Since 3/16 I have been trying to collect my 4 silver-plated items that they have not sold. I have left phone messages several times asking about them. The owner did call me on 3/22 and said the items were not lost and that they had a room with boxes they could not get to because the AC was being worked on so I waited a few weeks and called this morning (4/11). In the message I said I was making a complaint to the Revdex.com.Desired SettlementI would like to pick up my silverplated items.Business Response The consignor brought multiple silver plate items to us for consignment on January 27, 2015. There were 7 items which she brought to us contained in 2 black trash bags. A contract was signed by the consignor. She received a copy of the contract signed and dated 1/27/15. The 3rd line of the contract states that "after 2 attempts to contact the consignor their items will be donated automatically". When we opened the bags she left with us, the items were severely tarnished and black in color. I called her personally and told her at that time we would not be able to sell them in their current condition. As the owner of the store, I took home a 5 pc. coffee service and polished it personally. It took several hours to remove the tarnish. I called the consignor and told her that her items were too tarnished to work with, that I had taken home her tea service and polished it personally to test the time it took to clean her items for sale. Also that our store employees could not invest the time to polish silver plate prior to selling it. I asked her to come collect what we could not keep the 1st week of February 2015. I also let her know that her tea service (which I had polished) was being placed on the sales floor for $225.00 on February 25th, 2015. The consignors unsellable items were moved to the storage area of our store, tagged with her name and consignor number waiting to be collected by her. We called her and left multiple voice mail messages asking her to come and collect her items. All of which we noted in the "notes" section" of her consignor account. She did not return our calls. He tea service sold for $225.00 in March of 2015 and a check was cut for her in the amount of $112.50 (50%) per contract and mailed to her. The check was cashed in April 2015. Yet, she did not call us to collect the balance of her items at this time. The consignor collected her items that we were unable to list for sale in June of 2015. We did not hear from her again until March 15 of 2016 - 14 months after she brought her items to our store initially. And again on March 21, 2016. We have hard copies of both telephone messages. It was at that time that we first were told by her that there were items missing from what she collected in June of 2015. Thus 10 months had passed since she had come to collect the things we could not sell due to tarnish. Since the time that she brought the items initially, we had moved our store to a new location - we moved into that location on March 4 2016. Our contract (which she signed) is very clear, it is for 120 days - thus the period for her items, had they all been placed on the sales floor, would have ended June 25th of 2015. Because of our move, She did not hear from us immediately, and she called us twice, leaving messages both times about her "lost" items. The consignor claimed that she did not receive ALL of her silver plate items back when she picked them up from our store in June 2015. However she waited 10 months to make that claim. It is our belief that we returned everything belonging to this consignor to her in their original packaging. I did call and leave a voice mail message for her stating that her items were not "lost" - I reminded her of the contract terms, and that it was her responsibility per the contract to contact us with problems within the 120 day contract period. We have looked in the areas where merchandise is held and have not located any items left behind that belong to this consignor. We have a strict inventory tagging policy which was adhered to throughout the time that we had inventory belonging to this consignor. Per contract our store is not responsible for inventory left in our storage area for a 15 month period of time. The consignor should have communicated with our store immediately and responsibly about her items, both after she left them with us initially AND immediately if items were missing from what she came back to collect. We regret that she is upset and displeased with our service and policies. However, they were made clear to her both verbally and in writing. We have over 3,000 active consignors, we are not able to store merchandise for lengthy periods of time. This is an unfortunate situation for both the store and the consigner, however we have contracts to avoid such circumstances, which clearly define the responsibility of both the store and the consignor. Consumer Response I had computer problems and could not respond within a week. I read the owner's response and counted at least 7 lies. I have no proof that she lied. Thank you for trying to resolve this ordeal. I hope no one else has to deal with her lies.Final Business Response I should not be subjected to this type of communication and I find it so unbelievably distasteful and unprofessional. There is absolutely nothing about my response that is not documented, witnessed and accurate. The timeline, carbon copies of telephone messages, contract, etc. speak for themselves. As far as I am concerned, this matter has been dealt with to the best of our ability. Again, it is unfortunate that this customer is so dissatisfied. That is certainly not how we want our customers to feel, however, it is very important that they accept responsibility for the policies of our store, the contract they sign and their own merchandise during this process. We wish her the best.
