Review: We purchased a [redacted] business liability policy through DHF Agency in [redacted] (it looks like they went through [redacted] in Oregon). We previously filed a complaint against [redacted] but we were told to pursue DHF Agency. We purchased this policy as a requirement for the commercial kitchen we were using to cover us in the kitchen as well as for the markets we are participating in. When we went to switch kitchens on the policy we found out that we were never covered for the kitchen. [redacted] thought the kitchen- A Taste of Long Island- was a farmers market. When we went to add the new kitchen- Kitchen Co-op- it was discovered that we were not covered. We would have never paid $492.50 (plus $100 broker fee) for a policy that did not even cover us for the kitchen! I am relieved that we did not have an issue where we had to file a claim and find this out the harder way! We found another policy through [redacted] right away that covers us in the kitchen as well as farmers markets so we need this refunded right away. We are a new business that cannot afford to throw $492.50 (plus another $100) down the drain when this was not our error. I have been emailing with [redacted] from the DHF Agency and her stories keep changing. When we switched kitchens and wanted to update our policy I spoke with [redacted] and she said that she found out [redacted] does not cover us in the kitchen and that they made an error listing them because they thought [redacted] was a farmers market. She got a quote for us to cover us in the kitchen for $1200 (if I recall the correct number) which would be ridiculous to pay this on top of the $500! Now [redacted] is saying that she thought I had coverage for the kitchen elsewhere and that she was just providing an events policy. If this were the case why would she say [redacted] made an error? and why would she even contact [redacted] to change the kitchen listed on the policy? I never said we had coverage elsewhere. We received a quote from [redacted] to cover the kitchen and markets for $637 (can provide) before deciding to go with [redacted] for $492 plus $100 broker fee for the same coverage. When I found out that we were not covered for the kitchen (which is a requirement by the kitchen) I immediately got coverage through [redacted]. I expect to get all or some of the $592 back for the policy that did not cover us for what we asked along with the stories changing. The website for DHF now pulls up something different so I am not sure if this is still in business which also seems shady.Desired Settlement: I would like my money back for the policy I purchased ($492.50 + $100 broker fee).

Response:

0n 6/**/14 I sent [redacted] from [redacted] the paperwork to bind coverage for her business liability policy. She informed me that she got the insurance elsewhere. After looking into it further, it seemed that another broker had taken the quote I had originally given her. I explained to [redacted]) that I could recoup her business if she wanted to continue with me since I had originally quoted her and that she can sign a broker change form. On 6/**/14 I received an email from [redacted] stating that the [redacted] company declined their application due to the fact that they were selling their product in Farmers Markets. I asked her if she was selling only at Farmers Markets or in stores as well and she stated that they were predominantly selling at Farmers Markets, the A [redacted] store and looking for other establishments to sell at. On 6/**/14 I sent [redacted] an email stating the following, “Since you are working with Farmers Markets at least for this year - it will cover you for that until you are established in selling you food in a store. I will list Taste of LI as an additional insured – is there another Farmers Market you know of that will need to be listed?”

On 6/**/14 I sent over the contract which was a third party vendor through [redacted], it was called [redacted]. Their contract stated that: “All event policies are fully earned once bound”. It also stated that the policy was for a [redacted] Policy for a single vendor. [redacted] included in the contract the 3 Farmers Markets she needed certificates of liability for. [redacted] signed and sent it back, along with the full years premium, as the contract stated. Every email thereafter was regarding other Farmers Markets they needed to add and needed certificates of liability for, which they were provided. On 6/**/14 they received certificates for 3 Markets they were attending. On 7/**/14 [redacted] requested an additional certificate for Flea Market [redacted], with a new kitchen to be listed as an additional insured, to which they received one. On 7/**/14 they asked for a certificate for the Village of [redacted], and on 7/**/14 they asked for an additional one for the [redacted]. I also called [redacted] on 7/**/14 to follow up on questions she had regarding property coverage. In this conversation she realized she was not covered for the Kitchen under a business liability policy. There was a misunderstanding as to the fact that the other broker was covering the [redacted] policy because she now had coverage with [redacted] for the Farmers Markets, when in reality they never continued the other policy. We offered her another policy through [redacted] again but she explained it was too much premium. I suggested she research on her own some companies as an informed consumer because I only had access to the ones I had offered her and they all had the kitchen liability coverage separate from the event policies. On 7/**/14, [redacted] informed me that they found coverage through [redacted]. I offered to see if we could get any pro-rated funds from [redacted], even though the contract stated premiums are fully earned at inception. On 7/**/14 the request was sent to underwriting management who declined any refund due to the contract stating the premium was fully earned at inception, the insured signed as an acknowledgment of this clause and [redacted] had done their job as per the contract, they provided them with at least 6 certificates of liability for the Farmers Markets they were taking part in. I can understand [redacted] and [redacted]’ frustration in this matter. They felt they were covered for something they were not and it was a miscommunication, but they are asking to be reimbursed on a policy that did its job. It provided them with the coverage they needed, if they did not have it, they would not have been able to participate in the 6 markets they were provided coverage for. The fact that they were able to find a company that provided them with both coverages for kitchen and farmers markets at a lower premium is great- that is what informed consumers do on a daily basis at their renewals or otherwise to find better rates. I am not the company that provided them with coverage- it was [redacted], so if there is a complaint and a demand for a refund, it would need to be addressed to them. I did take initiative to try and get a refund for them but their underwriters refused it due to the fact that they did provide a coverage where there was a need and it specifically stated in their contract that premiums are fully earned once bound. They would need to contact them directly to escalate this matter. For the record, my website has never changed, there is a placeholder there with my contact information. Since I work with several wholesalers to provide insureds with coverages, they are directed to their sites directly.
