We were contacted to do a part bathroom renovation. The Homeowner was renovating the bathroom and sub-contracted part of the work out to us. We removed a tub, installed a new tub, removed a window and...

surrounding ceramic tile in the tub area and installed new ceramic tile. We also supplied & installed a bath fan and ducted it to the outside.
We hired a local plumbing company [redacted] to install tub and related plumbing work. The new tub was installed as per the manufacturer's installation instructions. When the tub was removed, all that was visible was the subfloor; there was nothing visible to indicate there was anything to be concerned about. The ceiling below is dry walled and is not visible for inspection.
Our last day worked on site was June 9th 2014; I received an email from customer on March 11th 2015 to complain about the tub making noises. After receiving the initial email from the customer, I contacted the plumber and was told, by the plumber, there were 6 legs under the tub and if there was any space under any of the legs it should be shimmed. I visited the site, climbed into the tub and with great effort was able to get the tub to squeak. A carpenter was sent at a later date to see if any shims were required, he was able to get only one shim under one of the legs. I did not hear anything for a couple of weeks and then received an email saying there were still noises. I then contacted the plumber again and asked him to meet me at the job site to have a look himself. We met at customer's house at 7am to accommodate customer's work schedule. I again climbed into the tub and worked to get tub to make noises, while doing this, plumber looked under tub and observed movement in the floor framing. It was suggested the floor joists could be beefed up to eliminate the movement.
At the time the estimate was done, there is a tub in place, a floor in place and a ceiling below in place. Nothing is open for inspection. It is unreasonable to expect a contractor to anticipate this problem in advance. There were no obvious signs that would lead me to think I should allow for floor repairs.
All work stated in our contract has been completed, it is unfortunate, but any additional work needed will be extra to our contract and subject to additional charges.

The statement "with great effort was able to get the tub to squeak" is false. The noises happen any time that a person moves from one location to anotehr while showering, no "great effort" is required. Also, the "guarantee" on [redacted]'s site states "At [redacted] Construction we warranty all the materials and workmanship against defect for 12 months from substantial completion of the job. Our motto is guaranteed quality workmanship since 1949". I would suggest that the workmanship is insufficient when the tub makes unbearable noises that affect our quaility of life. As [redacted] was conatacted 9 months later, this would have fallen well within the guarantee's deadlines but eh isue has not been resolved.

As stated previously a carpenter was sent to site to see if any shims could be installed. He was only able to get 1 additional shim under 1 support leg. I am not sure how this new plumber was able to accomplish this when all legs were firmly on the floor or firmly shimmed. I have never heard any unbearable noises coming from this tub.

This is not a resolution, just excuses. It is obvious that the contractor refuses to take any responsibility.
