After reviewing the call placed, and listening to the voicemail left by the collector, a message was left for me to return the callEven if collector had no previous knowledge that the calls to my employer were prohibited, under FDCPA calls to a 3'd party are only allowed for sole purpose to identify location information and/or verify place of employment The message left by the collector did not state either of those allowed reasonsTherefore violating FDCPA {1).2. On 05/25/when I called collector back and was told that Desert Schools collector had made a web search and found my employer phone number,which was my manager's cell phoneThis is
simply not trueDoing a simple web search of my name you will find several websites listing
my current work number that I have had for years, none of these web searches list my manager's cell phone number as my work number.3. I did a web search of my manager's cell phone number and I was unable to find any website listing this number as my place of employment, or a contact number to reach me.4. If you provided a credit application in your responseI'm sure a work number was listed, this would have been the same number listed on any web search by simply searching my name, this is a valid work number and there was never any attempt to reach me on my actual work numberI have had this work number for over years.For the reasons listed above,it is evident the call placed to my employer, furthermore my manager's cell phone and the specific wording left on the message, was in clear violation of my privacy and my rights.I'm unable_,to accept your response as the actual circumstances of the call were quite different.*** ***###-###-####

This letter is being sent in response to the complaint
you filed with the RevDex.com (Revdex.com) on September 13, Your complaint
related to how Non-Sufficient Funds (NSF) fees are assessed
A copy of your complaint was received in our office on September 14, 2017.
In your complaint, you indicated that NSF Fees are assessed
to your account when the balance
is positive
and holds on transactions and deposits are purposely placed so that NSF Fees may be assessedAs a fully disclosed program, the information
regarding
your
concerns can be found at:

To address
your specific concerns,
Desert Schools authorizes and pays transactions using the available balance in your account
rather than the actual (ledger) balanceThis can cause some confusion
as Online Banking
and your account statements only display the actual
balance when a transaction is postedHowever;
if you need to inquire on what your available
balance was on a specific
date and what items were on hold, our Member
Assistance Center or branch location can assist you.
In addition,
Desert Schools will place
a hold on your account
for any authorized debit card transactions until the transaction settles
Holds on funds and the order in which transactions are posted may impact the total amount of NSF Fees assessed.
I hope this information helps answer your questions regarding
the program and when fees will be assessed
apologize that that when contacting the Manager at our Gilbert
branch, a more in-depth explanation of how the Privilege Pay program works was not providedThe Manager will be coached
to ensure this does not happen again to other members.

disconnected before he was able to provide you additional informationJamie did make additional
attempts to reach you but was unsuccessful
in doing so.
In an effort to minimize the number of NSF Fee incurred on your account a
recommendation is to withdraw your entire Privilege Pay limit either
at a branch location,
using a check drawn on your account
or at an ATM and then
use the cash for your purchases rather
than swiping your debit card multiple times at merchant
locationsProvided there are no other items on hold, you would only incur one Paid NSF Fee for the branch or ATM withdrawal.
Although the fees assessed
were
properly
applied,
we
recognize
that
incurring
these
fees
can
be
of
concernTherefore, I have
reversed
an additional five NSF fees (in addition to the six you had reversed previously)By the time you receive
this
letter,
the
credit
of $will already have been
applied

This isn't a response to resolve the complaint but a...
response to say they will work into this latter. The complaint is still unresolved and this matter needs to be looked into. In addition to the funds I want to be reimbursed, this bank's transaction processing needs to be looked into by either the NCUA or the FDIC to ensure they are processing transactions in a legal, fair, and non-deceptive way.

I feel that the fact that you are doing business with another bank that is predatory and has not been available to contact should now be the responsibility of the bank who signed me up for these services. Telling me sorry can't help you when you have made some sort of profit off of this by...
applying your own personal customers for their services means you need to do a little more than sorry can't help you.

Schools. A copy of your complaint was received in our office on May 30, 2017.The complaint indicated that you believe actions taken by Desert Schools violated the Fair Debt CollectionPractices act (FDCPA) and the Fair Credit Reporting Act (FCRA).Your first concern focused on a call that was made at your place of employment, Wells Fargo Home Mortgage.
The concern was that a message was left on your supervisor's voicemail regarding your past due auto loan and
that act may have violated the FDCPA. After researching the call, it was determined that the collector's actions were reasonableand within the guidelines of the FDCPA. The collector left a general message and did not provide details of the account or the purpose of the call. The FDCPA section 805 (3) states that collection calls cannot be made at the consumer's place of employment if the collector had knowledge that calls are prohibited. When the call was initiated, the collector had no knowledge that calls were prohibited until you return the call and explained that the number was not your work number. We
have removed the number and no further calls will be placed.The second p*rt of the complaint addressed your concerns of your
credit report information being pulled without your consent. You felt that this was a violation of the Fair Credit Reporting Act (FCRA). The FCRA section 604 (A) (3) states that consumer reports can only be generated for "Permissible Purposes". Collection activities on an account qualifies as a "Permissible Purpose" under the FCRA. In addition, Desert Schools has a signed Consumer Loan application from you giving authorization to verify information, employment and obtain credit reports. A copy of your signed Consumer Loan application has been provided with the letter. As part of the collection practices at
Desert Schools, *consumer report is generated to obtain more information, especially when contact attempts using current account information are unsuccessful. The collector's action in pulling a credit report to gather more information was reasonable and within the guidelines of the FCRA.I appreciate the opportunity to respond to the concerns outlined in your letter. I hope my response adequately
