I and my wife, [redacted], purchased a Dennis Banks-construction house in 1996. This year, 2015, I noticed a leaking roof and looked at my paperwork from the purchase and found a fact sheet from the sale that indicated the roof to have a 50-year limited warranty.On October 5, 2015 I visited the Dennis Banks office and spoke with Dennis Banks and his office worker, [redacted]. I explained the situation and was told the original paperwork, including warranty information, was in storage and it would take a few days for retrieval of the information I requested. On October 12th I contacted the Dennis Banks office by telephone and spoke to [redacted] and was told the paperwork had not been located.On October 14th I visited the Dennis Banks office once again and was told the paperwork had not been located and was asked to send a copy of my proof of warranty to[redacted].On October 15th I sent a copy of my paperwork to[redacted] via email, and have not been contacted since.Product_Or_Service: Single Family DwellingDesired SettlementIf the business can locate the original warranty and provide me with a copy, I'd like the warranty to be honored. If the business cannot locate the paperwork, I'd like the roof to be repaired to industry standards concerning a fifty-year roof warranty, but since the repair needs to be done soon due to the impending winter, I've contracted with another roofer and will need to be reimbursed if the warranty covers repair.Business Response Contact Name and Title: [redacted], AttorneyContact Phone: [redacted]Contact Email: [redacted]Dear [redacted]:Thanks for your letter of October 30, 2015, forwarding a copy of Case No. [redacted] involving a consumer complaint about a roof leak.Twenty years ago, my client Dennis Banks Construction Co., LLC was the general contractor for the construction of the homes in the subdivision. A brochure printed in 1995 describes a list of features of the homes, including "concrete tile roofs with Class "A" rated 50 year limited warranty." The brochure does not contain the tile manufacturer's limited warranty terms and conditions, however.The homeowner relates that the home was purchased in 1996. He further relates that at some point in 2015, he "noticed a leaking roof" and last month, October, 2015, visited my client's offices twice, and spoke to my client on the phone. He relates that my client asked for time to locate any paperwork on the home, including any warranty paperwork, and ultimately, he was informed that my client could not find any and asked if the homeowner would please supply the warranty. The homeowner then sent my client a copy of the 1995 brochure.The homeowner has complained to the Revdex.com that my client should pay for the homeowner to have any necessary repairs made to the homeowner's roof. I typically respond on behalf of my client when legal matters arise, and I am doing so here. In response to this complaint, please be advised that my client obviously is not the tile manufacturer or provider of the limited roof warranty. The warranty of materials and workmanship that applies to Nevada contractors does not go on for decades. A warranty that would cover a roof leak 20 years after construction of the home is a special matter of contract law, and the actual contract (i.e., the limited warranty contract) needs to be presented.In addition, the brochure refers to a limited warranty. This means that the manufacturer will provide certain benefits under certain conditions. Especially where a limited warranty is involved, it is essential, to establish the applicability and/or validity of a warranty claim under the particular circumstances of a given case, to have the warranty itself, which is why my client asked for it.My client has not received complaints of roof leaks at homes in the subdivision, except your Case No. [redacted]. However, if a leak exists and the homeowner wishes to pursue a warranty claim, it should be pursued according to the limited warranty contract with the manufacturer.Sincerely, [redacted]Consumer Response (The consumer indicated he/she ACCEPTED the response from the business.)The company lawyer who responded to my complaint was either not given the true facts about my visits to the office of Dennis Banks or has injected his own opinion about what I was asked to provide. When I visited the Dennis Banks office I asked the Dennis Banks office for any supporting warranty paperwork, since It had never been provided to me. I was then asked to provide any documentation I had supporting my claim. I provided what I had, because I was never given a written warranty. If I had a written warranty from the roofing subcontractor I would not have visited the Dennis Banks office, instead going to the subcontractor. What I was told was that any paperwork Dennis Banks had concerning my construction was unavailable, but would be provided to me when it was "retrieved from storage". I never got that information from the Dennis Banks office. If a home builder has put his name to a building and promised a 50-year warranty on any part of that building the builder should be able to keep the paperwork for 50 years. It appears this is not true with this builder. I am dissappoited he is unable to provide the warranty information I asked for, stating that he doesn't remember who the roofer was and that a 50 year warranty for a roof is unusual instead of providing the information. I accept the response from the Dennis Banks lawyer, but feel he and his client are not meeting the intent of the original construction contract.
