We met with ***, back in July, at his daughter and son-in-law’s home were the deck was being built to give him an estimate. He stated to me that he will be for-seeing the project because the home owners (his daughter and son-in-law) were not living at the home at the time due to an
addition being built on the house*** presented to us, a drawing of how he would like the deck builtJust a drawing, no height of deck, numbers of stairs or railings for the stairs)I gave *** an estimate of $and wrote up a contract and presented it to himWhile I was in front of him, *** and his son-in-law read over the contract and signed it and gave me a deposit of $When I came to the home to give him an estimate I explained to him how we would use the finished nails to fasten the deckingTwo days before starting the project, *** called me and said he did not want to use the finished nails and instead wanted us to use the composite screws to fasten the decking which was not a problemOn the start day of this project, *** was suppose to give us a check for $We did not receive that check from him until the 3rd consecutive day from the start dayAs per his drawing and the contract, the only railings to be installed were the railings around the deckNothing was ever discussed about railings being put on the stairsNYS code does not require railings on the stairs if there are two steps or lessThere are only two steps connected to the deckThe height of the deck was never written in *** drawing or in the contractAfter completion of the decking (not including the deck railings, stairs, etc.), *** presented us a check for $in which he still had no complaints about the build of the deck, screws used, height, etc., leaving him to provide us with the final balance of $on the final completion of the project which we still have yet to receiveAfter the final completion, the West Seneca Building Inspector came out and inspected the deck and passed the completion of the project*** went on to nitpick at every little piece of this project and complained about the screws we used (which are the screws he decided he wanted us to use when he called us two days before the start of this project), the height, and railings for the stairsWhy is he complaining after the project was completed, and passed by the town’s building inspector? And why did he pay us the down payments owed to us throughout the project if he had issues? We built this deck per the customers drawingWe have voice mails from *** stating he wanted the composite screws instead of the finished nails and other voicemails stating his satisfaction of the completed projectOnce final payment is received we can address the final issues that aren’t building code issuesDecks Etcis always there to fulfill their customer’s needs and is willing to resolve this issueBecause we have not received the remaining balance, there is no warranty on this project and the product

1.This project was not based on satisfying the expectation of town inspectors Town of Orchard park, not West Seneca)2. The hight of the deck was determined by the deck it was to be replacing, and any professional deck builder would have known what that hight should have been. The deck was built a     few inches too short, and this contractor had corrected it by adding an unwanted, in our view unsafe make shift step as a compensation for the mistake which was brought to our             attention after the fact.3. We hired this contractor being under the impression, he was a licensed representative of [redacted]. We became suspicious watching them using a gun drives fastener             product instead of special fasteners recommended by [redacted]. We called the [redacted] Company and they informed us that the fasteners being used was not recommended by them, and the       deck built by them will not be warrantied by [redacted], so we stopped them from using the method, they argued but instead of using the hidden fasteners recommended by [redacted], they             agreed to use screws instead of the gun driven nails as they had started with, and now we have screw wholes all over the surface of the deck, which would have been avoided having       used the hidden [redacted] recommend products.4. The railings for the steps, was our choice, not just satisfying the inspector's expectations.5. The steps structure is the most minimalistic choice chosen by any contractor. We could have chosen any contractor building this deck for us for as little as $8,500 - $13,600  but we chose this contractor because we were reassured that he understood we wanted a [redacted] deck and he understood we wanted quality, not just satisfying the minimum local codes. and he was the highest priced contractor. what we actually ended up with was a deck built with corner cutting and carelessness, and minimum requirements. Our contract was to pay a last payment of $3,000.00 when the job was completed, when we saw the mistakes particularly the lower hight of the deck the what should have been, we asked this contractor to correct the problems. He decided to call us fussy and bad mouthing and threatening to come in and demolish the deck forcing us to inform the police department of his intentions. We will have to have this deck corrected and it is going to cost us well beyond $3,000 to do that. At this point, we don't chose to have anything further with this man, but we hope our experience becomes known to others, so they don't fall victims to this kind of behavior.
