We received your letter and phone call on March 18.  This is response to complaint ID [redacted]. With regards to the [redacted] project ([redacted]) there have been several scheduling issues, however, we are within the bounds of the contract.  To address the complaint regarding no...

“updates” work has been submitted and uploaded to his server along with presentations of videos and screen progress shots during the course of the project [as it stands the project is not complete].  Although the project did not proceed as fast as the client would have liked both sides experienced scheduling issues, [redacted] taking 1-2 week trips at least 2 if not 3 times during the project where he was unreachable and had delayed responses.  On our side (Dev Team 7) we had scheduling and sickness issues to contend with preventing us from meeting an aggressive schedule.  Although we are not required in accordance with the contract to refund nor was there a delivery date requirement in the agreement, we have offered the client a refund in order to part ways amicably and at this point he has refused to accept the refund.Dennie G**Dev Team7, LLC

Complaint: [redacted]
I am rejecting this response because:1. It is a lie that work has been uploaded to my server (assuming he means the AWS server)- total data transfer to my server amounts to a few MBs since inception. Hardly enough to represent any meaningful work.2. It is true that twice I was presented with short video screenshots, but only to show some superficial data entry pages. Again, no meaningful work. Once I was given access to his home server to view an early prototype dashboard. Again, no meaningful work. 3. It is a lie that we do not have an agreement on project delivery. It is not in the contract (an oversight on my part, and what now looks like a purposeful omission on Dennie's part), but it is in the written proposal that I accepted and on which the contract was based. Furthermore, there are multiple instances in subsequent emails where Dennie promised to deliver either updates or completed work, yet failed to do so.4. It is a lie that my travel schedule contributed to any delays in work. On the few occasions where I planned to be in transit and unreachable for 1 or 2 days at a time, Dennie was informed beforehand to ensure it wouldn't cause problems and that he would have plenty of work to proceed with.5. It is a lie that there were delayed responses on my part. Dennie and I have an extensive email record that illustrates that it is himself who often failed to respond to me in a timely manner.6. It is true that Dennie has offered a refund. What he has failed to disclose is that he is offering the refund only on the condition that he keeps the rights to the work. MY WORK. This would create an intolerable risk of malicious claims of infringement as I move forward with another developer and furthermore create a risk that he shops my business model and platform ideas to a potential competitor. He has also failed to disclose that he has been offered a fair separation of rights whereby I explicitly protect myself from the mentioned risks, but leave him free to use whatever code he has created for his own purposes. He has not even bothered to respond to that email or the follow up.7. Dennie has also failed to disclose that he offered to keep my deposit and handover all work in it's incomplete state.... SIGHT UNSEEN. That's right, he wants to keep my deposit and hand over a body of work that he will not agree to have reviewed by a competent third party.8. Dennie is a failure on many levels and he can not be trusted to deliver in any capacity.
Regards,
