Premium Title Group was notified via email on July 12, 2016 from Ms. [redacted] regarding her subordinate 2nd Note/Mortgage with The Department of HUD/ChaseShe stated her Subordinate Note was not paid and she is now being notified by HUD to pay it in full We immediately researched said loan...
issue and provided to Ms. [redacted] our findings as follows: At time of closing, we contacted Chase Mortgage to obtain a payoff for her 1st and 2nd Note. (Both mortgages were held in the name of Chase Mortgage and Department of HUD with the same exact loan number)We have a signed payoff informational document provided by Ms. [redacted] stating she only owed one Mortgage with Chase –she failed to mention her 2nd mortgage or provided an account number to obtain said payoff (see attachment) –At time of closing, she never mentioned owing the 2nd loan or informing us the payoff was short $4,000. This would have stopped the closing and further research would have been done. �...⇄ felt confident with the information provided from Ms. [redacted] and Chase that both loans were paid in full. Chase sent us a payoff and stated that both mortgages would be paid in full (we were audited a few months after closing on this file and verified with Chase again that this was paid in full) We have a verbal confirmation from the payoff department by Andy [redacted] in customer serviceAfter we concluded our research, we contacted Ms. [redacted] and informed her that the Note was still due and we would pay any late fees due to this oversight; however she was responsible for paying the balance of her NoteWe were requested to speak with HUD on Ms. [redacted]’ behalf to explain to them the scenario and verify her late fees.After a few emails and missed/unreturned phone calls-- [redacted] and the representative for HUD finally spoke in which [redacted] confirmed the amount of $315.91 for late fees and informed Ms. [redacted] of this amount.A check for $315.91 was sent to Ms. [redacted] on 04/18/2017 which she promptly cashed. We have since been informed that this is a common problem with the Subordinate 2nd HUD loans according to the National Underwriter Stewart Title. It is a trending claim issue in 2017.
