Good morning, we also received a complaint from the Department of Justice and responded on December 14, 2017. Attached is the letter we sent regarding our findings a long with evidence
supporting our response.We received your letter dated October 30, regarding a complaint filed byMr*** ***.We investigated the matter and contrary to Mr***'s allegations, Del Taco didnot incorrectly charge him for the item he ordered during his visit on October 23, 2017.Mr*** ordered a value bean and cheese burrito, which is an off-menu board item atDel TacoMr*** alleged that he should be charged $for the value bean andcheese burrito because he incorrectly concluded that the price for the value bean andcheese burrito should be the same price as the ***ed up value bean, rice and cheeseburrito, which is on the menu board but is a different item than the burrito he actuallyorderedEnclosed is a picture of our menu board showing the items under one dollar,including the ***ed up value bean, rice and cheese burrito priced at $0.89.Our Shift Leader *** *** stepped in to explain the difference in price toMr***Ms*** took further steps to explain the situation by pulling the menuboard panel from the menu board to show Mr*** that the only burrito available for$cents was the ***ed up value bean, rice and cheese burritoWhen Mr***accused our managers in charge of advertisement, Mrs*** rang up the offmenu value bean and cheese burrito on the register and showed Mr*** that theburrito he ordered is priced at $and not $Enclosed is a picture showing theprice of the off menu value bean and cheese on the cash register.Further, our employees are regularly trained to redeem remaining gift cardbalances of less than $upon customer requestWe also regularly remind ouremployees of the gift card redemption lawAttached is a copy of a notice that was sentto our restaurants on November 30, According to our Shift Manager, at no pointdid Mr*** request the balance of $from his gift cardEnclosed is a statementfrom our Shift Leader, *** *** explaining the situation with Mr***.Finally, Mr*** did not place a second order using the same gift card for thesole purpose of cashing out his gift card as the gift card he initially used does not appearon any of the other gift card receipts processed at the restaurant on October 23, 2017.Enclosed are receipts of all gift card transactions processed on October 23, Pleasenote that the receipts show the last four digits of the gift card used in the transactionThestore receipts for that day do not show multiple transactions for any of the gift cards usedin the restaurant on that day.Due to our findings we believe Mr***'s allegations are without merit and hiscomplaint should be dismissed.Sincerely,DEL TACO LLC*** ***General Counsel

We would like to resolve this claim by giving Mr. [redacted] a $20.00 master card gift card. Please let me know if he will accept the gift card.  I will also need his address to mail him the gift card.

Review: I am writing to you regarding my experience at your Del Taco, located at 5644N. Telegraph Rd. Dearborn Heights, MI 48127. On 01/24/2016, around 245am, I approached the drive thru screen and was greeted by the employee. I proceeded with my order, “Can I have a number 9 with a diet coke, and I would also like another number 9, just the burrito, not the meal”. The Del Taco employee started hysterically chuckling at me. I asked her what was funny, and she replied “so do you want the number 9 or not”. I said, “Yes if you weren’t laughing so hard, you may have understood me in full, I need a number 9 and also an extra burrito that comes with the number nine”. She continued to chuckle. At that point I was both confused and offended that I was being laughed at for simply placing an order. I asked the worker once more what was so funny about my order, and the speaker went dead.

I then pulled up to the window, and a woman came to the window. I immediately asked to speak to a manager and at that point, the woman at the window stated she was the manager. I then asked her why the woman who was taking my order was laughing at me and I then continued to ask her what was funny about my order, as I restated it to her. The “manager” replied, “because she’s in the good mood”. Because she’s in a good mood that means its fine to laugh and make fun of paying customers? I then became very angry and told the “manager” that I also was not done placing my order however; since her employee was laughing so hard, I hadn’t got a chance to even finish my order. She then slammed the window closed and stated her was calling the police and knowing I did nothing wrong, I told her to call the police. I sat with my car in park as she went and grabbed the phone and called the police , all because her employee was laughing at us. Had I not had children waiting for food at home, I would have waited for the police but after about 5 minutes of waiting for the “manager” to return to the window, I left.Desired Settlement: I would like Del Taco to award what they feel is appropriate in compliance with their store policy's and regulations.
