Here is our business response:The above consumer was a member of our facility and was well aware of our cancellation policies as we go through great effort to make sure our members fully understand their contract before signingThe above consumer signed a contract and signed the specific page within her contract that clearly states that she will give Delta Life Fitness days notice of cancellation prior to her set draft dateThe consumer's contract was breached by failing to submit her cancellation request within the allotted time frame for cancellations and she was penalized. The consumer did submit a doctors notice after the allotted time frame; however the notice provided from her doctor clearly shows that she was NOT examined and that she was simply not to do any "intense" workoutsThe notice also never mentioned that she was high risk or any other concernsAttached is the doctor notice that we received. Also, here at Delta Life Fitness, we provide pregnant friendly/light workouts so that our expecting members can still stay on track with getting fitWe do understand that unexpected pregnancies happen and that it is unlikely to predict when you will become pregnant but the consumer did not take the correct actions or provide accurate documentationThe above consumer did not comply with company policy, she did not comply with her contract, and the consumer's doctor notice did NOT support her given reasons for cancelling and therefore is not eligible for a refund; however, once the consumer has given birth and is cleared to workout again we will gladly welcome her back and credit her account in the amount of her penalty feeSincerely, [redacted] Gym ManagerDelta Life Fitness Mid-County

Response to complaint :On 11/30/15 Mrs. [redacted] signed a 6 month membership contract with our facility, agreeing to come in and cancel her membership in person if she did not wish to continue after her 6 months were fulfilled. This is our company policy and is required of every member of our facility. Mrs. [redacted] emailed me on 6/20/16 requesting an explanation on the charges. I thoroughly explained the charges, our cancellation process, and the options available to her. Two days later on 6/22/16 Mrs. [redacted] signed her cancellation form and we considered the matter closed. On 6/27/16 Mrs. [redacted] came into our office with a rather hostile demeanor. I had my assistant, [redacted], locate Mrs. [redacted]'s file, and signed cancellation form, in hopes that we could reach a resolution. I offered to credit her account for one month so that she could continue to workout when it was convenient for her.  Mrs. [redacted] refused the offer.  Mrs. [redacted] asked who else she could speak with, besides myself, and I
informed her that I am the acting owner of this business. The sole
proprietor of our facility has left every operation of the business to
my discretion. This displeased Mrs. [redacted] and then her demeanor became even more hostile as she proceeded to curse and exit the building. Upon her exit she slammed the front door so hard that it rattled the entire office and alerted everyone in the building. My assist was present during all of this. We take pride in our business and are always willing to work with, and help out, any of our members ; however, we do reserve the right to refuse service if necessary. Mrs. [redacted] was/is responsible for the membership dues for the month of June 2016 as she did not comply with our termination policies. I am still willing to credit her account with us for 30 days.Response to message:Mrs. [redacted]'s inability to reach the survey must have been a technical issue as I don't have the capability of revoking her right to take the Exit Survey. I will gladly sit down with any member to discuss any issues or concerns they may have and strive for a resolution. Sincerely, [redacted]

Prior to closing on Monday July 27th I received this email, but once I spoke with her about disagreement of charges she revoked my rights to a survey. When I tried to complete it states no longer available not long after disputing the charges. She also told me there was no one else I could complain...

to but her. But most of all the lack of sincerity for her customers is really what made me decide to file a complaint. She belittled my position as a grown woman. She states, "As a adult you should have known about the extent of the six months." She was overall very rude and not professional. I also have a friend who attended and has the same complaint and would like to end her membership in which I will be referring her over to Revdex.com to expos her experience with Delta Life Fitness and manager [redacted].

Here is our business response:The above consumer was a member of our facility and was well aware of our cancellation policies as we go through great effort to make sure our members fully understand their contract before signing. The above consumer signed a contract and signed the specific page...

within her contract that clearly states that she will give Delta Life Fitness 10 days notice of cancellation prior to her set draft date. The consumer's contract was breached by failing to submit her cancellation request within the allotted time frame for cancellations and she was penalized. The consumer did submit a doctors notice after the allotted time frame; however the notice provided from her doctor clearly shows that she was NOT examined and that she was simply not to do any "intense" workouts. The notice also never mentioned that she was high risk or any other concerns. Attached is the doctor notice that we received. Also, here at Delta Life Fitness, we provide pregnant friendly/light workouts so that our expecting members can still stay on track with getting fit. We do understand that unexpected pregnancies happen and that it is unlikely to predict when you will become pregnant but the consumer did not take the correct actions or provide accurate documentation. The above consumer did not comply with company policy,  she did not comply with her contract, and the consumer's doctor notice did NOT support her given reasons for cancelling and therefore is not eligible for a refund; however, once the consumer has given birth and is cleared to workout again we will gladly welcome her back and credit her account in the amount of her penalty fee. Sincerely, [redacted]Gym ManagerDelta Life Fitness Mid-County

I am rejecting this response because: [redacted] is certainly lying about me coming in with a hostile demeanor. It was not until discussing the agreement and going over the terms which I was not aware of, and [redacted] speaking to me with the most disrespect as if I was not an adult or a person of "her" standards. [redacted] spoke to me about how this was not her problem, aggressively stating that as a "adult" I should have read this and this is something I should've have knew. She also arrogantly stated that there was no one else I could speak to besides her as if there's nothing I could do about it. Also when signing up online it did not state that I had to cancel after the 6 months in person because otherwise I would have. Also I signed up via Facebook, there was no introduction with someone sitting down with me, when I did say the paper that she is speaking about it was my first day coming work out and she didn't sign me up or go over anything, I was handed a paper and just telling me about how it will be drafted from the account. If there was information about coming back to fully cancel the membership it was in small writing the rest was highlighted as a way to trick members. Another issue I want to address, not once did I curse so that was a lie, I did slam the door but not to the matter where it would alert other members she's over exaggerating so she can make light of her lack of ability to be professional. Also why would I want to complete a month with that business after the way she spoke to me and also told me I was no longer welcome there. She did not offer a month until after I repeatedly asked what could be done. My first contact was not the 20th and I have emails to prove that. Which I will send as well. Another thing why was June drafted from my account on June 16th that's no where towards the end of the month, I honestly believe she knew my membership was ending and she immediately draft TWO $97 transactions from my account on the 16th, how can she explain that? At this point I want nothing to do with the business, but I would like to note this with the Revdex.com and will express my concerns to others. Clearly she is not willing to refund my $97. Also she's lying about the survey how convievent for it to have a error after my exprerience with her.
Sincerely,
[redacted]
