[redacted] contracted us to install (3) White [redacted] wells with ladders and grates and (3) replacement windows.    We installed everything according to our contract.  Our contract clearly states final balance is due upon completion of work, as well as on our...

preconstruction letter emailed to the client on 6/16/16.     The very nature of an egress window well, presents vulnerability to the space with regards to water. As a company, we go above and beyond with service to prevent potential water damage or build up. That being said, We never tell any client that we can fix all water issues, but we are always willing to do what we can for the safety and satisfaction of our clients, should they be willing to work with us.  Denver Egress Estimators/Sales reps explain to all of our clients the process of installing new window wells.   Denver Egress Windows will dig the wells down 12-18 extra inches below the window and install 4”-6” inches of gravel to help with drainage.   In Mr. [redacted]’s case, he let us know immediately after our installation that there was a slight water issue with one of the wells we installed. As you can see from the attached picture with tape measure confirming we dug down 20 inches EXTRA at the clients request to try and help resolve his water drainage issues. After further review, our installer determined water was being driven into the window well from the siding in the attached picture. As stated at the time of the sale; window wells are not designed to keep water out they only retain the dirt.  Basement windows are the lowest point for water to infiltrate.  We are contracted to only replace window wells; if the water is coming in through the wall or windows; the source of the water can only be from poor drainage, gutters or ground water table.   Mr. [redacted] was rightly frustrated, as any home owner would be, when having existing water issues in his home. However, Denver Egress was not responsible for these water issues the client had existing water issues before Denver Egress Window was contracted to replace the window wells and was only trying to help Mr. [redacted] get the problem resolved. Mr. [redacted] refused to pay for the already completed scope of work, yet expected us to do more work without payment. As we explained to Mr. [redacted], multiple times, Denver Egress was happy to continue working with him to resolve the water issue, but he needed to complete the final portion of his payment for the work we had already completed. He refused to do this, while being extremely hostile over the phone.   The Denver Egress Window company  prides itself on trying to help clients with their Egress windows and Window Wells; we do more than 1000 egress installs a year.   When communicating with [redacted]; his hostility, anger, and unprofessionalism was overwhelming. He would hang up on us multiple times when our staff was trying to explain possible resolutions to his window well water drainage issues.   We completed the work that we were contracted to do and installed everything properly to industry standards and actually went above and beyond by digging down the 20” inches versus our standard of 12”-18” inches.   When we were contracted to do the project with [redacted]; we explained to him that we would install this but sometimes this doesn’t resolve all water issues the only other thing we could do is install a sump pump. As we discuss with all our clients, this is not a bridge we want to cross until we have to, as it only adds more cost to the clients investment. We were happy to continue working with [redacted], however, his unreasonable request to wait until the next time it rained to complete payment on finished work was outside of our standard payment guidelines and forced us to send collections after this client.   If you need anything further from us please let me know.         [redacted] General Manager Denver Egress Windows [redacted] ###-###-####
