On December 30, 2014 I purchased a 2003 [redacted] from Delisle Auto Sales in Yorkton. The dealer had the vehicle posted for $4,995.00 on [redacted] After speaking on the phone several times about the work that had been done to the vehicle, I went to Yorkton to view it. The dealer gave me a copy of the "Visual Vehicle Inspection Report" which was filled out by the mechanic, and not dated. After buying the vehicle, the truth came to light:The dealer claimed he put $4500 into fixing the vehicle. He did not want to negotiate price, as he said he had already came down simply because the vehicle has been on his lot longer than 120 days. When reviewing the invoice of the repair which I received after buying the vehicle, I noticed the date was scratched out, but legible. It stated the work had been done November 27, 2013. The work also had been done at [redacted], which is not in Yorkton, but in Saskatoon, where the dealer stated he purchased the vehicle from an auction. The total of the invoice totaled to $497.59. Therefore, he lied about having the vehicle serviced recently, where it was serviced and he also lied about how much he paid to have it serviced.After purchasing the vehicle, I noticed the horn did not work (Which was recently fixed according to the mechanics invoice). After having it parked for a night, my tires went flat (the salesman claimed they were in excellent condition, with 70% tred- that is false). I went for an oil change and the mechanic who serviced my vehicle said it had not been done recently, and my fluids were all very low and very filthy and need to be changed. I needed to purchase new windshield wipers as well.A few days following the purchase of my vehicle, it would not start. The dealer had claimed that the battery he gave was brand new but may have lower voltage than required. Therefore, I bought a new battery. The following day, my vehicle would not start. After taking it to a mechanic, they told me my block heater did not work at all and it would need to be replaced. That came to nearly $250. For a couple of days it worked, until I was in class one day and it would not start when I got out. I took it back to the shop and had to replace the starter because it completely failed. That costs nearly $500.00.I got In contact with the salesman prior to realizing that my starter failed as well. He had stated that he would send me a check for $300 if I would return his battery via [redacted]. I have not received a check.[redacted] I called last week and left a message stating I needed to replace the starter, and wondered where my check is. They did not return my calls, and have been ignoring me since.The total value that I paid for the vehicle was $4725.00, and now had a complete oil change, new wipers, new battery, new starter, and new block heater installed and have spent well over $1000 to keep it running. [redacted]. I still have his battery that he asked me to return and will not return it until I get my check.[redacted]Desired SettlementA check for $300 Business Response [redacted] It is my understanding that initially the vehicle was incorrectely advertised on [redacted] for $4995.00 and should have been $5900.00 as listed in [redacted]. However, [redacted] was told of this oversight and it was decided the $4995.00 would be honoured. The [redacted] was initially purchased through [redacted] This vehicle passed [redacted]'s inspection then it had a second inspection at [redacted]to do a full inspection on it . A full Car Proof was also provided to client. In response to customer Paragraph 2: Delisle Auto Sales does not agree with stating that $4500.00 was put into this vehicle for repair. What was intended to be communicated was $4500.00 total cost was into this vehicle /including repairs.(Actual cost 4797.00 ) I would assume that customer would want to know what kind of repair would require $4500.00 as this would be an excessive amount of repair. The following was provided to customer to view: [redacted]'s inspection sheet read as follows; and provided to customer to view/ repaired in the amount $497.59.-Diagnose horn not working, tested fuses burnt, horn missing from vehicle -had used horn at shop to test found when plugged in horn stayed on, tested relay found relay burnt, replaced relay horn worked properly, installed new horn tested ok. Steering column intermediate shaft clunking, remove and replace intermediate shaft -horn, relay, intermediate shaft. Oil and fluids/tires were not an item of concern with mechanic and would have been listed if it did not pass inspection. Necessary repairs were completed and this unit was transported to Yorkton. [redacted] When they drove off our lot, the tires were inflated and the tread good. The only explanation I have for the tires is the cold weather we have been experiencing and as far as the horn, it had been fixed to my knowledge and if fluids were low/wipers needed replacing, inspection should have called it. If you refer to Paragraph 4 : Consumer advised car would not start following purchase: The battery that was purchased from [redacted] was called in specific to 2003 [redacted] and would have to be exact for this vehicle/Delisle Auto Sales would not have purchased or replaced a battery with insufficient voltage knowingly. As this is a brand new battery I can only offer the cold weather once again as an explanation of not starting. We cannot offer explanation of reason block heater is not working, as far as the starter needing replacement this can burn out if a vehicle is continually attempted to start unsuccessfully and worked at time of purchase. Upon conclusion of sale, customer inquired about warranty and 30 days on engine and transmission failure only was provided and initialed by [redacted]. Delisle Auto Sales also decreased the sale amount to $4500.00 plus gst $225.00 for a total of $4725.00 as she wanted the vehicle for less money to allow for minor repairs if needed. Our office was later contacted by customer and I told her that I would do $200 but after her Mother-in-law called I agreed to do $300 if the battery was returned and she thanked me for help in this matter, and more of a refund was requested due to the battery being changed. It was agreed that once our office received the initial battery back, a cheque would be refunded to them in the amount of $300.00. Finally, we have the refund in the amount $300 and once we receive the battery back it will be mailed direct to customer. [redacted] Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)My primary reason for denying this response is [redacted] still have not received my money. The salesmans assistant spoke to me on the phone several times and he stated that the check for $300 had been mailed to me. [redacted]. If they intended on receiving there battery before sending my check it should have been stated, and my calls should NOT have been ignored for two weeks following. I do not believe I will receive my check if I send the battery, and wanted to set up arrangements for the fees of sending the battery via [redacted] which was discussed. However, the owner and assistant CONTINUE to ignore my calls, therefore, this matter is not resolved and I will not send the battery without receiving some sort of notification that I will receive my check. I also refuse to pay the fee's to have the battery shipped to Yorkton, which me and the salesman had previously discussed before ignoring me. This entire matter could have been avoided if they would have complied with what they had stated and sent my check. Once I receive my check I will return their battery.
