I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The business' resolution is rejected because the proposed action that the "loan modification and all other issues relating to the servicing of the mortgage loan…be directed to [redacted] as the servicer for the mortgage loan." was done prior to filing this Revdex.com complaint in April 2015 through the Consumer Financial Protection Bureau (CFPB).  [redacted]'s response to that inquiry contradict's the business' response statements that 1) "DBNTC is the Trustee" not the owner of the mortgage, 2) "DBNTC has no beneficial ownership interest or stake in the  mortgage loans in the trust and instead only holds title to the loans solely for the benefit of the investors, and 3) "[redacted]…as the loan servicer,…is solely responsible for managing any activity concerning the mortgage loan."  In response to the CFPB inquiry earlier this year, [redacted] provided and referenced the attached loan modification denial letter dated December 19, 2013, wherein in [redacted] stated that the sole purpose of the loan modification denial is "The owner of your loan has very specific, technical guidelines for participating in the government's [redacted] program and your loan falls outside of the requirements."  The letter further identifies "according to our records, Deutsche Bank National Trust Company as Trustee for [redacted] Series 2007-A5 Mortgage PassThrough Certificates Series 2007-E is the owner of your loan."For the above reasons, because [redacted] and the business's responses are in conflict in which the business claims to be a non-owner without beneficial interest in the mortgage loan and that [redacted] services the mortgage loan independently; and [redacted] claims that the loan modification was denied because of the owner's guidance, and because [redacted] identifies the owner of the loan mortgage as DBNTC, I reject the business; response to contact [redacted] for resolution.  This action was taken and [redacted] indicated that the owner's, DBNTC's, technical guidelines are the basis for my loan modification denial.

Review: Loan Modification policies that discriminately disallows the bank's service provider, [redacted], to approve a loan modification that is authorized under the [redacted] for underwater homeowners. On two occasions, 2013 and 2015, [redacted] in accordance with Deutsche's discretionary policies contrary to existing [redacted] authority has denied our loan modification applications, despite proven severe decline in our home value and documented severe decline in our household income due to Mr. [redacted]'s permanent disability status. The basis for the denial is "The owner of your loan has very specific, technical guidelines for participating in the government's [redacted] program and your loan falls outside of the requirements. Because our loan is not backed by [redacted] or [redacted], my husband and I have lost the opportunity to take advantage of refinancing through [redacted] and are subject to the discriminatory policy of Deutsch Bank National Trust Company as Trustee for [redacted] Series 2007-A5 Mortgage Pass-Through Certificates Series 2007-E. Because of the legal maze of ownership, we are unable to speak directly with anyone within the bank that actually owns our loan regarding our personal situation. [redacted] will not release contact information for the bank, and Deutsch Bank redirects our phone inquiries to [redacted]. It is a vicious cycle designed to disable the customer.

Under any peer bank standards, our circumstances more than qualifies for a loan modification. However, because we have not missed a monthly mortgage payment by subjecting our family to gross financial hardships in other areas of our household, [redacted] acting under Deutsche's "technical guidelines" keeps our family economically strapped and oppressed.Desired Settlement: Approve our loan modification request based on the hardships of 1) more than $200,000 decline in property value since 2007, and 2) loss of husband income due to permanent disability status and inability to work since 2012.

Review: Loan Modification policies that discriminately disallows the bank's service provider, Bank of America, to approve a loan modification that is authorized under the Hamp or Harp Program by Mr Obama for underwater homeowners. On two occasions, 2014 and 2015, B of A in accordance with Deutsche's discretionary policies contrary to existing BofA authority has denied our loan modification applications, despite proven severe decline in our home value and documented severe decline in our household income due to Mrs. [redacted] permanent disability status. The basis for the denial is "The owner of your loan has very specific, technical guidelines for participating in the government's FED programs and your loan falls outside of the requirements. Because our loan is not backed by Fannie Mae or Freddie Mac, my Wife and I have lost the opportunity to take advantage of refinancing or modifying through BofA and are subject to the discriminatory policy of Deutsch Bank National Trust Company as Trustee on Behalf of IMPAC Secured Assets Corp. Mortgage Pass- Through Certificates, Series 2006-4. Because of the legal maze of ownership, we are unable to speak directly with anyone within the bank that actually owns our loan regarding our personal situation. BofA just released contact information for the bank. It is a vicious cycle designed to disable the customer. Our families gross financial hardships in other areas of our household, BofA is not authorized to help and is acting under Deutsche's "technical guidelines" keeps our family economically strapped and oppressed. I would also like to add to this complaint that DBNTC in Santa Ana CA office is showing a lease sign, and is s subject of a new movie called The Big Short. They still may be under investigation by the DOJ, and may be shutdown.Desired Settlement: I believe that we should be able to modify our home and be able to keep it. I also believe that DBNTC should be an investor and owner of my loan through [redacted] because of their practices and being involved in the meltdown of 2007-and 2008. So I want my desired outcome to be is to Approve our loan modification request based on the hardships of 1) more than $227,000 decline in property value since 2007, and 2) loss of husband income due to permanent disability status and inability to work since 2013.

Review: I have applied for a loan modification but was denied due to investor restrictions. This restriction goes against the making home affordable act.Desired Settlement: I am wanting for the investor to get rid of the balloon payment on the loan, reduce the principal to the fair market value and then redo the loan at 2%. Also requesting that the payment amount be reduced to at least 700.00 with a fixed rate for the completion of the loan.
