January 11, 2018 To Whom It May Concern;             Thank you for contacting us, we really appreciate your giving us an opportunity to present our side of the story in response to Miss [redacted]’s complaints in this...

case.  Here is what happened based on my Manager on duty recollection.  Miss [redacted] came to our store that day and asked to get her nails done.  We asked her to be more specific on what needed to be done, she mentioned that she wanted her nails to be longer, that it would last for a while, yet still would keep her real nails healthy. This was the very first time we met Miss [redacted].  She had never been to our store before.  She is not our regular customer.  We recommended to her the new Organic Deep Powder Manicure that is so popular now.  This technique does not require the usage of a lot of extra chemicals, thus would keep her nails much healthier.  She asked how much that would cost, we pointed to our price list on the wall that it is $35 dollars.  My manager also said that if she wanted to extend her nails to be longer, we need to put little tips on the nails to extend them, and with such extension, there will be a $5 dollar extra, this is also on our price list, so the total would come to $40 dollars.  At this point my manager on duty, also the person that did Miss [redacted] nails recalled clearly that Miss [redacted] did not give any indication that she disliked the price.  She sat down at my Manager’s station, and she did Miss [redacted] nails.During the course of this Deep Power Manicure process, there were other customers’ conversing with each other, and my manager responded to some of their questions, but there were definitely no disparaging remarks made towards Miss [redacted], whether on her appearance nor her taste, etc .. not as in her complaints.  If we made such remarks, why would any person just sit there and listen to that?  Any customer when heard such nasty remarks made towards her has every right to stand up, be very angry and leave.  The fact that she sat there very comfortably meant there were no such things said.  We are in a business of customers’ service, we thrive on giving our customers’ the best nails service possible, plus a friendliest atmosphere so that they would feel comfortable in our establishment and return again and again.  We have very strict guidelines in our establishment on what our technicians can talk to customers, no discussions on politics, race, religion nor personal family matters, and our technicians are for sure not allowed to judge anyone.  Throughout the whole Deep Powder Manicure, she never indicated that she didn’t like her nails nor its color.  If she didn’t like it, one, two may be three nails into the whole process, she would know that she didn’t like something.  This is similar to going into a restaurant, and ordered a plate of food, one, two may be three bites into it, you know you didn’t like that food.  Then you have the right to call the restaurant’s Manager over, explain what’s wrong and exchange a different plate.  You don’t eat the whole plate, then wait until they bring the bill to you, then complained that you didn’t like that plate of food.  But she sat there and let my manager totally completed her nails.  After her nails were completed, Miss [redacted] got up and pay, gave my manager her credit card, stood there watched my manager charged $40 dollars through our credit card machine.  When the receipt came out, she said why $40 dollars, my manager told her about the $5 dollars extra for the nails extension, which was mentioned before.  She said she is not paying for that, and she will not sign the receipt.  She also said that she will call her credit card company and dispute this charge.  She then proceeded to walk out of the front door.  My manager ran after her with phone in hand, dialed and called [redacted] Police.  When Miss [redacted] heard my manager’s calling [redacted] police, she stopped, then the Police came within a couple of minutes later, Miss [redacted] reluctantly signed the receipt.  Our manager has been working in [redacted] for 23 years.  She is very professional and has a very large clientele.  Her clients are also her friends in real life and on social media.  We had seen her came to the hospital to visit and did a manicure for one of her customers when this customer got into a car accident and broke her leg. We have all of our confidence in our manager’s truthful recollection of this event.  Furthermore, our establishment is in [redacted], which is predominantly African American.  All of our clients are African American.   If we made such disparaging or discriminatory remarks as Miss [redacted] claimed, how could we do business in this area for such a long time?  Miss [redacted] action (dispute over $5 dollars?) suggested that this was premeditated.  She came into our store with the intention of stirring up made up controversy to get herself out of paying.  She referred to our manager in this complaint as ‘The Chinese lady don’t know her name”.  Is this reference not discriminatory?  Our manager is Vietnamese.  Thank you for taking some time to read and listen to our side of the story.  We hope that this shed some insights on what happened.   We would like to stress that:We don’t surprise our customers with out of the blue extra charges, pricing is posted on the wall and customers will be told up front of their nails’ service cost.We don’t judge anyone nor any of our technicians allowed to make disparaging, discriminatory remarks towards any of our customers, not even in jest.  Thank you. Sincerely,  D’Luxe Nails Spa Management.
