKS warranty.UNDERSIDE OF DECKThe underside of decks are not typically cleaned and stained. This estimate and contract does not include doing the underside of the deck. Some exceptions can be made, and a supplemental fee will be charged to do so

The photos submitted were the ones we received prior to doing the touch up work the first time We will stop back out and take additional photos of the deck, and then submit them We will need some time to do so See below:CORRECTION POLICYIf in the event there are any discrepancies between DECKWORKS and the customer, we reserve the right to rectify the situation within days of notice of the problem. Customer agrees that they will allow DECKWORKS access to their home during this day period to do any necessary work. Customer agrees by signing this contract that they will not use any other outside source to litigate, correct, or facilitate the rectification of the situation. Customer also agrees that any problem that cannot be rectified by DECKWORKS will not be solved by litigation, but that it will be solved by an impartial mediator

The state of Ohio acknowledges verbal contracts as legal and binding Therefore, our day resolution clause stands

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.We are already in the process of finishing the work ourselves.  Any photos submitted by Mark would be of our work, not his.  I've already submitted photos of his work.  His "touch ups" were grossly incomplete. Furthermore our back yard is secured and he is unwelcome.  If he is caught roaming our backyard without our permission, he will be handled as a trespasser.  He has publicly threatened us already by angrily responding to our honest reviews on google.  He was fired, we didn't sign his contract, and we are seeking a partial refund.  His presence on our property will be viewed as a hostile act, and he'll get the trouble he's looking for.  Inform him to set the time by advance appointment by contacting me directly.
