On 01/04/*** *** purchased an Chrysler 300M At that time he was issued a WE OWE (see attached) to inspect and repair his Traction and ABS light Please note that at the bottom of the WE OWE in large print it states that the customer must call the service department to
schedule an appointment within days or the WE OWE is void No repair center tells a customer, for example, to have their vehicle there at a certain day and time due to possible conflict with the customers schedule As a courtousy we work around their schedule and let them set a time that is convenient for them.It is unfortunate that Mr*** did not schedule an appointment with the day time period to have the repairs done We can not reimburse money for the repairs due to circumstances

[I am rejecting this response because: The response from Destiny Auto Sales is not accurateThe paper work attached states they will check the brakes and tires on the truck, it does not mention any down payment being required firstWhen I called them to schedule this work I was told they did not have a mechanic at their location to complete the workWhen my truck broke down on the side of the road, it was after their business hours so contacting them was not an optionI had to pay to get the car towed, and as previously explained I paid for several other repairsThis vehicle is my only means of transportation, so obviously leaving the vehicle on the side of the road or leaving the dead battery would not be an optionI missed time off of work trying to get the vehicle running so they could take a look at it I contacted *** and advised her of the money I had been spending and again she stated they did not have a mechanic there, and that I should not have spent money on a vehicle that was not mineI explained to *** the amount of money that I spent on the repairs and told her I needed them to work with me on the remaining down payment, because I had already spent more in repairs and tow fees than the down payment amount they were requestingI told her I could bring her $on 2/6/because I needed to get the paperwork from them to register my vehicle with the BMVWhen I got there after work on 2/6/15, *** was not thereI talked to a man that said he didn't know anything about my conversation with *** and that he could only write me a receipt if I wanted to give him the $I understand that I bought a used vehicle, but it doesn't make sense that a dealership would sale a vehicle in that bad of shapeIn less than days I have paid for tires, a battery, brakes, a wheel barring, etc, the $car note in addition to the fact I was told not to mention to the bank/finance company that I still owed a down paymentI feel like this company is not selling quality vehicles, and operates with some shady business practicesI should not have had to spend this much money out of my own pocket on a vehicle just purchased

What Mr*** is implying is falseFirst and foremost he signed the payment arrangment on the remainder of the down payment and defaulted that agreement prior to making ANY repairs to his vehicleAs I previously stated Mr*** never once called the dealershipIt wasn't until I phoned him attempting to collect his debt did he mention he had a flat tire and had to get the vehicle towedAt that time I ask him if he had a mechanic look at the vehicle and he told me no not yetI further advised him that the only "we owe" work that was promised to him was that we would check brakes and advise and check on a pre owned tired (one)I have sent in that we owe that was signed by Mr***This is a used vehicle and when purchasing a used vehicle it is the customers responsibility to check out the vehicle and negotiate any work they want done prior to purchasing the vehicleMr*** did this himself and stated his only concerns were the brakes and tireI set several dates for him to come in to the shop and he never showedEvery conversation we've had had been me calling him to attempt to collect the debt and then being told about repairsHad he paid the down payment money he would have been calling up I'm sure but he knew he could not do that because he owes us moneyWe extended a cortousy to him by even allowing him to take the vehicle without paying the money up frontAt this time we would be willing to do only the work in the we owe and only upon receiving the remainder of the down payment money.Thank you

My vehicles break lines were rusted and the oil was leaking out of the lines which caused my breaks not to work properly which I have emails that I can send in between me and the guy *** who sold me the carThe company should have payed for my car to be towed back to thier location within that daysIt is unacceptable that a car lot expect you to drive a car that is at risk of having its breaks completely fail while your trying to continue to drive it somewhere, let alone drive it all the way back to the car lot while your break pedal is touching the floor because of the lines being rusted outSoon as I get home from work I will send files of emailsAlso I will send files showing that I payed to have the work destiny auto sales was supposed to repairThese businesses these days are con artists and thats why I will never go to a used car lot ever againThis is a disgrace that this company would come up with such an excuseThey should be ashamed of themselves

On 12/26/*** *** bought the above vehicle from usAt that time we told him we would check the brakes and advise as well as checking on a pre owned tire, as in One (see attached)We never agreed or mentioned tiresMr*** never completed his down payment and defaulted the
arrangement madeMr*** was informed that we dont do any "we owe" work until the down payment is complete I phoned him several times in regards to the down payment and was told he "didn't have it"My second time speaking with him he informed me that "something" was wrong with the truck but he had not had a mechanic look at it yet I told him I would assist him with getting our cost on any parts needed as well as cheapier repairsMr*** was suppose to come in and talk to me then and never showedI then phoned him again on 01/19/and was told again he did not have the money he owed usHe went into the same speech about the cars repairsI again told Mr*** that if he would have paid the down payment owed instead of taking it upon himself to pay for repairs we would have fixed the issues we agreed to but we obviously can not put money into a vehicle that the customer owes us money onI did tell him at that time that even if he set a payment and promised to be in before thenAgain, he did not showSo I contacted him again on 02/02/and it was a repeat of the two previous conversations with a promise to be in this coming friday 02/06/Mr.*** never once contacted our dealership concerning any problems with the vehicle Only after I phoned him attempting to collect the money owed did he mention any issues.If you have further questions or concerns please contact me at the above information
