Delta Management Associates, Inc(Delta) sent the complainant four separate mailings since March Further, Delta made multiple attempts to contact her by phone (at the same telephone number referenced by her in her complaint) to assist her in working toward a mutually beneficial resolution Until the receipt of this complaint, Delta has only had one other contact from the complainant, which was on 3/10/when she called our office after having received our initial noticeBut the complainant hung up while being transferred to a representative who could assist herNone of our subsequent voicemail messages were responded toIn searching our inbound/outbound call database, Delta could find no other contact or messages left for us by the complainantThat said, the complainant has asked that Delta cease our attempts to contact her by phoneAs of 10/20/15, Delta has duly noted this request and will not place any calls to the complainantShould the complainant wish to discuss this matter with Delta, we remain very willing to assist in whatever ways possibleShe may call us at [redacted] , extension ***This will connect her with [redacted] , our Unit Manager

Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Both the secretary and HR witnessed Delta Management requesting to speak to me on the second call, and when I came to receive the call, I advised them as I did prior to not cally work place They also called several employees prior advising them that they have reached the wrong extension and to please transfer them to my extension and with some they even left their contact number to be called This is a practice of this company They should not be in the business of calling workplaces even if it is legal but when told not to, should abide by the law On both calls, I have witnesses of me asking them not to call and on both calls they asked for me directlyThey are creating narratives outside the truth to cover their nefarious operations and I pray and hope that more people speak up Since filing this complaint, the calls have stopped Regards, [redacted] ***

Delta Management Associates, Inc(Delta) did place calls to the complainant's phone as statedOur objective was to reach a different person and we were provided information which linked that person and the complainant as possibly being acquaintedAs the complainant has now clearly indicated, there is no knowledge of the person with whom we were trying to reachThat stated, Delta has removed the complainant's phone number from any association with that third party, and no further calls shall be placed by Delta to the complainantFurther, Delta genuinely apologizes to the complainant for any inconvenience our calls may have causedLastly, Delta believes that the last call referenced by the complainant was the result of a poor line connectionIn our review of that call, Delta's rep was trying to access information and, after about seconds of silence, the line goes deadUntil that point, the conversation was quite friendly and productive

Again, Delta Management Associates, Incis not "DTM", and did not place the phone calls to the complainant that she describesWe are neither aware of, nor affiliated with, a company named ***Nor were we ever attempting to speak with the complainant about a car loanAs stated in our previous response, Delta placed a total of three calls to the number the complainant listed as hers in her complaintThe dates were 2/18/16, 3/22/16, and 4/7/On none of those occasions did we speak with the complainant or any other personWe received a voicemail greeting that identified the phone number and did not leave a message on any of the three call attemptsThe telephone number she identifies does belong to DeltaBut there must be confusion as to which calls were placed by which party, as we are absolutely not associated with the call(s) she describedAs stated in our last response, we have entered clear and conspicuous 'Do Not Call' alerts, and will attempt no further contact with the complainant

In an effort to best address the complainant's concerns, I'll answer each item individually1) Again, Delta was provided an address by our client, and that was the one to which all mail had been directedDelta would have had no reason to change an address on which we had no indication of its inaccuracyWe presume the address we were furnished is good until we receive indications to the contrary2) Delta not receiving returned mail or a forwarding address from the Post Office is among the few ways we can validate an address' validityIt is admittedly not foolproof, but it was all the information by which we had to go3) As to Delta's policies of requiring a person's name, date of birth, and (at least the last digits of) their social security number, this is done to ensure that the sensitive information with which we're entrusted remain secure and that it is not disclosed to anyone other than its intended recipientDelta does recognize that some are uncomfortable providing it, but it is a necessary safeguard put in place to protect the privacy of the consumers whose information we possessAs to the complainant's request to stop the garnishment, it cannot be done until or unless certain prerequisites have been metThese were described in Delta's initial responseDespite the complainant's skepticism, Delta does wish to assist him in the process of stopping the AWG actionFurther, Delta would have absolutely preferred that something was done prior to its commencement that would have avoided it altogetherNow that it has begun, there are procedural steps that must be takenAgain, the complainant is encouraged to contact Delta to explore those optionsAs stated previously, Delta remains committed to doing everything possible to work with the complainant

Delta Management Associates, Inc(Delta) did place one call to a relative of the complainant's as a means of procuring location informationDelta had tried for over a year to reach the complainant at the number she provided in her complaint, but we had made no contact and our messages were not returnedWe therefore questioned whether or not the number we had was valid or if the phone was even operationalUnder such conditions, Delta is allowed to place calls to third parties to obtain the location information we sought from her relative when calling 2/22/It is important to note that no personal or private information whatsoever was disclosed to anyone during this callThat stated, Delta will honor the complainant's wishes that we cease all efforts to contact third parties and, to that end, conspicuous 'Do Not Call' alerts have been enteredAll future attempts to reach the complainant will be through mail, at the number she provided, or at an alternate number we believe is valid to reach her directlyIf the complainant wishes for us to cease all efforts to reach her by phone and/or mail, we ask that she so directs us so that we can further update our records

Delta Management Associates, Inc(Delta) has had many communications with the complainantIt is now, and has been, Delta's policy to ensure that we only disclose the specifics of the purposes of our calls to individuals whose identities have been confirmed and who are authorized parties to receive the informationWhile we certainly understand that the complainant may not feel comfortable disclosing this information, it is Delta's policy nonetheless, and no substantial conversation can take place without it taking placeAgain, Delta takes very seriously our responsibility to safeguard the sensitive information with which we are entrusted...both from the standpoint of consumers in general and our clientsAs the complainant pointed out, we have since received from her the information we required in order to proceed and, at this point in time, nothing else is needed of herDelta does apologize for any inconvenience our policies may have unintentionally caused the complainantWe do thank her for her cooperation and for having voiced her concerns

Delta Management Associates, Inc(Delta) did initiate a mailing to the complainant's employer directing them to withhold 15% of her wages through an Administrative Wage Garnishment (AWG), although Delta would not classify this as an "informal letter"Prior to this mailing, Delta had sent letters directly to the complainant, and had attempted to reach her by phone on multiple occasionsVoicemail messages were left for her and one contact was made wherein she indicated she wished us to call her at work no furtherThis demand was honored by DeltaThe latest contact with the complainant's employer was not made to establish contact with the complainant...rather to effect the collection of the account directly from her employerDelta will continue to honor the complainant's wishes that we not contact her at her jobHowever, future calls may be placed to her employer to ensure that they comply with the demand made of them as outlined in the mailing to which the complainant refersLastly, as the complainant now indicates that she questions the validity of the debt on which Delta is collecting, we will request and forward her a copy of the Promissory Note as well as a copy of the payment historyWhile Delta anticipates we will get this information to the complainant in relatively short order, it is important that she understand this request will not forestall the AWG action that is in place against herShould she have any questions of Delta, the complainant is free to contact Delta at [redacted] and speak with [redacted] She is the manager of Delta's AWG unit

Delta Management Associates, Inc(Delta) did place a handful of calls to the complainantBecause Delta has not spoken with the complainant as yet, we are uncertain as to whether or not she is actually the person with whom we wish to speakDelta did initiate a mailing to the party with whom we seek to communicate, but the address to which it was sent was in OhioAll of this notwithstanding, Delta will happily honor the complainant's wishes to not be contacted by us by phone and has placed conspicuous Do Not Call alerts to the two numbers we believe the complainant to be referencingNo calls will be initiated to the complainant at these numbers until or unless the prohibition on our calling them has been rescinded by the complainant

Delta Management Associates, Inc(Delta) did, on behalf of our client, agree to accept a reduced sum to settle her daughter's accountA letter was sent indicating the amount and the date by which the payment needed to be madeThe complainant mailed a payment that was $less than the amount needed to fulfill the settlement agreementThe account sat in an 'unmanned' queue for a period of time until Delta received a call months later from the complainant inquiring as to why a balance still showed as owing from our clientIt was explained to her that the settlement amount was less than agreed to, and different options of remedying the existing default were discussedDelta tried many times to follow up with the complainant and her daughter, but our calls that were placed over a period of several months were not returnedDelta heard nothing further until March after the complainant's daughter's tax refund was intercepted and applied toward the outstanding balanceEven after the application of this offset payment, a balance does remainDelta would be happy to discuss both the application of the payment as well as means of resolving the remaining liability with the complainant and/or her daughterEither of them are encouraged to contact Delta's Special Assistance Unit at [redacted] This group is comprised of Delta's managers trained in handling consumer inquiries and/or concerns

Most importantly your statement about making several attempts to contact us is ridiculousThis was already discussed between myself and a delta supervisor that absolutely no attempts were made for seven months , either by letter or phone call by delta , in fact he expressed to me that it concerned him that no contact was attempted for so many monthsI finally received a letter in AugustTo me this is a sure way to collect more interest, and why leave a dollar balance on the account ? Why not take the whole amount from her taxes ? I would still to this day not know about this balance had I not contacted deltaAgain there was no attempt by mail or phone to advise us of any balance.So most of your response is untrue Before you were paid 14,we were contacted by delta several times a week Then you say the account sat unmanned for several months ? What does that mean? And why? I feel delta dropped the ball on this and it has cost my family a lot of money in penalties and interestI have to ask , when were you going to advise me of any balance due? Next year at tax time? Delta Management Associates, Inc(Delta) was assigned a defaulted federal loan in the complainant's name for collection from [redacted] (***) on 1/22/(seven days ago)While attempts were made to reach the complainant by phone and mail, Delta never attempted any calls to the number provided by her in the complaintAll calls that were placed were done within permissible timeframes and in accordance with both law and Delta policiesIt is worth noting that the latest time of day that a call was ever placed by Delta was just after 4:00PM (on 1/22/18)The address Delta was provided by [redacted] does not match the one furnished by the complainant so we have updated the address and initiated another mailing to the complainant that will explain the account better, as well as explain rights afforded her under the FDCPADelta has also never had any communication whatsoever with the complainant until this filing, including any receipt (verbally or in writing) of her wish to not be contacted by phone about this matter -or- her request that we send her a copy of her agreementThis fact notwithstanding, Delta has placed conspicuous 'Do Not Call' alerts on the complainant's file and will honor her wishes henceforth and will also forward her (to the address she provided) a copy of the promissory note that binds her to this accountAs stated earlier, Delta will place no future calls to the complainant, but remains happy to try to help her resolve this matter as best we canShould she wish to contact Delta, she is welcome to call us at ( [redacted]

Delta Management Associates, Inc(Delta) began speaking with the complainant in August The program to which he refers was discussed in detail, as were the terms and timelines associated with the avoidance of collection costs being addedUnfortunately, the timelines were not met, and the collection costs were (irrevocably) addedDelta did send the agreement out, through email and through ***Again, this agreement was not returned timelyLastly, as to the issue of Delta's identification policy, we understand that some consumers find it onerous, and apologize for any inconvenience the complainant may have felt as a result of this policyBut the policy exists to ensure that the private and sensitive information with which Delta is entrusted is only disclosed with individuals whose identities have been fully verified by us

Delta Management Associates, Inc(Delta) did initiate an Administrative Wage Garnishment (AWG) on behalf of our client as indicated by the complainantPrior to the commencement of this action, Delta sent letters and attempted phone contact as means of avoiding itDelta believes that we did speak with the complainant in April but, because the person with whom we spoke declined to provide the identifying information Delta requires before disclosing the purpose of our call, we were unable to go into any detailAs to the address to which letters were sent, including the Notice Prior to Wage Withholding, Delta mailed all correspondence to the address provided us by our clientThe responsibility for furnishing his creditors with updated addresses and/or telephone numbers lies with the complainantDelta received no mail returns on any of the letters sentIt is important to note that Delta would have certainly preferred to have spoken with the complainant prior to the commencement of AWG and to have provided him voluntary alternativesAs it is, the complainant still has optionsHe may file for an untimely hearing if the validity of the debt is in question, if he feels he may be eligible for a discharge of his loans, or if the amount being taken through garnishment presents a hardship to him and/or his dependentsThe other options, to which the complainant already alluded, would be for him to either pay in full or settle his account, or to make five qualifying voluntary payments in addition to the amount being garnished at which point the AWG action would be suspendedAll of these options can be discussed in greater detail, and the complainant is encouraged to contact Delta directly toll-free at [redacted] Delta would be happy to assist the complainant in any manner possible

As stated in our initial response, Delta believes that we made more than adequate efforts to communicate the outstanding needs to the complainantAgain, many calls were placed, many messages were left, and many letters/agreements were sentNone of these were responded toA completed loan rehabilitation would have been to the complainant's benefitIt still would prove beneficial to him, even having to start it anewBut it is also important to note that a completed loan rehabilitation is in Delta's best interestThe complainant and Delta were working together toward the same goalBut in order to achieve it, lapses in communication (such as those described herein) cannot occurAs of 1/13/17, the complainant has re-enrolled in the Loan Rehabilitation ProgramIt is Delta's hope and objective to see this through to completion, just as it was last time

Delta Management Associates, Inc(Delta) has had a total of two conversations with the complainant since her account was placed with us more than months ago; one on 12/1/and the last on 2/7/Despite the claims by the complainant that Delta's representatives were needlessly threatening, our review of the recorded calls indicates that the complainant was dealt with in a calm, patient, and professional mannerThe complainant even commented on the fact that she was pleased that Delta's agent took the time to carefully explain the status of her loans and the options available to her on the call on 12/1/Unfortunately, the call on 2/7/was less productive, as the complainant insisted that she had spoken with the United States Department of Education (ED) and was told that her two loans showed a $balanceDelta's agent attempted to explain that the liability about which we were communicating was not with **, but with [redacted] (***) on defaulted loansThe complainant accused Delta's agent of not willing to assist her and she hung up the phoneIt is vital to note that Delta's statements to the complainant relative to Administrative Wage Garnishment were made informationally...not threateninglyWhen Delta spoke with the complainant on 12/1/16, it was her calling us in response to a Notice Prior to Wage Withholding (NPWW) that had already been forwarded to herThis notification identified the complainant's liability to [redacted] and provided her specific recourse for avoiding the imminent wage garnishment actionOutside of the complainant's phone call to Delta (which, in and of itself, is not an adequate response), Delta has received no reply from herAt this point, because no formal response to the NPWW was received within the prescribed period of time, an Order of Wage Withholding was sent to the complainant's employer instructing them to remit 15% of her disposable wagesAgain, the statements made about garnishment were neither reckless nor cavalier...at the point garnishment was mentioned, the process had already begunBecause the complainant is seemingly upset by the tenor of the two conversations she has had with Delta, and because we do not wish to further upset her, we will cease placing any calls to her from this date forwardThe complainant obviously remains free (and welcomed) to contact Delta, as we remain happy to discuss voluntary resolution of her liabilityIt is important for the complainant to understand, however, that her account is presently in active garnishment and must now be handled differently
