Per letter sent by the above persons submitted 3/2/17, the following is supplied in response: The facility received *** *** social security check in January via EFTI spoke with *** *** the second week in January about thisShe was understandably upset since her son hasn't been at the
facility since December of and the facility never received his social security check while he was hereI informed *** *** that I would have to call the social security office about the error to discover whyThe facility recently changed ownership and I was hoping that the January check was an anomaly because of the change and paperwork filed with Social Security to that effectI called the Social Security Administration office in Odessa, Texas February 5, after the facility received a second social security check for MrMayoI explained the situation to the customer service rep who answered the telephoneI informed her that I needed to either return the monies to Social Security or issue a refund to the recipient but I was concerned that if I sent the money to *** ***, Social Security would discover their error sooner or later and issue a recoupment through the facility trust fund into which the check was deposited by EFTThe last owner of the facility had that happen several times; it is then extremely difficult for the facility to then get money from the familyI am looking out for my employer; my main objective is to collect monies, not to lose it through lack of patience with the slowness of the Social Security systemThe customer service rep stated that either the recipient, his mother, or the facility in which he now resides apply for Representative Payee so the checks will be issued correctlyAfter the Social Security office received the Rep Payee application, they would issue a refund request to Hogan Park NursingI called *** *** immediately after I hung up with the Social Security Administration and left a voicemail as to what I had discoveredI offered to help her with the Representative Payee application as wellShe did not respondI called my corporate consultant and made her aware of the situation, tooI called *** *** again several days later when I didn't hear from her; I left another voicemail messageWhen she still did not respond, I assumed that she had taken my advice and had someone file a Representative Payee applicationIt takes the Social Security Administration at least one month to complete the application and send the check to where it needs to beSince it appears that *** ***, her son, nor the current facility has not filed a Rep Payee application, I will refund the monies to *** ***I will expect the Rep Payee application will be filed forthwith to avoid this situation in the futureI would also require that *** *** advise me when the application has been filedI will send a copy of this letter to the Social Security Administration in the hope that they will not issue a refund through automatic recoupmentIn the event a recoupment occurs, I would ask that the family refund those monies to the facilityPlease let me know if you need anything else
