We have visited the home in question and concluded;
the issue is a minor leak that could be easily repaired in a few daysIt was

 Design Homes resolution was only a portion of the cost.  That is not satisfactory since the issue is Major Structural and is covered under MN State Code for repairs due in the 10 year time frame leaving them 100% liable.  And due to the manner of the issue, it will be difficult to even forecast materials & labor entirely since much of the issue will not be revealed until more of the house is taken apart.  This includes under shingles, chimney chase, wall in basement below were leaking has occurred.  Design homes has stated the home was "as is" and again that does NOT pertain to a major structural issue.  The house was NOT build to code and there is currently an investigation being made by the State of MN Code & Licensing Division Enforcement area.  I stated to Dan when I emailed him the last time that if his resolution was not in my families best interest, I would take legal action, which I have.  We are also speaking to a Toxic Tort lawyer in regards to the illnesses suffered by my family over the past couple of years due to the massive mold infestation.   There are also other issues with the polystyrene under the siding and that too will be addressed.  The siding will have to be removed to examine the other seams of the house.  The small area uncovered already showed a 4 foot section and a corner of the polystyrene that was NOT sealed with tape as said in the blueprints.

Review: November 8, 2010 we had a house fire that completely destroyed our home. Displacing a family of 6 we found temporary residence. We had decided to purchase a modular home so we could get our family back home as quick as possible. The home we purchased was discounted as it was a display home, even better then we didn't have to wait for a home to be built. We were aware the home was "as is", which addressed things as the linoleum that had tears, some dings in the doors, etc. Not a major construction issue. Over the past year plus there have been several unexplained illnesses in our home, especially with my youngest. We had discovered a major black mold infestation in our living room. Continuing to pursue the source, took apart sheetrock on the living rooms walls only to find black mold from inside all the way to outside. Yet, trying to find the cause, our contractor looked around the chimney only to discover that the house was not build to code. There was flashing missing completely on one side of the chimney, on another side the flashing didn't even come to the corner and the house wrap was not over top of the flashing as it should be BUT underneath, still leaving access for water entry. This falls into MAJOR construction issues and would not fall into the "as is" statement as given by Design Homes. Major construction defects must fall within a 10 year time frame - as this does clearly. We have already made calls to PFS (their inspection company), HUD and the state inspector - my family is living in a massive mold infestation and Design Homes has no concern for the already occurring health issues. We have not even looked into the basement bedroom yet for possible issues there from water run off. My family has been through so much and now we have to fight for what is right.Desired Settlement: ALL materials and labor costs be covered 100% by Design Homes.
