Complaint: [redacted]I am rejecting this response because: Definitive Construction, LLC fails to accept responsibility for the damage to the property that was a direct result of having to remove inadequately installed concrete patios caused by Definitive Construction, LLC. As the General Contractor our ultimate responsibility is to the homeowner and to insulate them from shoddy work like that of Definitive Construction, LLC. It must be mentioned that the owner of Definitive Construction, LLC is in his early 20's and has little experience in dealing with conflicts such as this. We have been involved in construction for over 20 years and have never had a sub contractor avoid his responsibility to resolve a matter to the satisfaction of his customer like we have had to deal with Definitive Construction, LLC. We can easily obtain testimony from both the homeowner and the subcontractor we hired to remedy the situation about the facts on the ground.You will notice the significant absence of testimony from the respondent (Definitive Construction, LLC) regarding the hiring of unlicensed contractors to complete the work, this is both a violation of our contract and Oregon law. We have filed a formal complaint with the Oregon Construction Contractors Board regarding this issue.To summarize: We hired Definitive Construction, LLC to pour concrete patios on a home we were building for a customer. Definitive installed the forms for the patios and then hired an unlicensed contractor to finish the concrete surface because they personally did not have the experience to do it themselves (even though they represented themselves as a concrete contractor). The forms for the concrete that Definitive installed did not provide positive slope away from the structure causing rain water and snow melt to run toward the structure. We hired another contractor to remove and replace the patios and even allowed the owner of Definitive Construction to work with the other subcontractor so he could save some money. Damage to home included, window cleaning, paint repairs and landscaping repairs that were a direct result of having to remove the patios that Definitive Construction was contracted to install. Our contract with Definitive Construction, LLC completely indemnifies [redacted], LLC from all damages, losses and expenses. It is our hope that Definitive Construction, LLC will recognize the error of their ways and reimburse us for the expenses we incurred as a result of their work before this matter ends up in small claims court.Sincerely,[redacted]

Definitive Construction, LLC was hired by [redacted] on January 20th, 2015 to grade, install gravel, and pour a concrete patio on the front and rear of a home they were building for a customer in Bend, OR.  The work began on January 22nd and completed on January 24th.  The patio on...

the back of the home did not have the proper slope when installed and therefore needed to be removed and re-installed.  The unprofessional and mean attitude that was displayed by the owner of [redacted] lead Definitive Construction, LLC to seek hiring out the task instead of doing it themselves.  I have personally received harassing phone calls, emails, and text messages by the owner that lead me to ask for email contact only.  The last text message I received from the owner was, [redacted] with me some more and let's see how that works out for you."  This was a response to my text message asking how the clean-up was my responsibility.  [redacted] met with another concrete contractor and got an estimate to remove the slabs and repour them.  I liked the price and accepted the estimate.  Attached is the estimate from the concrete contractor as well as an agreement from [redacted].  Note that it does not state anywhere in that document that I was responsible for anything regarding cleaning up after this crew completed their work.  I completed the required tasks of cleaning steel columns, installing drain, and installing tree for the homeowner on 4/6.  I also confirmed with [redacted] that I was to have no liability for the work completed by the other contractor and this liability was part of the reason I was hiring this out instead of doing the work ourselves.  The damage [redacted] is seeking compensation for are for items created by this hired repour contractor.  The sod received minor damage, the mulch around the concrete pad needed to be raked and re-mulched, the house needed a quick pressure wash from the concrete dust created by the saw to cut the slabs, and the windows needed to be cleaned again after they were already professionally cleaned when the house closed.  The original agreement was that Definitive Construction was responsible for repainting some siding near the original pour because supposedly there was damage that had to be scraped.  I never received proof that this was our fault and the owner of [redacted] claims that there was too much other painting around the home both interior and exterior and to not worry about it.  Also I explained to the homeowner that I did not repour the concrete and I did not understand how I was responsible for repairing/cleaning up someone else's mess.  I received an email shortly after relieving me of my duty to repair the sod from [redacted].  At this point I am still expected to repair the mulch, pressure wash the home, and clean the windows according to [redacted]'s after the fact requests.  The contract even states that we would remit payment to the repour contractor upon final clean-up.  Definitive Construction, LLC is not sure how they are responsible to clean-up after someone else completed the work.  It was not discussed prior to the repour, only demands from [redacted] after the work was complete.  Also, there was a breach of contract on [redacted]s part as they will not allow us to stain the patio as per our original contract.  See stated attachment.  We are not seeking damages from this breach.  We only want the issue to be resolved and to remain in good stainding with the Revdex.com as we are currently.

Definitive Construction has finalized all matters regarding this complaint on May 27th 2015.  Definitive Construction was not issued a fine or any discipline regarding [redacted]'s accusations.  We have been in contact with the CCB to resolve the issue.  We have provided them with all necessary information to get this case closed immediately.  With this being said, the complainant should have no further issue with Definitive Construction considering we have met all of their needs and desires.
