Delicato Transport LLC, Moving and Storage Reviews (2)

Review: I hired Delicato to move my furniture into my new 2-bedroom apartment. Many of my items were badly damage, some of which was concealed by the movers, and some items are missing. Several of the services outlined in the Service Contract and that was communicated to me during the in-person estimate were not followed. I have photographs of the damage and evidence that the movers did not handle certain items properly, thereby resulting in the damage. I am seeking compensation for the substantial damage to my property, destruction of property, and loss of property that resulted from Delicato's gross negligence in executing the move. This includes compensation for the following (1) missing items: Missing Mirror; Bookcase with Doors later found smashed in a dumpster; (2) non-repairable items: Black Bookcase Shelving Unit not protected appropriately and had damage concealed with mover's tape; Queen and Full-size Mattresses with dirt stains and holes due to not being covered with plastic; Filing cabinet had finish removed because it was taped and not protected appropriately; Dresser drawer corner was cracked; Sofa with 2 Tears; and Stainless Steel trash can was dented.Desired Settlement: I have been in contact with J[redacted] at Delicato and have requested repairs and replacement of the unsalvageable/non-repairable items as a result of the mover's gross neglience. As a result of negligence, I estimate the replacement value for only those items that are missing or that were badly damaged and cannot be repaired to be $2,800.

Response:

I have made multiple offers to have Ms. [redacted] furniture professionally repaired, I have given her the option of choosing the repair vendor of her choice and deduct the cost from the money she owes us for the move, I have made multiple offers of financial compensation for any items that can not be repaired (which are very few). Ms. [redacted] has rejected all my attempts at resolution and instead has decided to lodge this complaint to damage my reputation. I have done all that even though she has refused to pay me for the move when I do not have to because in ** the laws states that no claim can be addressed or satisfied until the moving charges have been paid in full. Ms. [redacted] also did not purchase any additional insurance for her move, thus again under the law in ** a movers liability is limited to 0.60 cents per pound per article. All of the multiple offers of compensation I have offered Ms. [redacted] and have been rejected exceeded that level of liability so I have reach beyond my responsibility in my attempts to satisfy her. It appears that the only satisfactory resolution for Ms. [redacted] is full replacement of all new furniture which is neither an option under the law and regulations that govern public movers in ** nor the terms of the contract she sign agreeing to a valuation of 0.60 sixty cents per pound.I again reiterate, we at Delicato Transport, LLC Moving & Storage are still requesting to be paid for the move so that we can process Ms. [redacted] claim under the terms of her contact and the laws of the Sate of New Jersey.

Review: I used this company to move and for storage of my items until my house was ready. I was assured by their sales representative that my items would be stored separately away from others items, this was not done. I was assured that the owner of the business was the only person with access to my items, this was not true. The company damaged items and lost items. The company did an unauthorized repair of my furniture without advising me that my furniture was broken and without allowing me to see the damage prior to repairing it.Desired Settlement: I would like reimbursement for lost items, some of which are original art work and I would like my lost items replaced.

Response:

This complaint contains false information, first, we are a moving and storage company and operate a general movers warehouse where multiple shipments are stored at any given time although shipments are obviously segregated from each other in the warehouse. I made no claim that [redacted]''s goods would be stored in a separate unit or self storage type facility. All my promotional material I provided to [redacted] made no such claim, my website makes no such claim. Although her goods where segregated during the time stored at my facility. Second, I and my manager are the only persons with a key to my warehouse but of course my employees have access to preform their regular duties as movers, I really don't understand this part of the complaint or what she is insinuating, if she is insinuating somehow that I represented that NO ONE but me would touch her goods that is again not true and a false statement, frankly it would be ridiculous to assume that. Third, I did go ahead and made a repair on a table leg that broke during transit but again I notified her that I held the piece back for repair at the time of delivery and delivered the professionally repaired piece about a week later. Fourth, There is a matter of a lost plastic kitchen trash can which she claims I lost and I have agreed to reimburse her 18.00 for that which is her value on it, even though there is no proof that we lost anything. It is common that people cant find things after a large move but they almost always turn up after people get settled and I believe that is the case in this case. Fifth, She did claim some other furniture damage but has not been specific and has not allowed me to come and inspect any damage or make any repairs which I have now offered to do more than twice. Sixth, This customer did all her own packing and used her own boxes. When that is the case a mover has no knowledge of the contents of those boxes and assumes the standard level of liability of sixty 0.60 cents per pound per article. If [redacted] can provide a better description size, weight, etc. I would be happy to make a reimbursement that is within my level of liability per the laws of the state of NJ and the contract she signed for the moving service. To this date [redacted] has provided no such information, has not allowed me to inspect her claims of damage and has not allowed me to do any other repairs since the repair I did initially. [redacted]'s claims of lost artwork are unfounded and unverifiable. I have made numerous attempts to resolve any issues [redacted] has but she has not allowed me to do so. At this point it is difficult to resolve her problems and just reimbursing her the 500.00 she is seeking without any verification of lose or damage is not only far beyond any level of liability I have even if she could verify anything for me which she has refused to do.
