Mrs. [redacted] called on 5/15/2015 to say that her alarm system was not working and could not afford to pay for a service technician.  She wanted to cancel the account.  Rather than cancel the account, customer was offered a one time no charge service call to repair the system. ...

Customer agreed and decided not to cancel. At no time was the customer told to call in September to cancel the account.  On 9/9/2016, customer called in to cancel and was told that her agreement had renewed.  It is stated on the agreement that in order to cancel, we must receive a written request to cancel service at least 30 days prior to the expiration date.  The agreement was due to expire on 9/19/2016, which means that we would have needed written request by 8/19/2016.  After reviewing the account it was decided that we would forgo the buyout of the agreement if the customer would agree to pay for the no charge service call she was given in lieu of cancelling.  B Safe feels that this is a fair compromise.  Please let me know if I can provide you with any further information. Mary CakirCustomer Service Manager

Good afternoon [redacted]  BSafe has given much thought to Mrs. [redacted]’s recent response and felt it important to take her current situation into consideration, understanding that she is a retired nurse living on her Social Security benefits, and that she has been a long term customer of American Protections, and later assigned to BSafe, Inc.  We respectfully would like to offer a fair settlement to Mrs. [redacted]’s regarding the contract that she signed in 2002 and the terms of that agreement.  Please understand, that the terms were agreed upon with American Protection, and were assigned to BSafe Inc in 2015.  BSafe Inc. MUST abide by the terms of the agreement, as this is a legal and binding contract which the consumer would expect for us to honor, as we would expect them to honor, and as would the law itself.   However, under these circumstances, we are happy to offer to Mrs. [redacted] a change in her renewal terms, which are currently 5 years, and lower it to a 1 year renewal term which she will find is the minimum renewal terms on any contract within the industry.  This being said, instead of the term of the agreement of June 13, 2022, we will change it to June 13, 2018.  Mrs. [redacted] paid for the months of June through November and cancelled in December. This leaves the months of December 2017 through to June 12, 2018 which total $200.20.  We are also happy to work out a reasonable payment plan with Mrs. [redacted] if the full amount cannot be paid all at once.   We hope that Mrs. [redacted] finds this offer to be fair and reasonable, as our goal is to always come to an amicable agreement with our customers. We would like to thank her for the years of patronage and would like to close this matter with her at her earliest convenience.   Sincerely,     [redacted]

[redacted] does not tell people to call back when they are inquiring about cancelling their agreement. The policy is explained on the agreement about cancellation in writing at least 30 days prior to the expiration date of the agreement.   Every agreement has the terms and the renewal stated on it.  By signing an agreement you have verified that you have read it in entirety and agree with it.  We opted to let her cancel her agreement but are asking for the cost of the service call that was given to her in lieu of cancelling her agreement.

Dear [redacted],   I am responding to the complaint filed by [redacted].  We received a phone call from Ms. [redacted] 9/14/17 stating that she was considering changing her service to Comcast due to price.  She was offered a 10% Senior Discount, and accepted.  Her account was changed...

to reflect the reduced charges as well as a credit memo was created for the current invoice at that time.  Nothing further was said about cancelling. The next invoice was sent out and on 12/4/17 she called to cancel.  At that time she was informed that she could cancel but that the term of the agreement did not end until 6/13/22.  A buyout with default terms of 50% of the remaining term was sent to her.    Please refer to Line 3 Term of the attached agreement which indicates the agreement is for a period of five years.  The contract states under Line 4 Renewal; automatically renews for successive periods equal to the initial period unless written notification is received 30 prior to the expiration date.  The contract did not change, it is the same contract that was signed in 2002, a new contract was not sent to Ms. [redacted].  The contract automatically renewed several times before it was assigned to BSafe.  Please refer to Line 25 Assignability of Agreement.      1.        We addressed the concern about price with Ms. [redacted] on 9/14/17.  An amicable resolution was found.  2.        A new contract was not sent to Ms. [redacted].  It is the same contract that was signed in 2002, with the same terms and conditions that she agreed to 2002.  3.        A buyout amount of 50% of the remaining term was offered (refer to attachment).  Ms. [redacted] is not responsible for 100% of the remainder of the term.   We would like to resolve the matter with Ms. [redacted].  Customer satisfaction is very important to us at BSafe Security, as well as safety and security.  Thank you for alerting us to the open complaint.   Respectfully,     [redacted]
