Initial Business Response /* (1000, 9, 2016/10/03) */
In response to the "lawn mowing company continues to trespass on my property", Mr. [redacted] has a fence around his backyard and a no trespassing sign attached to it, we in no shape or form EVER trespassed on Mr. [redacted]'s property, we NEVER entered...

his fence. In response to "they continue to damage my fence", Mr. [redacted] has SEVERAL red concrete straight edging stone along his bottom fence line where there are holes and gaps. One can only assume this is to keep his little dog in. The area in question ALSO has red concrete straight edging stone, I have pictures of the area in question. The individual that was on the mower at said incident was more than 1 foot away from the fence (we weed-eat a 1 foot perimeter on ALL properties). Mr. [redacted] did called the police, we still have not seen a report. The employee DID call Mr. [redacted] a liar, never threatened him, yes while the police where there. Mr. [redacted] called me and left a voicemail saying my employees where driving around the neighborhood, cussing at him, flipping him off and threatening him. At the time of his phone call and voice mail, I was on the phone with my employees, they where at the gas station on Evans Rd and 65. He has called and left threatening voice mails about going to the court house and that we have a time limit to respond to him. We will not be firing anyone, and will not replace a damaged fence that was clearly damaged before we even started mowing. We do have pictures to prove the damage was there previously. We also do not work for [redacted]. Several individuals told and "warned" us about Mr. [redacted], thus being a huge reason we NEVER even blew grass on Mr. [redacted]'s property.
Initial Consumer Rebuttal /* (3000, 16, 2016/11/04) */
The edging is on the inside of the fence - not the outside and it was decorative purposes as our smallest dog weighs 47#'s & could not get through a hole or gap. There are NO other gaps or holes in the fence other than the damage that they caused. That is not why the decorative edging was ever installed. They did damage the fence as the wire as that part of the wiring is torn away from the fence. The fence is NOT on our property line. Our line extends an addtional TWO feet from the fence on the south and west side therefore they were and have entered our property. This company was mowing [redacted] management rentals but was hired by [redacted]'s maintenance staff. They do not have pictures of the previous damage as there was no damage on the fence (they would need to prove with dates as we do have pictures w/the mower being to close to the fence). If they would like a copy of the police report this can be supplied. The police was called due to the unprofessional employee and due to the damage. This company has been repeatedly asked to stay off the property and have been explained where the property line is. This company also had someone run out and take pictures after the police were called & we filed a complaint that day. We were informed that the owner would be calling us to discuss the issue and this has never occurred leading us to file this report. The police department has also informed us that if we don't receive any relief that we need to contact them back and they will file the appropriate information. We were trying to go about this without involving the court system but if that is this unprofessional companies desire to come to an equitable resolution we will pursue it the legal route.
Final Consumer Response /* (4200, 20, 2016/11/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
They need to repair the fence where they caused the damage that is noted on the police report. We have informed [redacted] multiple times to inform whoever they have mow to stay off our property. It is not our problem if that communication does not happen as we cannot be home every time one of these companies mow. It was also not a weed eater that was utilized. It was their big mower. I am Mrs. [redacted] and I have witnessed this by the mowing companies that are hired. They have pictures that were taken after they damaged the fencing. We are assuming that this company has absolutely no desire to rectify their mistake and that we will have to take other measures to resolve the issue. We were informed the owner/manager of the company would contact us to discuss but refused to do so and to return our calls. I sent emails through their website requesting return response but they have ignored them also. It is unfortunate that they damage property but fail to admit the wrong doing. it really may not take much to do the repair and it will also be down to a case of one person upset that tells 10 people - they tell 20 and on down the line over a fairly simple fix. We have never had trouble with the normal mowing crew as they are a reputable company - we have used them to mow our lawn and our rental next door at times but this company has questionable business practices. We can also only assume, because they were temporary, they really do not care about how they took care of the surrounding properties as they will most likely never be back.
Final Business Response /* (4000, 18, 2016/11/09) */
There was never any question about the location of the edging, pictures show it is located INSIDE the fence area. The mow crew does NOT mow next to fencing, we keep all mowers at least a foot away from fence lines, as we use weed eaters to ensure no scraggly pieces of grass are left behind. If Mr. [redacted]s fence is located 2 feet inside his property line why is this not clearly marked? He has a No Trespassing sign on the fence BUT NO markings of any kind else where informing where said property line is. Most individuals rather business or not assume a closed off area (ie: fence) is someones said property, if a 2 foot area outside said fence is not CLEARLY marked and an individual or business come in to do property work on the neighboring property, HOW IS ONE TO KNOW? He did NOT inform the mow crew until AFTER he started yelling at them for being on his property and stated that his property extended 2 feet out from said fence line. We do have pictures of the fence, no we did not go out at a later date to get them, the pictures include Mr. [redacted] and the law officers that were there during the time of the complaint. Mr. [redacted] is accusing someone of something that they DID NOT DO. The normal mow crew that takes care of the neighboring property was unavailable and asked the business to mow for a few weeks. We where told to make sure to not even blow grass on Mr. [redacted]s property, we MADE SURE to stay away from his property. We were never asked "repeatedly" as stated by Mr. [redacted] to stay off of his property, until that afternoon he stated yelling about the mower being on his 1 foot of the 2 foot area outside the fence.
