When I found out that the car had a bad engine full of slug and could not be driven, I transferred the money to another account just until the materof the engine was worked out. I called the salesman at the dealer and asked him not to put the check through until the matter of the engine...

wassolved because the salesman told us that the car had been checked all over thoroughly and was in perfect shape and they only had to replace the oilpump. In talking withMr. D[redacted] I asked if he had sent his mechanic to look at the engine and see for himself that it was all full ofslug and he said no. The insurance said the body work would be paid for but since the engine was not damaged in the accident and it was full ofslug that they would not pay for it. The car had been at the repair shop quite a few days and the dealer's mechanic called the mechanic at therepair shop and said to get the car to their place. My attorney had the call from Mr. D[redacted] or another person to bring the car back. So I wasabout to have it towed to their place until all of a sudden people the mechanic or someone kept calling not to bring the car back. The car was inthe repair shop from March 15th to present day. They did a little work on the body but had to stop cause the dealer wanted the carback at their car lot right away. Work was stopped and arrangements made to tow the car to the dealer. Then calls were coming in that they didntwant the car not to bring it back. This car was not taken care of and the oil changed regularly because it is so plugged up with slug and been thatway for a while.with slug and been that way for a while because the slug was hard and I think that my grandson got a lemon. The mechanic that put the oil pump insurely saw what the engine was like and didnt tell the manager or told him and fixed it so the car would run for a while and it wasnt their problem ifit blew up. They had sold it and it was the buyer's problem which means us. We should have taken the car to have it checked out before buying it.I believed the salesman and all he said and didn't do it. No warranty, "as is" can be a bad thing but everything looked ok and we didnt look under thehood cause normally you don't think something could be wrong under the hood I like to believe salesmen and he seemed very sincere and we believed himthat the car was checked all over and was in good shape, no problems. Hopefully the Mr. D[redacted], the owner, will see my point and admit theengine is messed up and buy the used engine that the mechanic from the repair shop found and pay for it to be put in the car. We really want tokeep the car but not if it cant be driven and I believe it is their duty to fix it. They lied to us.

I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory to me.
Regards,
[redacted]I did not send this letter...The response from Mr. D[redacted] is not exactly true.  The engine was all plugged with slug and started having problems before my grandson had the accident.  I have two statements from the mechanic whose shop is repairing the car, and one from a mechanic from a dealer that says the engine was all messed up when they were looking at the engine since the car was acting strange and jumping and making funny sounds.  When they were investigating to see what the problem was, thats when they discovered the problem.  i had told the salesman who we bought the car from to hold on to the check since the insurance adjuster was not going to pay for a new engine since it was was not damaged in the accident.  I took the funds from the account and put them into another acct. until the matter was settled.  I was told that since we had purchased the car "as is" it was our responsible to pay for the motor.  Of course I felt that the dealer should be responsible since they had the oil pump replaced and must have seen the problem with the motor.  My grandson was threantened  and was going to be arrested for check fraud.  I asked them to give it time to settle the engine mater.  Due to threats and court and was told they would not pay for the engine I did not have funds to hire lawyers and so I was forced to pay for a motor they found.   I asked my attorney for advice but he was not hired to do anything.  I still feel like we were taken advantage of.  The car cost us $7,780.34 and now Im forced to pay $1,777 for an engine cause it is useless without one, it appears we paid over $9,000 dollars for a car the dealer paid $6900.  My grandson needs a car for work.  He lives with me so I wont be alone since I am a 78 year old widow and he doesnt want me to be alone.  So NO I do not agree with the outcome of this situation, but have no choice according to the dealer since we bought the car "as is" no warranty.  They told us everything was checked out and the car was in goodshape.  So I guess there is no other choice even I know they should have been responsible for the engine because we were lied to.  Ohj  Mr. D[redacted] is being fair as he calls it by letting me make 3 payments of $699to pay for the engine and tires which the car needed.Thank you,[redacted]

In regards to the grandmother's complaint. On 3/11/17 we sold her grandson a 2011 Dodge Avenger for$6990.00 plus tax for a total of $7780.30. The grandson gave us a check for $7780.30 when he pickedvehicle up at this time he asked us to hold the check for one week, while he waited for on insurancesettlement on vehicle he had wrecked. We agreed to this and delivered him the vehicle which was soldto him "AS IS" No Warranty Expressed or Implied. After one week we deposited check (see attachedcopy) approximately a week later the check was returned to us stating the grandson had called his bankand asked to have a stop payment put on check. As you know after we delivered the vehicle the grandson was involved in an accident and on the way tothe body shop he says engine was losing power. The customer says Body Shop told him the motor wasbad and they could install a used engine with 60,000 miles for $3350.00 plus tax. I had our partsdepartment call around and found one with 19,000 miles that I told the grandmother we could installfor $1777.39 with a 12 month 12,000 mile warranty. I told the grandmother and her attorney we woulddo the work for $1777.39 including tax along with towing the vehicle here for free if she paid us the$7780.30 by certified check before we picked vehicle up. At the time the grandmother agreed but nowhas changed her mind.At this time I would still do what I agreed but will not proceed without payment on stopped check withcertified funds prior to picking vehicle up.If this is unacceptable to the customer then I am left no other option but to proceed with legal action onstopped payment check. If you have any questions or suggestions please call me at ###-###-####.Sincerely,John F. D[redacted]P.S. Customer presently has vehicle in his name and is in procession of title.
