Under contract 4/3/15 for a $845 wedding cake for 9/18/15. On 8/13/15 our daughters wedding was postponed/cancelled to be determined. We gave a $200 deposit that day with an additional $200 payment 6/1/15. in corresponding with owner her verbiage was 'we have no refund policy. But I do hold the holds for one year, should things work out we will pick up where we left off. You will need to let me know within the year". At no point did I ask for a refund. On 4/26/16 I emailed her and asked that she make a cake to serve 20 for June 10th. She reply's "we do not apply deposits from cancelled weddings for future cakes". I was so shocked to hear this as I reiterated we paid $400 ($200 deposit and $200 payment) and was ONLY asking for a small cake to serve 20. This was her policy in writing. She continues to tell me not to contact her in any way or she will turn it over to the police and her attorney.Desired SettlementShe breached her own contract and I would want future customers to be aware! She lost a loyal customer over not making a cake to serve 20 that we paid $400 for???? The contract will clearly state what she needs to do if she want to use the deposit she put down on the wedding cake. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)She neglects to add her email stating we could reschedule within a year. Again, with a $200 deposit and an additional payment of $200 we were only asking for a cake to serve 20. I never asked for any monies to be refunded. I never told her this was for a wedding or baptismal. She never asked. She was very hostile and unwilling to help a customer stay loyal. So be it I have nothing but bad reviews for this bakery and their practices. She agreed to a service within a year, never stating I would need to pay an additional $475 for a $50 plain white cake. I vote with my feet thank you very much!!! Final Business Response The client received a copy of the contract on 04/03/15. On paragraph 1. it states:1/2 Deposit of total cake cost is due upon signing of contract. Final payment is due 30 days before event. Only cash will be accepted after that. IF YOU CANCEL YOUR WEDDING CAKE, WE MUST HAVE IT IN WRITING AND IT HAS TO BE CANCELLED 90 DAY PRIOR TO THE EVENT OR CUSTOMER WILL BE RESPONSIBLE FOR THE FINAL PAYMENT REGARDLESS IF YOUR WEDDING IS CANCELLED. AFTER SIGNING OF THIS CONTRACT ALL MONIES PAID INCLUDING EQUIPMENT DEPOSITS ARE FORFEITED IF SPECIFIC PAYMENTS ARE NOT MET, IF YOU CANCEL THE EVENT OR ORDER AND/OR IF THE BANK DOES NOT HONOR ANY CHECKS. RETURN CHECKS CAN BE REPLACED BY A CASHIER'S CHECK OR MONEY ORDER OR CASH PLUS A $30.00 RETURN CHECK FEE. IN THE EVENT THAT YOUR DATE IS CHANGED AND YOU HAVE PAID IN FULL, DEE'S BAKERY WILL HONOR THIS ORIGINAL CONTRACT FOR UP TO ONE (1) YEAR PROCEEDING THAT BOTH PARTIES AGREE UPON A SATISFACTORY DATE AND COST INCREASE. I kindly allowed you to pay only $200.00 of the $400.00 due at the signing of the contract due to your finical funds allowed. I carried that for two months until you were able to make the other half of the deposit of $200.00 on 06/08/15. You cancelled the wedding on August 13, 2015 37 days before the event date. In the contract it clearly states that you have to cancel 90 days prior to the event. On August 14th you replied to my email after I told you that there were no refunds and you said "I appreciate it" Thanks Dee. On April 26, 2016 you sent me an email stating that you needed a cake for 20 people and a small child's cake, this is after you knowledge that we don't do refunds or store credits. We honor the cake deposit toward the wedding cake only and only if the cake is paid in full. Which did not happen. On April 26, 2016 you sent me a harassing and threatening email. I responded to that by asking you not to call or email us again. You also stated that you didn't have my email address or phone number. You obviously have it has you emailed me to request a cake, and I give all my clients my cell number as well. I feel that you didn't read your contract. You did sign it and received a copy of it.
