In response to the complaint here stated, I wish to say that I have tried to honor my workmanship warrantyAfter the problems manifested themselves I have tried to offer to replace a great portion of the roofMr** ** *** came to my office last Thursday to deliver a letterWhile he was here I
proposed that I will have one of my roofers take a look at his roof to verify what needs to be done to make him wholeI told him that I would cover the cost for both material and laborThe interior damages and some exterior was going to be taken care off by himHe will use the funds from the balance owed on the $27,contracrtual agreement between usThe balance owed on the claim was $13,I had gotten from Mr** ** *** $13,He later told me that he no longer wanted me or anyone associated with me to step foot on his property and that he will hire someone else to do the workIn so doing he will have me pay him directly so that he can pay whomsoever he contracts withSomehow along the way there was a misunderstanding on the course we were going to takeMr** ** *** said he didn't trust me anymore and that he no longer wanted to deal with meI am trying to make it right

To help resolve this complaint I am also going to involve the [redacted] to go out and inspect how much of the roof needs to be repaired. Once again I am committed to getting the matter resolved.

Regards,
I would agree, if Mr. A[redacted] and O & M Construction work was dome in a workmanlike manner and our roof did not need to be replaced.  Mr. A[redacted] took my deposit and lied to me more that one time. On Saturday June 9, he agreed to give my deposit back because the roofer he sent to determine the needed repairs said the roof had to be replaced.  Then He changed his mind.  Mr A[redacted] lied to us when he was selling the roof to my wife and I.  he said he would have two workers on the ground picking up the removed shingles as they fell.  he said the area around the house would be protected.  he said he would use ice and water shield along the dormers and in the valleys. He said our gutters would be protected.  None of these things he said he would do, he did.  He lied to gain our confidence then he didn't perform the work with competent workers.  I am willing to take the 13,888 he keeps mentioning, our deposit, and forgo the cost of repairs to damages caused by his workers and O & M lack of supervision if he pays before August 12, 2016.

I do not wish to ever step on Mr. [redacted]'s property. In principle I cannot give him back the initial payment of $13,888.75 which was spent on the initial material order and labor. The total contract was for $27,777.50. We agreed for him to keep the remaining balance of the contract which was $13,888.75 to take care of the other repairs. Those repairs totaled according to Mr. [redacted]'s estimate around $8000.00. The $13,888.75 more than compensates him for those repairs. In short if I am willing to pay to repair the roof and he retains the remaining half of our contract, which will leave him an extra $5,888.75 after the $8000 spent to do the other repairs. Now if he wants me to hold him to the contractual agreement, then I would gladly pay him the cost to repair the roof including material and labor. Nevertheless he will owe me the difference of $5,888.75 between the other repairs ($8000.00) and the balance owed on the agreement of $13,888.75. In other words Mr. [redacted] wants me to return the initial payment of $13,888.75. He also wants to keep the remaining $13,888.75 of the agreement.

I spoke to [redacted] today. She accepted my offer to reimburse her for the repairs she has done so far. I will be sending my gutter guy to assess the gutter issue.
