Deck FAILURE
I had this "contractor" put a deck around my pool in 2010. It is now 2020 and I am in the process of putting a completely NEW deck in. From the moment this deck was done it was not done correctly. The material was not cut right, pieces put together incorrectly and now I have to pay to have his work completely ripped up and done over. The best part is he DID NOT USE PRESSURE TREATED WOOD. I didn't find this out under the deck started to "buckle". Thank goodness no one was hurt. Do not use this company!

Review: [redacted] made a contract to build a 12 feet by 30 foot deck for my pool. Start date was may 7 finish date was to be may ** 2013. Its june ** 2013 and the deck has not been completed. The contractor was barely at the work site. Never did what he said he was going to do. After realizing that the deck was not done correctly and asked him to take the flooring apart because it was buckling he claimed that it was a beautiful deck. Poor service and craftsmanship. Refuse to repair the problem and when I said I wanted to use a different carpenter of my choice he walked off the job. $7000.00 dollars later I now have to spend an additional price to tare down the deck and rebuild to pass inspection. Stairs was the worst. Looked underneath and saw shimming to level the stairs and concrete slap that was done so poorly it must be replaced.Desired Settlement: Would like contractor to pay for the new contractor who has to repair my deck. An additional $6000.00 dollars

I have been a designer and builder for 34 years

Just a few of my client list is HGTV, FOX SPORTS, ESPN, NEW ROC CITY (New Rochelle, N.Y.), Princess Diane Von Furstenberg, Clint Eastwood and Family, Sir Paul and Linda McCartney, Mark Messier (6 time Stanley Cup Champion) etc. etc.

The reason my Portfolio of clients are such, is due to Design, Execution and End Result.

Your complainant Mr. [redacted] met me through a mutual acquaintance. This acquaintance as well as myself, could not understand how Mr. [redacted] being a head representative of a Union in New York City knowing so many builders and contractors would not and could not get ANYONE to do any work for him at his home. Oh well we're a nice enough company we will do a great job for him. (A FLAG SHOULD HAVE COME UP FOR ME THEN, EVEN THE POLICE OFFICER WHO WAS WITH ME ON THE LAST DAY OF THE JOB AT MR. [redacted] HOME ASKED ME WHY WITH SO MANY CONTRACTORS AND BUILDERS IN ORANGE AND ULSTER COUNTY HE WOULD SEEK ME OUT 3 COUNTYS OUT AND ACROSS THE RIVER?)

Now prior to this complaint I had done a very specialized roof for Mr. [redacted]s home, which he was very happy with. (now here is where it begins, the reason he was in good spirits when the roof was being done was because (bear with me here I couldn't make this kind of stuff up!) the Giants were well on the way to the super-bowl, that's right so life is good! For Mr. [redacted]

Now its time to do the deck, The Yankees are doing poorly and the Giants have just bit the dust.

Time for everyone to walk on eggs around Mr. [redacted]. Now nothing is pleasing him.

There is a protocol to building that Mr. [redacted] didn't wish to understand, first the plans are submitted to the town, then the town makes sure all the paperwork is in order then schedules a date for a pre-inspection according to the submitted plans. (Mr. M's response was "I don't have to wait this is BS they can't tell me what to do)

Anyway I waited for the Building Inspector and according to my plans I was given an approval (1st approval) to proceed.

Now if anyone recalls May happen to be a VERY rainy month it must of rained every other two days it broke the record for rain in the month of May. I had to dig holes for foundation columns not good weather for it. (I'll spare you his continuing colorful remarks) ...Holes were dug building inspector observed the depth and approved for the pouring of the concrete (2nd approval).

I'll skip the ducking in and out due to the weather and the owners not understanding why I don't just camp out in his back yard so the very second the rain stops I can continue working and I'm on the job!

Now the structure is up (deck without floor decking or rails) and the building inspector must check for structural stability. Passed again..(3rd approval)

I purchased top grade decking beams to lay on the deck no screws showing. Mr. [redacted] insisted on having it stained right away so I asked for color and type of stain (I would have waited atleast 30 days for the wood to be acclimated but he went on about events he was hosting at his home and didn't wish to wait) After assuring me of the color and stain through photos and texts we stained the wood. Days later he asked why the hell would I stain the wood that color? (Auggh!) He said he never said to stain it that color. I wished to show him the texts and photos but he said he didn't care he never said that and that's that!. So I removed high grade deck beams that we stained and replaced them with new ones at my cost for labor and materials.

He also at another occurrence once apologized to me in text but only once! That he had gone on a drinking binge. Ok so there goes his behavior and his memory.

Now we were asked (by the building inspector) as a courtesy to build part of the railing and the steps so it can be viewed to check for height and spacing as this was a very different type of deck design. We did just so, and the building inspector liked it and told us we can continue, (4th unofficial approval)

He also noted due to now fully seeing and understanding the design that he would like to add to the cantilevers (that is a structural member projecting from a vertical support) We agreed and did so

The last working day I saw Mr. [redacted] I had worked for 14 hours on the deck with 3 of my workers at the end of the day it was night but he said he was very happy.

The next day a Sunday the mutual acquaintance of ours had stopped over to see the deck and Mr, [redacted] told him he was very satisfied and the mutual friend looked and walked the deck and agreed it was a beautiful deck.

Monday I had doctor appointments and business meetings and had plainly told him that on Saturday night when I left after the 14 hour day. So now on Monday morning he HATES the deck its a piece of %#$#$

He had made a buddy that night with a contractor he just befriended and now the deck is worthless he wants to rip it completely out of the ground, concrete and all --- and he did!!! and now he wants me to pay his new found buddy contractor for ripping it out of the ground and redoing it completely.

Sorry not going to happen and there will be no negotiation. He never let me finish the work. He ordered me to leave so the final inspection could not be performed as I was not allowed to finish the work and he signed a complete release for me. But I guess he also doesn't remember that either.
