Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me and the matter has been resolved Sincerely, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: As I have stated before, I will not accept this offer because it is just another way for Wilbar to make money off of my misfortunate original purchaseThe pool you are offering me to purchase at $is several hundred dollars than I can purchase it myself locally or even onlineI found the same pool online for $with free shipping and no tax They all include the liner and the skimmerSee Attachment for several prices from difference distributers The warranty is a scheme to have consumers purchase products at a higher price every years If Wilbar is the manufacturer then wouldn’t the price be lower than their distributers? Like I stated previously, I will settle for the 50% in a checkI have went elsewhere to purchase a new poolI have wasted half the season without a pool because the customer service at Wilbar waits to weeks to reply on their site It has been well over a month since the last reply I have received I purchased a better pool with a new pump, skimmer, filter, and liner for cheaper than you are charging me for a 50% discounted poolWhy is the price of the warranty that is supposed to be 50% off the retail price end up more money than the original price I paid for the defective product with the pump, filter, liner, skimmer, and ladder? This is just a skeem to require consumers to purchase your productsI will settle for 50% of the price of the pool as the warranty states I am eligible for at year pro-ratedInstead of me spending the money on the parts you can keep the parts and send me the 50% This would be $according to your math and the attached invoiceThis is the total amount subtracting shipping and tax I feel that the product is defective and should not be sold to any other customer knowing it will rust in only a few years This product should be recalled because it is a safety hazard to anyone who uses itIt will only be a matter of time before someone cuts themselves on the jagged rusted metal I have sent contact to the CEO Steven C*** I will be sending mail to his home asking for a resolution [redacted] Your name and each person that has gave me the run around on [redacted] with be mentioned in the letters I will sendThis is ridiculous to have to experience such terrible customer service from such a terrible product In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

The Platinum series warranty that is provided in the WILBAR response is not the same warranty that was provided to me at the time of purchase of my new swimming pol packageNowhere in my warranty that I received reads that I'm responsible for charges on a "defective" partAlso WILBAR response reads that I'm responsible for a ten percent service & handling charge on said "defective" partWILBAR quoted that said part# *** has a list price of $1,in a letter that I received from WILBAR dated ** June How does that come to a $service & handling charge? Sounds more like $More Fraud & Deception from WILBAR

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
The swimming pool is destroyed do to the wall rusting and splitting! When the wall gave away it shredded the liner gushing hundreds of gallons of water everywhereThe sand under the liner washed away along with the landscaping around the poolEstimated cost, less the landscaping, is $3450.00(labor, liner, sand and pool water). It is unacceptable to pay any cost at all! The pool should be replaced in the manner in which it existed prior to the rusting problem and we should not be responsible for any of the expense to restore the pool.

As previously stated the warranties have no monetary value and we do not send out checks or creditsThe terms of the warranty are only available thru the manufacture of the poolWe have offered you an all resin pool to replace the steel one you originally purchasedWe have gone above and beyond the terms of your warrantyIf you feel that you would like to purchase another pool at your local dealer that is entirely up to you, but we do not reimburse for thisWe have nothing further to add to this claim

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
The warranty does not state that it references "Seasons" over yearsIt is a year limited warranty, not a season limited warranty. I have attached the warranty for the pool. 50% off the price of the pool is equal to the full price that I originally paid for the poolThis manufacturer uses customers to ensure they continue to buy their product every years or so at the same priceThe same people that run the warranty also builds the product. This seems to be a conflict of interest in my eyes. The warranty claim I started was in the beginning of April but it took them until the end of April to respondThe would respond about once a week with, "Can you send more pictures"? I sent many pictures of the rusted parts over the course of months. They had a field technician call me and explain to me that things rustHe told me it could be the soil, rain, Bara metrics, and several other possibilities until I stopped him from giving me more excusesI told him my neighbors pool is over years old without one bit of rust on it and it is located about foot away from mineI found it hard to believe that my pool rusted while theirs does not if the landscape and weather are the same. I have attached a couple pictures of the damage and you can see the neighbor's pool right on the other side of the fenceI continue to read the reviews of several other consumers with the same issues I am havingThe customer service is terribleThey rarely respond and when they do it is brief with a pointless statement or question to buy them more time in the hopes that the consumer with become frustrated and stop proceeding with the claim. Their advertisement states that the coating on the material will allow the product to last many yearsI don't feel that years is many.

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
So your company bought out the original warranty company and isn't responsible FOR the OUTSTANDING warranties? ? So my warranty is basically INVALID because Wilbar picks and chooses what warranty and type of pool they want to cover?

Attached is your warranty letter and warranty for your poolIn the terms of your warranty it states; "Owner will be subject to all costs for transportation of the defective or replacement pool components and/or accessories." It also states "There will be a 10% Service and Handling charge on the
list price of all items ordered"At some point you spoke with your pool dealer regarding adding your order to one of their trucksWe can not guarantee when the warranty walls will ship, when added to a dealer's truck The cost you paid is for the handling fee and for the freight of shipping the wall to youThese are items are the consumers responsibility per the terms of the warranty

We received the Bill of sale for this pool on 6/**/and did not receive the images of the problem until June **, 2015. We processed the warranty letter on June **, and emailed a copy of the warranty letter to the consumerAttached is the warranty letter that was sentThe pool you have
was manufactured by ***, not Wilbar International*** has gone out of business and all the warranties for their pools are legally voidWilbar tries to cover the terms of ***'s warranties to the best of our abilitiesThe attached warranty letter is the best we can do to assist you with the problem you are having with your poolWilbar is not responsible for the liabilities of ***All of the warranties have a prorated warranty, which takes into account the general wear and tear that occurs over the life of a product and covers claims proportionately based on the time between the date of purchase and the date a claim is filedAt this time your pool is in it's 9th season and the prorate on your pool is 60%, giving you a 50% discount on covered partsIn the letter we are covering the wall, bottom rim and bottom plate at the prorate of 60%This means you have a 40% discount off of the retail price of the parts for your pool

We received the information for the warranty claimThe pool that you have was manufactured by *** not Wilbar International*** has gone out of business and the warranties are legally voidWilbar tries to cover the terms of ***'s warranties to the best of our abilitiesThe warranty for your Echo Canyon is pro-rated and is currently at the pro-rate of 60%, which gives you a discount of 40% off any of the covered parts you need for your poolThis is our best offer for your poolAttached is the warranty letter that was sent to you stating this informationWilbar purchased the assets of *** not the liabilitiesTherefore, we are not liable for any of ***'s warranties

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
They continue to claim there is damage at the skimmer and the return which there is not Again, why offer a warranty if you're not going to honor it? I wouldn't buy another pool wall from a company that doesn't honor the warranty The pool is warrantied for years and after years it is of no use to meI consider Wilbur to be very disreputable and dishonest business and would never buy another product from them

All of our pool warranties are by season not yearThe first season starts on the date of purchase and ends on December *** of the same year, the next season starts on January * of the next year and goes to December *** of that year, and so forthThis pool is in it's 6th season and the pro-rate
for this pool is at 50%That means the consumer received a 50% discount off of the price of the parts they need for their poolIn this case the consumers pool was needing to have a full replacement of the wall and frame and we have offered them this at a discounted price off of the retail priceThe warranty for our pools only cover the pool they currently haveIf a consumer needs to have a replacement frame and wall, the replacement will be the same pool if it is still manufactured or a compatible poolThis is up to the manufactures discretionIf the consumers wants a different pool they will need to contact a dealer in their areaThe warranty does not cover a different pool then the one they purchasedThe pool warranties do not carry any monetary value and we do not give credits or send out checksTherefore, this is not an option under the terms of the warrantyWe are currently in our busy season and the time frame to respond to warranty claims is taking to weeksThe warranties are worked in a first come first serve basisThis warranty claim was first worked on and a letter send to them on April **, At which time the consumer stated they would be speaking with a lawyerWhen this happens, we are unable to help them anymore with their warrantyThey will need to speak with our legal representativesWe have upheld the terms of the warranty and the price for the replacement wall and frame is our best priceThere is nothing more we can offer them regarding this warranty claim as we have gone above and beyond the terms of the warranty

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
The information for the warranty was submitted on the *** of June of this year I have an email that states from Wilbar that they needed information I as well as the associate from *** * *** of *** sent ALL the information as well I do not know how a company can run and NOT know what the right hand and the left hand do Copies of the pictures and the bill of sale were sent numerous times by both myself and *** * *** of ***! Yes, I know I have a manufactured pool by ***, but most times when people buy other people out or companies they carry over what was given such as this instance of the pool warranty I was NEVER notified of this and I'm sure I probably wouldn't be You should honor other warranties if you bought them out! Numerous phones calls were made and we NEVER got any response back, how does a company such as this work? And I was lied to stating I spoke to someone and did NOT, I write down everything and copy everything that I get to keep in my possession until things are taken care of!I can see this is not going to go know where because, your customer service and representatives that work at Wilbar International are very unprofessional I say this because of the NO return phone calls or emails and all the information I and the associate kept sending to this company was lost in the computer world, but I have my emails as well I'm sure *** * *** do too.I refuse to pay $for pool parts that is a disgrace especially with most pools having a lifetime warranty on them I hope to NEVER deal with this company again, I know I will not and will spread the wordHorrible dealing with! I just wanted my warranty honored and the parts for my pool Unfortunately I am not rich and can not afford!
