Mr [redacted] and I spoke on 5/26/2016, as documented in our computer on our health club software programAt that time he asked to have both additional members on his account dropped from his membershipWe discussed a date to invoice the process fee for the charge on his agreement and that he no longer was employed by Paradise Unified school District, but still qualified for our senior rate as he is years oldI also confirmed the expiration date of his credit card at that time, as described in my notes in our club software systemNever in our conversation did Mr [redacted] verbalize a wish to stop or cancel his membershipI would have been happy to assist him with that if he had askedThe agreement he signed is a month commencing 10/03/The 12th payment of due to complete his agreement was made 8/3/in the amount of $At that time his membership still continued on a month to month basis billing both 9/3/and 10/3/Mr [redacted] did not contact us until 10/17/(days later) claiming he asked us to "turn off the auto-renew" when he dropped [redacted] and [redacted] and wanted the past two months refunded As soon as we were aware of his wish to discontinue the membership we cancelled the account waving the "full" 30-days notification, required by the membership agreement he signed, and making it effective before the next invoice was to bill 11/3/I called Mr [redacted] 10/31/explaining the 12th payment of his agreement was the 9/3/invoice and we had not spoken of cancelling his membership during our conversation, but we would go ahead and do so at this time waving the full 30-day notice and he would have no more debits from his accountMr [redacted] called me back, three days later, on 11/3/claiming he” wasn’t paying for something he was not using” Agreement reads “ I understand that I am obligated to the terms of this agreement regardless of the amount of club usage” He called me a “liar” and became very anger and mad, yelling, and finally hanging up on meI would be happy to provide a copy of his agreement, with his permission, and printout of member notes from our system as evidence of our conversations They are all time and date stamped in our systemI have worked for over years and pride myself in accurate “by-the-book” policy handling of all membership and agreementsMr [redacted] was inappropriately rude and out of line calling me a “liar” he knows he did not ask me to cancel his membershipAs stated before, I would have been happy to assist him in doing so Sincerely, [redacted] Business Office Specialist Beyond Fitness

I want him to understand that I am holding him only to the agreement he has signed and am returning $88.00 to his account. His agreement was dated 9-3-15 to 9-3-16. If he had cancelled early he would have been required to pay a cancel fee of $150.00. Never was I informed of any medical issue or I would have informed Mr. [redacted] how to cancel or freeze his account without any fees by providing a doctors note. You see,m I am here to serve the members I work for, I have no reason to lie to them or con them in any way.  I pride myself in the long-lasting relationships I have formed with the majority of our members. I understand there are times we need to take personal time off or medical time off and I offer a kind word and an understanding shoulder of support and assist them with the process.
