I am rejecting this response because: The time, effort and stress that this project has caused me is far beyond the amount of money quotedI had to fix things I should not have had to fixWork that was done by Delta was sub standard and still isI haven't painted the wall yet as it still need correctingAdditional, the concrete has started to crack in lumpsI contacted a concrete expert and was advised to stain the concrete in an attempt to hide the cracks which was at great cost and only yesterday I sat out and noticed a piece of loose concrete.Nowhere else in my whole yard, which has a lot of concrete that is plus years old, has this happenedBut with the Delta work it has happened and I'm sad to say will most likely continue to happen.I do not want to meet with ***I offered on very many occasions for him to do a final inspection and now he want to meet when it the situation is seriousI would rather not.My original claim for the wall stands

As stated in the original quote (Estimate 510), the plan for the project was to build a straight wall along the front yard with a 90-degree angle towards the houseThe work to construct the wall was delayed because the day we poured the concrete Mr [redacted] requested a change in this agreementThe changes were to build a wall with pillars of 1’ X 1’ X 38” high and a semicircle at the center of the front wall (Estimate 539)On that day we installed the first layer of blocks to begin the building of the wallSince the wall was no longer straight, we had to place a special order for the wall caps of the section that was missed due to the change, which took time for the order to processWhile waiting for the wall caps, Mr [redacted] continued the work on building the wallOnce the wall was built Mr [redacted] purchased the Verneer stone to be used on the pillarsOn that day we met to go over the details of the project and we offered our help to unload the stone from his truckLater that evening he called me to complain about broken stone and mentioned that my team dropped the box with the Verneer stone from his truck onto the floorI found difficult to believe that my team could pick a pallet with a box of Verneer stone and let it drop to the floor due to the fact that the space between the back of the truck and the garage was only couple of feet, leaving no room for the palette to be dropped and the weight of the box made it impossible for the team to lift it over the bed of the truck and drop it to the side of the truck on the floorI called my team to learn more details about the incident and confirmed that they unloaded the stone one by oneI contacted Mr [redacted] and he stated that he no longer had trust on the team and did not want us to continue building the wallThe construction of the project ceasedA few days later on July 27, 2016, Mr [redacted] sent a text message stating, “Now that some time has passed the dust has settled and my emotions have subsided, I’ve realized that the right thing to do is for you to finish this project I spent a considerable amount of time getting quotes and refinances of other companies, and even though this project has not gone completely smooth I believe yours should be the company that finishes it.” We came to an agreement to continue with the projectAlso, he requested that all the work to be done under his supervisionThis condition allowed only a couple hours of work during the evening after Mr [redacted] returned home from workWe agree to those conditions to finish the project in good termsBecause we could only work for short periods of time it took longer to install all the stone on the pillars and we had to place the order again for the wall caps since the original order was canceledFor all the reason above explained, the project was delayedDue to the delays Mr [redacted] did not want us to continue the project with the installation of the wall capsIn regard to the finish of the wall, Mr [redacted] never requested that the finish of stucco on the wall we were building to match the finish of the stucco of the houseWhen he requested our company to return to finish the work on July 27, when the stucco was already done, he did not complain about the quality of the finish of the stucco implying that the work was acceptableAlso, on the last day that Mr [redacted] worked at Mr [redacted] ’s house, doing the final cleaning of tools and materials, Mr [redacted] asked Mr [redacted] to install the wall caps with out notifying me of the work that he had just requestedAt that time he did not complain about the finish of the stucco or the visible aggregate on the Vermeer stone, since Mr [redacted] installed them following the process established by the industry as shown by picture The lack of complaints at that time and the request made by Mr [redacted] shows that the quality of the work is acceptable and Mr [redacted] likes [redacted] ’s work

As stated in the original quote (Estimate 510), the plan for the project was to build a straight wall along the front yard with a 90-degree angle towards the house. The work to construct the wall was delayed because the day we poured the concrete Mr. [redacted] requested a change in this agreement. The...

changes were to build a wall with 5 pillars of 1’ X 1’ X 38” high and a semicircle at the center of the front wall (Estimate 539). On that day we installed the first layer of blocks to begin the building of the wall. Since the wall was no longer straight, we had to place a special order for the wall caps of the section that was missed due to the change, which took time for the order to process. While waiting for the wall caps, Mr. [redacted] continued the work on building the wall. Once the wall was built Mr. [redacted] purchased the Verneer stone to be used on the pillars. On that day we met to go over the details of the project and we offered our help to unload the stone from his truck. Later that evening he called me to complain about broken stone and mentioned that my team dropped the box with the Verneer stone from his truck onto the floor. I found difficult to believe that my team could pick a pallet with a box of Verneer stone and let it drop to the floor due to the fact that the space between the back of the truck and the garage was only couple of feet, leaving no room for the palette to be dropped and the weight of the box made it impossible for the team to lift it over the bed of the truck and drop it to the side of the truck on the floor. I called my team to learn more details about the incident and confirmed that they unloaded the stone one by one. I contacted Mr. [redacted] and he stated that he no longer had trust on the team and did not want us to continue building the wall. The construction of the project ceased. A few days later on July 27, 2016, Mr. [redacted] sent a text message stating,  “Now that some time has passed the dust has settled and my emotions have subsided, I’ve realized that the right thing to do is for you to finish this project… I spent a considerable amount of time getting quotes and refinances of other companies, and even though this project has not gone completely smooth I believe yours should be the company that finishes it.” We came to an agreement to continue with the project. Also, he requested that all the work to be done under his supervision. This condition allowed only a couple hours of work during the evening after Mr. [redacted] returned home from work. We agree to those conditions to finish the project in good terms. Because we could only work for short periods of time it took longer to install all the stone on the pillars and we had to place the order again for the wall caps since the original order was canceled. For all the reason above explained, the project was delayed. Due to the delays Mr. [redacted] did not want us to continue the project with the installation of the wall caps. In regard to the finish of the wall, Mr. [redacted] never requested that the finish of stucco on the wall we were building to match the finish of the stucco of the house. When he requested our company to return to finish the work on July 27, when the stucco was already done, he did not complain about the quality of the finish of the stucco implying that the work was acceptable. Also, on the last day that Mr. [redacted] worked at Mr. [redacted]’s house, doing the final cleaning of tools and materials, Mr. [redacted] asked Mr. [redacted] to install the wall caps with out notifying me of the work that he had just requested. At that time he did not complain about the finish of the stucco or the visible aggregate on the Vermeer stone, since Mr. [redacted] installed them following the process established by the industry as shown by picture 1. The lack of complaints at that time and the request made by Mr. [redacted] shows that the quality of the work is acceptable and Mr. [redacted] likes [redacted]’s work.

I am rejecting this response because: Although there was nothing written in the quote about Delta, matching the stucco on the wall, to the stucco of the house. There was verbal agreement that this would be done. The fact that I overlooked that this detail was not outlined in the original quote does not deny the fact that this was always the case. Why on earth would I want a wall that was in such close proximity to my house, not match to my house. Mr. [redacted]s was happy with the verbal requests especially as we were paying cash for the entire project. I have neighbors who have a wall built similar to ours. I took Mr. [redacted]s to view this wall, as this was how we wanted our wall to look. While at the neighbor’s house, and with the occupants, I again mentioned that the stucco and the edging of their wall looked great and I asked that my wall look like theirs. Matching the house was important, to which he responded, yes it would. I also sent many photos to Mr. [redacted]s of the way the wall looked with the bottom edge and the matching stucco. After [redacted] had started to stucco the wall, I asked if it would match the house and he informed me it would. I later asked [redacted] to fix the stucco because it didn't match the house. He told me he was going to sand the high spots down and that it would then match the house. This wasn’t done. I asked how he was going to finish the bottom edge and he told me that it was done. I had to grind the bottom edge of the cement finish on the wall because it was left in an awful mess. This was something I'd asked [redacted] and Mr. [redacted]s to correct many times, but it never was. Metal bars were dangerously left sticking out of the walls, that I had to use an angle grinder to cut off. I had asked for this to be done, but it never was. I repeatedly asked Mr. [redacted]s to come and look at the work that had been performed. However, Mr. [redacted]s never came and did a final inspection of his companies work and avoided all calls and texts that I sent him. I last called on or around August 17. At this time a asked Mr. [redacted]s to please come and look at the work and help advise me how to clean the cement residue from the veneer stones as well as how I should deal with the stucco. I heard nothing from him until the day after I submitted this complaint. In a recent text he asked if we could settle this quickly between ourselves, without involving anyone else. Mr. [redacted]s had previously agreed in a text to me that his team had made mistakes and apologized. But none of the poor workmanship was ever repaired. Then again after I made this complaint, he told me in a text that he had proof that other contractors who had worked for me had had the same issue with me. Apparently I have a habit of having work done and then complaining about the work so I don't have to pay for the work. I’ve had four contractors work for me since living at my address, and have had no issues with any of them. I will gladly give their contact details. Regarding the veneered stones, if someone were to look at a pallet of veneer stones they would see that all the stones are presented carefully and neatly, layered with paper between each layer in a box attached to a pallet. I had approximately 1/3 of a full pallet of veneer stones in the back of my truck that day. None were damaged as I had checked many of them. I had offered to unload the stones myself, but Mr. [redacted]s insisted his team would do it. His two employees as well as [redacted] dragged the pallet to the end of the bed of my truck, tore open the pallet box and dragged every last stone from the bed of the truck dropping them onto the floor. At this point I did get very upset and called Mr. [redacted]s. He again never answered my call but did call back later. I asked him to come to my home and look at the work but again he never did. I did decline Mr. [redacted]s supplying the wall caps in the end because I was tired of waiting for them. I was told on the 6th of June By Mr. [redacted]s that he would supply the caps and yet apparently he didn't order them until August the 9th. that's over two months! I have many texts and photos to support these claims, I have contractors whom I’m sure would attest to my integrity. All I ever wanted was a good working relationship, and a good quality product, as I have had from other contractors.

I am rejecting this response because: The time, effort and stress that this project has caused me is far beyond the amount of money quoted. I had to fix things I should not have had to fix. Work that was done by Delta was sub standard and still is. I haven't painted the wall yet as it still need correcting. Additional, the concrete has started to crack in lumps. I contacted a concrete expert and was advised to stain the concrete in an attempt to hide the cracks which was at great cost and only yesterday I sat out and noticed a piece of loose concrete.Nowhere else in my whole yard, which has a lot of concrete that is 10 plus years old, has this happened. But with the Delta work it has happened and I'm sad to say will most likely continue to happen.I do not want to meet with [redacted]. I offered on very many occasions for him to do a final inspection and now he want to meet when it the situation is serious. I would rather not.My original claim for the wall stands.

I would like to resolve this matter by meeting Mr. [redacted] half way. I propose that Mr. [redacted] keeps the remaining balance of $1,654.80 which represents 52.45% of the cost of the project. He could use those funds to complete the project by the means he choses even though we completed more than 50% of the construction of the wall. Please let me know if you have any other questions.
