D.F. Clark, Inc. was hired by the [redacted] Family (Client) to conduct a Title 5 Inspection on their septic system as required by the Commonwealth of Massachusetts regulations for a property transfer which we performed on July 15,2017. As in other communities, Rockport has additional local...

regulations, one of which is in regards to acceptable standards for access covers to grade.    As part of the inspection our inspector noted that the covers did not meet local requirements and installed safety grates on the system for the cost of $75.00 as approved by the homeowner.  Unfortunately, the safety grate did not meet Rockport’s local requirements but that of another Town with similar requirements, a mistake on our inspector’s part.   The inspection report was submitted to the Rockport Board of Health and upon the review by the Board of Health, the discrepancy was discovered and the health agent notified us.   In turn we notified the homeowner of the discrepancy and offered to remove the safety grates and refund the $75.00 fee.  We also provided to the homeowner a verbal estimate to install the correct covers  that will meet the Rockport regulation.  The cost estimate for the installation for the proper covers is $900.00; which would be a net change with the $75.00 refund of $825.00.   In conclusion, whether we installed the proper covers at the time of the inspection or if we install the covers now, the cost to the homeowner would remain the same.

I paid for a service of bringing the septic covers up to code.  They used the wrong parts due to their negligence of not knowing what town they were in.  I paid for a service, they should remove the wrong parts and install the correct parts to bring the covers up to code at their expense, which is the service I paid for.  What other items, can be raised in the future due to their use of the wrong codes/rules?  We will have to pay more again?  We paid for a service they should deliver the service, use the correct parts, and not have me pay for mistakes made due to their negligence.
