Mr***, it is our feeling that you may have not initially intended to use this shih Tzu for breeding, but once you did your research (as you told me you did) on chocolate Shih Tzu's and found out what a chocolate imperial sized shih Tzu normally sold for, that you wanted the dog for breeding If not, why so much emphasis on the registration papers (which I told you I would send you copies of the parents AKC papers and once the dog was neutered would send you HIS AKC papers) and the “well if I do not neuter him, all I need to do is pay the $and then can get the registration papers” statement you made directly to me on the phone If you purchased him as a pet – why would you give up a dog after 2-weeks of ownership Why? Because you wanted him for breeding and now found out you can to get papers on him if kept intact so you no longer have a need for him Who returns a "pet" after having it for over three weeks Who? Someone who did not purchase a pet, but purchased a breeding dog The only offer of resolution is one of two choices: 1) You keep the puppy and we will reimburse for the antibiotics 2) you may return the puppy on our “Return for resale” contract Those are the only two resolutions we will offer and are more than fair considering your specific circumstances, what your actual intentions for the puppy were and the way you handled the whole situation Please let us know if you are returning the puppy with a "return for resale" contract or are going to send us a copy of your vet bill so we may reimburse you Thank you and Good Day, [redacted]

Dear Mr. [redacted],
 ...

Now, please let’s tell the whole story here.

First let’s mention you came to us to get  puppy as your
daughter has  a puppy from us that she purchased about a year ago.

Second, we were NOT aware of the puppy coughing and at no time
did [redacted] hear that puppy cough.  Being that you incubation period for kennel
cough  can be as little as two days, he could have been exposed on Thursday to
the  virus via a customer that may have carried it in (from visiting pups
elsewhere  as kennel cough is as transmittable as a human cold).

Third, at no time did you ever speak to us in a friendly,
respectful  manner, it was always a very arrogant combative attitude – starting
with the  registration papers situation.

You purchased an Imperial sized chocolate AKC Registerable
Shih Tzu puppy on Saturday, 1/18/14.  You READ and willing signed a purchase
agreement  that offered you the papers and you declined the papers.  You READ
and willing signed a purchase agreement that stated that the puppy is required
to be  neutered by six months of age and proof of neuter sent to us, or you will need to
pay an additional five hundred dollars for not following our neuter requirement
for the  puppy.

You called [redacted] (sales person that was at the shop)  on
Sunday, 1/19/14 asking  about the papers.  She stated papers were available, but
you had declined them, and that you should contact me.  At *NO* time during that
conversation was there any mention to [redacted], which she will attest to, that the
puppy was coughing.

You contacted me on Monday, 1/20/14, in regards to the
registration  papers.  You specifically asked if you did not neuter him and paid
the $500  if you could then get his papers (which you declined at time of
purchase).   I asked you if you wanted the dog for breeding as we do NOT sell
our puppies for  breeding purposes.  That is the reason for the neuter
requirement on the puppy.   You vaguely responded that you were not interested
in breeding, but had done  some research online on chocolate shih Tzu's. You
then stated you could  not find “toysized” so I informed you to search for
“imperial” and that you will  find information on imperial sized shih Tzu's (which the puppy you purchased was - an imperial sized Shih Tzu).  I
also at this time stated to you  that I would send you copies fo the parents AKC
papers if you wanted them.  I  also told you to come to our home and meet the
parents in person.  You  did not request copies of the papers, nor did you
request to visit my  home.  During this call – at *NO* time did you tell me the
dog was  coughing.

You called me a few days later to tell me that the vet had
diagnosed the  puppy with kennel cough and provided and antibiotic, and then
stated that the  puppy had coughed since you brought it home.  You stated that
the puppy was  eating well and acting fine, just would cough once and a while.
I asked why  you did not say anything to [redacted] on Sunday or to me on Monday.
You did  not give me an answer to that question.  We discussed what kennel cough
was  and I told you there was a link on our “puppy care” page to read about
kennel  cough (which is just like a human cold – but in a dog) and that it was a
virus  and had to run it’s course.  I then stated that it appeared you were
either  having buyers remorse or wanted the dog for breeding. When you found out
there was no way you were going to get papers for the dog without neutering the
dog – per the  purchase agreement you READ and signed, you decided you wanted to return the
puppy.  You then stated that you did not  have buyers remorse.  I told you I
would then reimburse you for your  antibiotics, provided you sent me the bill (which you have not to this day)
and informed you that my address was on the bottom of the purchase agreement as
well as the health certificate from the vet.

You again contacted me on or about the beginning of February
(after having the  puppy for two weeks) to inform me that the puppy was still
coughing  OCCASIONALLY.  I once again informed you that kennel cough was a virus
and  it needed to run it’s course and that I would reimburse you for the cost of
the  antibiotics if you send me a copy of the bill (which you have not done to this day).  Also that the puppy would
quit coughing in time, just as people do with a cold.  Some people can  cough
for two weeks and some can cough for six weeks.  All depends on the  individual
(puppy or human).  I told you that we *may* consider taking the  puppy back for
a full refund or to have you bring him back on the “return for  resale” contract
we have, but I had to talk to call my mom as that litter of  pups belonged to
her and I had to see how she wanted to handle it.  My mom  contacted you (she
said you were very arrogant, which I already knew after the  phone
conversations I had already had with you)  and told you that due to  the
purchase agreement you READ and signed of your own free will that we would not take the puppy back
for a full refund, but you were welcome to bring the puppy back with a “return
for resale” contract or we would reimburse the antibiotics upon receiving a copy of the bill (which yo have yet to send).   She hung  up on
you – you are absolutely right and you deserved to be hung up on as you were
rude and threatening lawsuits/attorneys, etc.  She told you to go ahead as we had a legal  and
binding contract that you READ and signed of your own free will and then she ended the  conversation
with you.

If you could have carried on a conversation as a dignified
adult, then the  conversation would not have been ended.  If you were a teenager
you would  be classified as a “bully” by the Webster's dictionary term.

Absolutely! at NO time were you told by us to go hire an
attorney – YOU  tried to threaten us with the “ I will hire and attorney and sue
you”.  We  told you to go ahead as we had a legal and binding contract that you
READ, understood and signed by your own free will.

Mr. [redacted], if the puppy was coughing upon purchase why did it
take so many  days before you called to say the puppy was coughing when you you
had two  conversations with us prior to the “coughing” phone call???

Mr. [redacted], it is our feeling that you may have not initially
intended to use this shih Tzu for breeding, but once you did your research (as
you told me  you did) on chocolate Shih Tzu's and found out what a chocolate
imperial  sized  shih Tzu normally sold for, that you wanted the dog for
breeding.  If not, why so much emphasis on the registration papers (which I
told you I would send you copies of the parents AKC papers and once the dog was
neutered would send you HIS AKC papers)  and the “well if I do not neuter  him,
all I need to do is pay the $500 and then can get the registration papers”
statement you made directly to me on the phone.  If you purchased  him as a pet
– why would you give up a dog after 2-3 weeks of ownership.

Why? Because you wanted him for breeding and now found out you
can to get  papers on him if kept intact so you no longer have a need for him.   Who returns a "pet" after having it for over three weeks.  Who? Someone who did not purchase a pet, but purchased a breeding dog.

The only offer of resolution is one of two choices:

1) You keep the puppy and we will reimburse for the
antibiotics
2) you may return the puppy on our “Return for resale”
contract

Those are the only two resolutions we will offer and are more
than fair  considering your specific circumstances, what your actual intentions
for the  puppy were and the way you handled the whole situation.

Please let us know if you are returning the puppy with a "return for resale" contract or are going to send us a copy of your vet bill so we may reimburse you.

Thank you and Good Day,

[redacted]
